17 House of Representatives (House) respectfully advises this Court of three recent 18 filings in Defense of Marriage Act cases that are relevant to the Houses [. . .] 19 Motion . . . to Stay Proceedings (May 29, 2012) (ECF No. 39), which is pending 20 before the Court. 21 1. On July 23, 2012, Karen Golinksi, the appellee in Golinski v. U.S. Office
22 of Pers. Mgmt., Nos. 12-15388 & 12-15409 (9th Cir.), filed with the Supreme 23 Court a brief supporting the Executive Branchs petition for a writ of certiorari 24 before judgment in that case. See Br. of the Respt in Supp. of Pet. for Cert. 25 26 27 28 1

2. On July 27, 2012, the Ninth Circuit vacated the oral argument that was
4 scheduled for September 10, 2012, in Golinski v. U.S. Office of Pers. Mgmt., Nos. 5 12-15388 & 12-15409 (9th Cir.), and held that case in abeyance pending resolution 6 of the Executive Branchs petition for a writ of certiorari before judgment in that 7 case. See Order, Golinski v. U.S. Office of Pers. Mgmt., Nos. 12-15388 & 128 15409 (9th Cir. July 27, 2012) (ECF No. 147), attached as Exhibit B. 9 3. On July 25, 2012, the U.S. District Court for the Eastern District of New 10 York stayed in its entirety Blesch v. Holder, No. 12-cv-01578 (E.D.N.Y.), 11 pending the Second Circuits resolution of Windsor v. United States, No. 12-2335 12 (2d Cir.). Minute Entry, Blesch v. Holder, No. 1:12-cv-01578 (E.D.N.Y. July 25, 13 2012) (ECF No. 21), attached as Exhibit C. Blesch like Cooper-Harris (i) is a 14 relatively recently-filed case that challenges the constitutionality of Section 3 of 15 DOMA, 1 U.S.C. 7, (ii) in which the House has been permitted to intervene as a 16 defendant, and (iii) in which no dispositive motions or Answer to the Complaint 17 have yet been filed. Windsor like Golinski is an appeal from a district court 18 judgment holding DOMA Section 3 unconstitutional. 19 20 21 22 23 24 The House will file a response to the Executive Branchs petition for a writ of certiorari before judgment in Golinski v. Office of Pers. Mgmt. v. Golinski, 26 No. 12-16 (S. Ct.). The Houses deadline for so responding is August 31, 2012. 27 When the House does so, we will provide a copy to this Court. 25 28 2
