MOST RESPECTFULLY SHOWETH:

1. The petitioner 1s fil ing the present Petition seeking

Anticipatory Bail under Section 528
484 ofBNSS OF 2023.

2. That the petitioner being aggrieved by the order dated:

16.11.2024 passed by Sh. Satbir Singh Lamba, Additional
Sessions Judge, Tis Hazari District Court, New Delhi, in the
FIR No. 202/2024, P.S. Bakhira, District, Sant Kabir Nagar,
U.P. has wrongly and without appreciating the facts
 pertaining to the said case, dismissed the anticipatory bail
application. A copy of the order dated 16.11.2024 passed by
the Ld. Additional Sessions Judge New Delhi is annexed
herewith and marked as ANNEXURE A.

3. That the present FIR No. 202 of 2024 has been registered
against the petitioner on the basis of false and fabricated
facts. The police had falsely implicated the petitioner in the
present matter which is pending before this Hon'ble Court.
Copy of the FIR No. 202/2024 is annexed herewith and
marked as ANNEXURE-B.

4. The present case is classic example of misuse of process of

law at hands of the complainant in connivance with the
police official ofPS.

5. That the brief facts alleged in the FIR are herein under:
a. It was alleged by the complainant that she met with
the petitioner before 6 year who was residing
beside the complainant's house. The petitioner has
physical relation with the complainant about 6
years and the petitioner kept having physical
relationship by prom1smg for marriage with the
complainant. The petitioner kept having physical
relationship without her wishes.
b. It was alleged by the complainant that on
06.04.2024, the petitioner went to the complainant
and again started humiliating to the complainant
 with the intension of satisfying his lust. The
complainant again ask for the marriage to the
Petitioner, on which the petitioner became furious
and beaten up the complainant and raped her
forcefully.
c. That thereafter the complaint filed a complaint
dated: 13.04.2024 before the concerned police
station, on the said complainant SHO of the said
P.S. had not registered the case being found false
case against the Petitioner.
d. Then again on dated 24.06.2024, the complainant
filed complainant before PS Bakhira Distt. Sant
Nagar against the petitioner and his family
members. The FIR No. 202/2024 has been
registered against the petitioner.
1. The petitioner moved an application for anticipatory bail
application before the District Court & Session Court,
Sant Kabir Nagar, Uttar Pradeesh. That the District &
Session Comt has rejected the said application filed by the
Petitioner vide order dated 2.07.2024. A Copy of the
Order dated: 2.07.2024 is annexed herewith and marked
as ANNEXURE-C.
2. That thereafter petitioner has filed an application for anticipatory
bail before Hon 'ble High Court of Judicature at Allahabad.
Meanwhile, the FIR got transferred to the Delhi, and the
petitioner has withdrew the said petition vide order dated:
27.08.2024. A copy of the Order dated: 27.08.2024 is annexed
herein and marked as ANNEXURE-D.
3. That thereafter petitioner filed an anticipatory bail application
before the Tis Hazari District Court. The said bail application was
dismissed by Sh. Satvir Singh Lamba, ASJ, Tis Hazari Courts
Delhi in Bail Matter 1659/2024. Hence, the present petition
before this Hon'ble Court.

4. That the petitioner has not filed any other petition for anticipatory
bail or seeking similar relief before this l-Ion 'ble court or before
the Hon'ble Supreme Court of India and has preferred the present
petition on the inter alia following amongst other.

GROUNDS
A) Because the Ld. Addl. Sessions Judge failed to appreciate that
the complainant has alleged in the FIR that the complainant
was married women at the time making physical relationship.
B) Because the complainant was already married at the time of
making relationship with the petitioner, therefore, no question
of Promise to marry with the complainant is arising on the part
of petitioner.
C) Because the Ld. court failed to appreciate that the petitioner
and the complainant are in relationship since six years.
D) Because the Ld. court failed to appreciate that the complainant
at the time of making physical relation knew that she is married
and cannot marry with the petitioner.
E) Because the Ld. Court failed to appreciate that the complainant
extmting money from the petitioner. The complainant
threatened the petitioner to transfer huge amount but the
petitioner has transfelTed the amount of Rs. 5000 on the date of
the complaint which led to the false complaint against the
 petitioner and his family members. Copy of the statement of
Account is annexed herewith and marked as ANNEXURE-E.
D. That there are no chances that the applicants of being fleeing
from justice and he is ready to cooperate with the police.
F) That the custodial intetTogation of any of the Accused is not
required for any purpose whatsoever in view of the
submissions made above.
G) That the Petitioner is ready to join further investigation and to co-
operate with the investigation officer.
7. That the Petitioner will suffer irreparable lose and injury if the
present petition may not be allowed'
8. That no other similar petition has been filed by the petitioner
either before this Hon'ble Court or before the Hon'ble
Supreme Court of India by the petitioner praying similar relief.
9. That the Petitioner craves the leave of this Hon' ble court to
urge additional grounds at the time of hearing, if the need
anses.
PRAYER
It is therefore most respectfully prayed that this Hon'ble Court may
kindly be pleased to:

