GIFT DEED
THIS DEED OF GIFT made and entered at Nalasopara,
today this ___ day of November 2023 BETWEEN: Mr. ABBAS
HABIULLAH SHAIKH Age 52 years, an adult Indian inhabitant,
residing at Flat No. 202, Sai Shelter Apartment, Evershine City,
Nalasopara (East), Taluka – Vasai, Dist. - Palghar – 401209,
hereinafter called “THE DONOR” (which expression shall unless
repugnant to the context, mean and include his heirs, executors,
administrators and assigns) of the ONE PART.
AND
Mr. HASNAIN BARKAT SHAIKH PAN NO. KQUPS9032J
Age 23 years, an Indian Inhabitant, residing at Room No. B/2,
Baba Chawl, Tulinj Road, Near Forest Naka, Tulinj, Nalasopara
(East), Dist. - Palghar – 401203, hereinafter called “THE DONEE”
(which expression shall unless repugnant to the context, mean
and include her heirs, executors, administrators and assigns) of
the OTHER PART.
WHEREAS the donor and donee are the member of joint
family, and have natural love and affection towards each other.
AND WHEREAS the parties are in relation as paternal uncle
& Nephew and are the part of joint family.
AND WHEREAS the Donee is the REAL NEPHEW of the
Donor, and have Relation Of Paternal Uncle & Nephew
between the parties.
AND WHEREAS the Donor bears natural love and affections
for the Donee, as his nephew & is taking care of donor, and
making their best effort to take care of donor’s Health & routine
Life.
AND WHEREAS out of such natural love and affection, the
Donor has decided to make a gift of monetary value to complete
the education and future life of donee.
AND WHEREAS the Donee is ready and willing to accept the
gift of the said property, if made to him by the Donor.
NOW, THIS DEED WITNESSES AS FOLLOWS :
1. That the Donor out of his natural love and affection for the
Donee, does hereby make a gift of monetary / financial gift of Rs.
20,00,000/- ( Rs. Twenty Lakh Only), for the support of education
and future of done, described in further details in the schedule
hereunder, unto the Donee TO HAVE AND TO HOLD the same
absolutely and FOR EVER as the owner thereof.
2. That the Donee does hereby accept the said gift made to him
by the Donor.
3. That the Donee shall hold and use the monetary gift as his
own wish and to complete his education as well as his future
planning.
4. That the Donor does hereby declare and confirm that he, the
Donor, after execution & registration of This Gift Deed shall not
have any right, title or interest in or over the said money or any
part thereof and the donee becomes the sole & exclusive Owner
and hold the same forever and utilize the same as he deem fit
and proper.
5. That the Donor does hereby assure unto the Donee that he,
the Donor, has a clean and clear title to the said monetary
property as the same is self acquired, and the same is free from
encumbrances, and also that it is not a subject matter of any
pending litigation before any authority.
6. The donor hereby confirms that after execution of this Gift
deed, donee becomes the sole & exclusive owner of the said
monetary Property and at the same time donor is signed Gift
Deed documents to transfer funds from his account to, to donee
account.
7. It is declared by the donor that after the execution of this Gift
Deed, he himself or any legal heirs have no right to claim of
whatsoever in nature in future. Further this gifted property is
given from his self acquired property. So No one has any right
claim over the said gifted property.
8. That the Donor also assures unto the Donee that all the taxes,
cesses, charges and assessments payable in respect of the said
monetary property have been duly paid up to date by the Donor.
9. That all the expenses of stamp duty and documentation have
been paid out by the Donor alone.
10. THAT after the execution of this Gift Deed, the donee
becomes the sole & single owner of the fund / monetary property
and he is absolute and single holder of the said gifted property.
