Prepare a flow chart of the immigration procedure based on the following

materials: International Extradition Law, Migration Law and Regulations of


the Migration Law.

Then solve the following questions:

1.- Do Syrian nationals or residents require a visa to enter Mexico?


In this case I have two assumptions:
*If you come to Mexico for reasons of temporary or permanent residence, you do
need a visa, according to art. 40 section IV of the Immigration Law, which allows a
foreigner to appear in any place destined for the international transit of people with
the aim of staying for a period of no more than four years.
* If they come to Mexico for reasons of application for refugee status,
complementary protection, determination of statelessness, for humanitarian
reasons or causes of force majeure, in accordance with art. 37 section III
paragraph e) of the aforementioned law, do not need a visa; Likewise, this is
provided in article 42 of the law in question.

2.- What legal situation does the family have?


As can be seen from what has been mentioned, your country is at war, there is
poverty, inequality, violation of human rights, unemployment, lack of political
freedom and, therefore, there is difficult access to food, medical supplies, water,
among others, which has forced thousands of Syrians to leave the country.

3.- Are they candidates to remain in the country? If this is the case, state
under what immigration status.
Yes, they are candidates to remain in the country, according to article 52 section V
of the Immigration Law, which calls them VISITORS FOR HUMANITARIAN
REASONS.

4.- What rights does the family enjoy during their stay in Mexico according to
the Migration Law?
According to articles 6 to 15 of the aforementioned law, they have the right to
the following:
 The guarantee of foreign rights recognized in our constitution, treaties and
international agreements to which the Mexican State is a party regardless of their
immigration status.
 Enter, stay, transit and leave the national territory according to the
established limitations.
 Access to educational services provided by the public and private sectors,
regardless of your immigration status, as well as medical care.
 To the authorization of civil status acts and issuance of certificates related to
birth, recognition of children, marriage, divorce and death in the Civil Registry
Offices.
 The guarantee of the claim to reside regularly or regularize your situation.
 They will have the right to the procurement and administration of justice,
respecting at all times the right to due process, as well as to file complaints
regarding human rights.
 They will have the right to recognition of their legal personality regardless of
their immigration status.
 Right to be informed about rights and obligations, requirements for
admission, permanence and departure from national territory, granting of political
asylum, etc.
 If you speak or do not speak or understand the Spanish language, a
translator or interpreter who has knowledge of your language will be appointed ex
officio, to facilitate communication.
 They will have the right to be promoted access and integration of migrants
who obtain the status of temporary residents and permanent residents, to the
different areas of the economic and social life of the country, guaranteeing respect
for their identity and diversity. ethnic and cultural.
