McCarthy Montgomery County States Attorney 50 Maryland Avenue, 5th Floor Rockville, Maryland 20850 Dear Mr. States Attorney: Hogewash! is a blog which covers, among other topics, First Amendment issues. Since last May, the blog has been covering issues related to the use of lawfare to silence bloggers. Lawfare is the use of the courts to file SLAPP actions and the like to harass and intimidate. I have paid particular attention to the activities of a Montgomery County resident, Brett C. Kimberlin, who has attempted to use lawsuits and peace orders to retaliate against bloggers for publishing truthful information about Mr. Kimberlins past and his present activities. Brett Kimberlin is infamous as the domestic terrorist known as the Speedway Bomber. He was sentenced to 50 years for crimes related to that bombing spree, impersonating a federal officer, possession of explosives by a felon (he had a prior conviction for perjury), drug trafficking, and other crimes. On 14 November, 2011, in a hearing before Judge Jordan Mr. Kimberlin testified as follows under cross examination: Q Were you released and then sent back to prison for a parole violation, for failure to pay compensation to the, Ms. Delong (phonetic sp.), the wife of Carl Delong, who took his own life after those bombs A No. Q tore up half his body? A No, I wasnt. (See transcript p. 40, beginning at line 12, Kimberlin v. Allen, Civil No. 339254.) That testimony is contradicted by multiple sources including, for example, Kimberlin v. Dewalt, 12 F. Supp. 2d 487 Dist. Court, D. Maryland 1998, which deals with Mr. Kimberlins appeal of his parole revocation. I believe that this and other apparent instances of perjury by Mr. Kimberlin in Montgomery County have been brought to your Offices attention and that every complaint has been disposed of as nolle prosequi. What is your reasoning for allowing a convicted domestic terrorist and perjurer to abuse the legal system in Montgomery County with repeated instances of apparent perjury? Did you find, for instance, that Mr. Kimberlin never had a parole revocation?