a. Grant Anticipatory bail to the Petitioner and Direct the concerned

10/SHO to release the Petitioner on Anticipatory Bail in the event
of his arrest in the above said FIR;

This is an application filed on behalf of the

applicant/ accused Ambrish Pathak for grant of

anticipatory bail.

Copy of reply already supplied. Arguments

already heard. No clarifications arc required.

 Ld. Counsel submits that accused is innocent

and has b een fals ely implicated in the present

ease. Ld . Counsel claims that accused has not

committed any offence and present case is lodged

by the complainant with ulterior motive with extort

money. Ld . Counsel contend s that complaina nt

and accused were neighbour and complainant was

h aving matrimonial dispute in which she used to

take financial support from the applicant . It 1s

furth er contended that when the

applicant/ accused had d em a nde d his back money

and same was evaded b y the complainant instead

the complaina nt started insisting the accused to

marry her, to which accused flatly refused . It 1s

further con tended that in order to succeed h er

notorious design, the complainant started

notorious m essage s, to which th e applicant always

disapproved Ld. Counsel further contends that

when the complaina n t did not succeeded in her

motive, then compla inant started threatening the

applicant to falsely implicate him in false rape

ease and lodged the present case. Ld . Counsel

submits that the applicant/ accused is having

apprehension of his arrest and is ready to join the

investigation. With these submissions, prayer is

made for grant of bail.

Ld. Addl. PP has strongly opposed the present

bail application on the ground that the allegation

against the accused are pertaining to offence of

rape and are same are serious in nature. Ld. Addl.

PP for the state has prayed for the dismissal of the

present application.

Initially the present ease was registered as

Zero EIR in PS Bakh e r a, Distt. Sant Nagar, Uttar

Pradesh and thereafte r same was transferred to PS

Ranhola, D elhi for further necessary action. The

allegations against the accused arc under section

376/323/ 504/506 I PC. It is alleged that the

accused used to live in the neighbourhood of the

prosecutrix and were h aving love affairs for about

six years. It is alleged that accused sexually

harassed the victim on the pretext of marriage.

The victim has duly corroborated h e r a llegations in

her statement under section 164 Cr. P.C.

It is relevant to mention h ere that first

bail preferre d by accuse d / a pplicant before Hon'ble

High Court was dismisse d as withdrawn vide order

dated 27.08.2024.

It is r e levant to m ention h ere that during the

investigation of the present ease, accused evad ed

his appearance and coer cive" proceedings of NBWs

h a d a lready been initiated against him. Further, it

is also n ot the ease of the applicant that h e was

having consensua l sexual relations with the

prosecutrix. The allegations against accused are of

rape and same arc serious and heinous in nature.

Considering the facts of the ease and nature of

a llegations, there are apprehension t hat in ease

applicant/ accused is enlarged on bail, there arc

every chances of his fleeing from course of justice,

tamper evidence or may coerce/ influence

witnesses of the ease. Hence, considering the facts

of the ease and seriousness of the allegations

against the applicant/ accused, no ground is m ade

out for grant of bail to the accused . Hence, the

present application is dismissed .

Nothing h er ein shall be construed as an

expression on the merit of the ease . Application
stands disposed off.

Sharma, daughter of Subhash Sharma, 1s a

resident of R .Z/ A-66, Jai Vihar, Harphool Bihar,

Street No.20, Phase -3, Near Fauji Farm House

and Ram Vatika, Najafgarh, New Delhi -110043.

