Serve U Brands/ Insomnia Cookies (the “Company”) Attendance Policy (this “Policy”)

It is important that employees attend work as scheduled. Attendance is an essential function of every job at
the Company and is a condition of employment. As such, employees are expected to work on all scheduled
workdays, during all scheduled work hours and report to work on time, in uniform and ready to work, unless
excused, for example, due to illness or for previously scheduled time off or in accordance with the
Company’s Paid Sick Leave Policy and/or applicable law.

If absence is unavoidable, employees are required to give the Company as much advance notice as possible
to arrange coverage. If an employee cannot report to work, such employee must contact his or her store
manager directly as soon as possible and no later than four (4) hours prior to his or her scheduled starting
time. Except in extraordinary circumstances, any failure to provide at least four (4) hours advance notice of
such inability to report to work shall be deemed a “no call, no show” and a violation of this Policy that may
result in disciplinary action (up to and including termination). If an employee’s store manager is not
available, such employee should contact the director of operations for his or her region, rather than leaving a
voicemail message or sending a text message. An employee is required to inform his or her store manager
as to the amount of time such employee expects to be out and what type of paid time off or unpaid leave such
employee is requesting. If an employee is prevented by an emergency from calling prior to his or her
scheduled start time, either such employee or someone on his or her behalf must contact his or her store
manager directly as soon as possible. Except in extraordinary circumstances, unexcused absences or failure
to call in to report absence in accordance with this Policy, may result in disciplinary action (up to and
including termination) consistent with applicable law.

Employees must follow this procedure in connection with any and all absences, unless prior approval from
such employee’s store manager has been granted. Depending on the nature and length of the absence, the
Company may require a doctor’s note documenting the reason for absence and authorizing an employee to
return to work.

To the extent this Policy conflicts with anything contained in the Company’s handbook, this Policy shall
control.

ANY PERIOD OF TIME AND THAT NOTHING HEREIN SHALL INTERFERE WITH MY RIGHT
OR THE COMPANY’S RIGHT TO TERMINATE MY EMPLOYMENT RELATIONSHIP WITH THE
COMPANY AT ANY TIME, FOR ANY REASON OR NO REASON.
