It is Most Respectfully Showeth that
The applicant submits as under:
1. That the afore-titled Transfer Application, seeking
regularization of the Applicant was transferred to this
Learned Tribunal by the order dated 07.08.2020 passed
by the Hon’ble High Court of Jammu and Kashmir in SWP
2580/2018.
A copy of order dated 07.08.2020, passed by the Hon’ble
High Court of Jammu and Kashmir is annexed herewith as
Annexure – A.
2. That the said Application was last listed on 05.03.2024,
however due to the non-appearance on behalf of the
Counsel for the Applicant, the same was dismissed.
Certified copy of order dated 05.03.2024, passed by this
Learned Tribunal in T.A. 1412/20 is annexed herewith as
Annexure B
3. That it is most pertinently stated herein that the Applicant
is vigilant towards her rights. The Applicant kept on
following up with the Counsel that was engaged by her
earlier and in fact reminded him through texts and
messages before every date of hearing.
4. That it is most humbly stated before this Hon’ble Tribunal
that the counsel that was engaged earlier has stated it to
the Applicant that the due to the technical issues with the
online link, he could not join the proceedings and ended
upon missing the hearings.
5. That it is in the above circumstances the Applicant is filing
the present Application praying that this Hon’ble Court
may kindly restore the T.A. for adjudication and proceed
to hear the same on merits.
6. That the present Application is bonafide and genuine and
made in the interest of justice.
PRAYER
In the circumstances, it is therefore, most humbly prayed that this
Hon’ble Court may graciously be pleased to:
(a) Restore the T.A. No. 1412 of 2020 and proceed to hear the same
on merits;
(b) Pass any such other and further order or orders as this Hon’ble
Court may deem fit and proper in the facts and circumstances of
the case.