The applicant lives with h er parents at the

above address. Ambrish Pathak alias Sin tu, son

of Ramsharan Pathak, R/ o. Village Kuriapar

Belhasa, PS - Bakhira, District - San t Kabir

Nagar , U.P., lives next to the house of the

Complainant about 06 year s ago. The opponent

fell in love with the Complainant about 06 years

ago and the opponent kept having physical

relations with her by promising to marry h er.

The Complainant kept insisting him to marry

her from the very beginning, but the opponent

and his family members kept procrastinating

the matter of marriage by citing family and

financi a l compulsions a nd the opponent kept

having physical relations with the Complainant

against her wishes. In the same sequence, on

06.04.2024, the opponent came to the

Complainant and again started behaving

inhumanly with her with the intention of

satisfying his lust. Complainant spoke to the

Opponent about remarriage, but he got angry

and abused Complainant, saying bitch,

prostitute, motherfucker, I had a relationship

with you just to satisfy my desire. I had a

relationship with a lot of girls like you , but I will

not marry at all and if you don't asleep with me,

I will kill you along with your widow mother and

brother and throw them in a sewer, or thr eaten

to beat her with kicks, punches and belts and

forcefully rape her. In view of the afor esaid

facts, Complainant gave a complaint letter dated

13.04.2024 in local police station Bakhira

against Opponent. On this, the In-charge of the

local police post, Bakhira, called him a nd the

Opponent's family members , the Opponent's

father, elder brother and village Pradhan

representative of the Opponent who called

himself a journalist and the Pradhan

representative 's brother who 1s a lawyer by

profession came there and he showed fear of

bringing the police under his influence and

filing a fake case of abduction of t he Opponent

on the plaint. Those people started pressurizing

the Complainant to r econcile the matter and if

she did not reconcile, this is not Delhi , this is

Uttar Pradesh, its reach is much higher, they

will make you disappear from here , they

threatened and abusing the complainant and

chased her away from there. The a pplicant is a

very poor, helpless and distressed woman who

is sad and distressed due to the conspiracy of

the opponent. I am presenting this application

before you with a strong hope of justice .

Therefore, I request you to take serious

 cognizance of the above case and register a case

against the opponent regarding the a b ove

mentioned facts and take necessary punitive

action .

Application for disposal of Anticipatory Bail 3A-

An application for anticipatory bail under

section 438 Cr.P.C. along with affidavit has been

submitted on behalf of the applicant/ accused

Ambrish Pathak alias Sintu Pathak in connection

with the case of FIR No. 202/2024, under sections

376, 323 , 504, 506 IPC , police station Bakhira,

district Sant Kabir Nagar.

In brief, . according to the First Information

Report , Ambrish Pathak alias Sindhu, son of

Ramsharan Pathak, lives next to the house of the

Complainant about 06 years ago. The opponent fell

in love with the Complainant about 06 years ago and

the opponent kept having physical relations with her

by promising to marry her. The Complainant kept

insisting him to marry her from the very beginning,

but the opponent and his family members kept

procrastinating the matter of marriage by citing

family and financial compulsions and the opponent

kept having physical relations with the Complainant

against her wishes . In the same sequence, on

06.04.202 4, the opponent came to the Complainant

and again started behaving inhumanly with her with

the intention of satisfying his lust. Complainant

spoke to the Opponent about remarriage, but he got

angry and abused Complainant, saying, I had a

relationship with you just to satisfy m y desire. I had

a relationship with a lot of girls like you, I will not

marry at all and if you don't asleep with me, I will

kill you along with your widow mother and brother

and throw them in a sewer, or threaten to beat her

with kicks, punches and belts and forcefully rape

her. Complainant gave a complaint letter date d

13.04.2024 in Thana Bakhira. The in -charge of the

local post, Bakhira, called him and the Opponent's

family members, the Opponent's father, elder brother

and village head representative of the Opponent who

called himself a journalist and the head

representative's brother who 1s a lawyer by

profession came there and he showed fear of bringing

the police under his influence and filing a fake case

of abduction of the Opponent on the plaint. Those

people started pressurizing the Complainant to

reconcile the matter and if she did not reconcile, this

is not Delhi, this is Uttar Pradesh, its reach is much

higher, they will make you disappear from here, they

threatened the complainant and chased her away

from there.

On the anticipatory bail application , the learned

counsel for the applicant/ accused argues that

Opponent is innocent. He has been implicated 1n a

false case. This 1s his first anticipatory bail

application. Apart from this bail application, no other

anticipatory bail application is either decided or

pending in any other Court or any High Court. The

Complainant in the case is a married woman and her

husband's name is Shailendra Sharma , son of Shri

Raj Kumar Sharma, Residence-A66, RZ House and

Radha Vatika, Jai Bihar, Baprola, Najafgarh, South

West District, New Delhi -110043, presently

residence or actual address is Shailendra Sharma,

son of Shri Rajkumar Sharma, Resident of - Baspas

Mishra Police Station and District Maharajganj -

273303, U.P . The Complainant has filed case being

No.2258/2022 "Indu Sharma vs. Shailendra Sharma"

and case No.1382/2022 "Indu Sharma vs Shailendra

Sharma" in the Delhi Family Court, which is pending

in the court. The statement of the Complainant of the

case that he wants to marry the Complainant 1s

beyond the truth, because the Complainant is a

married woman, aged 32 years and is the mother of a

child. The Complainant has not been divorced.

According to the Hindu Marriage Act 1953, unless a

married woman or man is divorced, he or she cannot

marry again. The Complainant has concealed her

previous marriage in the First Information Report.

She used to demand money from the Opponent

during her stay in Delhi. On not giving the money,

the Complainant also threatened to implicate him in

the crime of rape, which he informed on 29.03.2024

through an application whose r egistry was done on

30.03.2024 to the Police Station Inchar ge, Ranhola,

New Delhi. Aggrieved by this , the Complaina n t has

lodged this First Information Report at her native

place Sant Kabir Nagar. The a rrest of the Opponent

will cause him social and economic loss. He has no

criminal history. The above crime does not fall under

Section 4 38 (6) Cr.P.C. Ther e is no p ossibility of t h e

applicant's p a rdon. The applicant will never mis use

his bail after getting b a il. Ther efor e, it is requested to

release the applicant on a nticipatory bail.

Heard the learn e d counsel for the

applicant/ accused a nd the learn ed District

Government Advocate (Criminal) and carefully

examined the documents available on t h e file and

other r elevant documents.

 The argument of the prosecution is that the

accused had physical relations with the Complainant

by promising to marry her. When the Complainant

protested, he abused her and threatened to kill her

and her mother and brother, while the argument of

the learned counsel for the accused is that he 1s

innocent and has not committed any crime.

The learned advocate of the accused presented

application lB and said that some important

documents have to be submitted, for which he needs

one week. Thereafter, the learned District

Government Advocate (Criminal) described the

present case as a heinous crime and requested to

dismiss the anticipatory bail application without

giving time. He is the main accused named in the

present case and investigation is still going on. The

crime committed by the accused is of serious nature.

I~ view of the above facts and circumstances and the

gravity of the cnme committed by the

applicant/ accused, without expressing any op1n1on

on the merits of the case, the court does not consider

the anticipatory bail application submitted by the

applicant/ accused to be acceptable .

ORDER

Application 3A for anticipatory bail in case of

FIR No.202/2024, under Section 376, 323 , 504, 506

IPC, Police Station-Bakhira, District Sant Kabir

Nagar by a pplicant/ accused Ambrish Pathak alias

Sindhu Pathak is dismissed.

being repeated herein for the sake of brevity and

convenience of this Hon'ble Court.

2. The petitioner, who is seeking anticipatory bail , has

absolutely clean antecedents. He has admittedly never

been involved in any other civil or criminal case of any kind

whatsoever. He has been wrongly and falsely implicated.

He has deep roots in the society. The petitioner is ready

 and willing to join investigation and there is no chance

whatsoever of the petitioner fleeing away from justice or not

being available for investigation.

3. That the petitioner undertakes to abide by any condition,

which may be put by this Hon'ble Court and join

investigation as and when , required.

4. That great irreparable loss and injury will be caused to the

applicant/petitioner if the applicant/petitioner is arrested

pending the final hearing of the main anticipatory bail

application.

5. That main petition/application will become infructuous if the

Applicant/Petitioner is arrested .

6. The present application is made bonafide and in the interest

of justice.
