On Friday, July 19, 2013, Officers J. Powell #2731, J. Alvarez #2231, A. Cornwell #2394, R. Hilliard #2522, and
Sgt. A. Pina #1983 were dispatched to an investigation at the Six Flags Over Texas amusement park located at
2201 E. Road to Six Flags. The call text advised the complainant's mother-in-law had fallen off of the ride, "The
Texas Giant". The complainant further advised he couldn't find his mother-in-law at the time of the 911 call.
Officer Alvarez was the first Officer to arrive at the scene and was directed to "The Texas Giant" where he met up
with Six Flags Security as well as Arlington Fire Department personnel. Officer Alvarez and others began the
search of the area under "The Texas Giant's" track until they were directed by Six Flags Employees to where the
possible decedent could be located. Officer Alvarez climbed onto an observation platform and observed the body

of a female almost severed in half lying on top of a metal structure. Officer Alvarez stood by the body so as to
secure the scene.
Sgt. Pina arrived at the location and began directing Officers in an attempt to locate various witnesses and the
decedent's family. Officer Powell was able to contact the initial complainant, the decedent's son-in-law, Ronal
Segovia W/M 0 and his wife, the decedent's daughter, Aracely Esparza W/F . Both Aracely and
Ronal told Officer Powell they had gotten onto the "Texas Giant" with Aracely's mother, Rosa Ayala-Gaona
Esparza W/F . At some point early on in the ride, Rosa was ejected from the ride. Once the ride was
over, they told the Six Flags employees about the incident who then attempted to find Rosa's body. Officer Powell
was directed to escort Aracely, Ronal, and the rest of their party to the First Aid area until a more formal interview
could occur.
Officers Cornwell and Hilliard were directed to contact the various witnesses, other riders of the "Texas Giant",
and Six Flags employees in order to obtain initial statements. Based on all of the initial witness accounts, there
did not appear to be any foul play involved.
At 19:25 hours, I, Detective C. Blank #2043 was contacted by my supervisor, Sgt. K. Fryer #1456 in reference to
this investigation. After being briefed with the information known thus far, I was requested to the scene in order to
begin the appropriate follow up investigation. At 20:40 hours, I arrived at Six Flags and met with Officers
Cornwell, Hilliard, and Powell who briefed me with the status of the plethora of witnesses. As to avoid any further
inconvenience to the witnesses, I asked Officers Cornwell, Hilliard, and Powell to interview them on my behalf. I
provided my audio recorder to Officer Cornwell and further requested he record their statements for my review.
After meeting with those Officers, I proceeded to the "Texas Giant" in order to survey the scene. At approximately
20:53 hours, I met with Scene Commander Lt. T. Baker #1804 and Sgt. Pina who updated me on the details of
the scene since my previous briefing by Sgt. Fryer. They further added that they had already contacted the
Tarrant County Medical Examiner's Office (ME) and informed them of the death.
I then signed into the crime scene log and proceeded into the taped off area in order to meet up with Crime Scene
Investigator (CSI) J. Fernandes #2713. While walking up to the fenced in portion of the "Texas Giant" on a
blacktop private road belonging to Six Flags, I observed multiple areas of human tissue and other bodily fluids. I
proceeded past this area into the fenced in area which led underneath the ride's tracks. In this area immediately
underneath the tracks, I noticed various internal organs that had been dispersed throughout. After passing from
the north side of the tracks to the south side, I looked on top of the corrugated metal tunnel and observed the body
of the decedent. The top portion of the victim was hanging off of the tunnel structure while her lower extremities
were wrapped around a wooden support beam.
I was then directed to a stair case which led to a brake house on the top of the track as well as various intermittent
platforms in between. Upon viewing the tracks from these vantage points, I could see the believed initial impact
point which was a wooden support beam on the north side of the track approximately 1/4 of the way from the initial
descent of the track. Secondary impact points were also observed on the top of the corrugated metal tunnel until
the decedent's final resting position.
CSI Fernandes informed me he was in the process of photographing the scene and we discussed what areas to
process. At the end of this conversation, it was determined there were no areas in this scene that needed any
other crime scene proceSSing. Due to the configuration of the scene, it was difficult to determine exact heights
and angles of the decedent's fall. Because of these difficulties, I informed CSI Fernandes I would attempt to
obtain these measurements from the ride's blue prints.
At approximately 21 :30 hours, Investigator Corley of the ME's Office arrived on scene. CSI Fernandes and I
escorted Investigator Corley through the scene. A short while later, the ME's transport team arrived onscene and
began collecting various body parts and tissue not with the decedent's body. At approximately 22:00 hours,
Investigator Corley completed his walkthrough and authorized the Fire Department to remove the body.
At 22:08 hours, I cleared the "Texas Giant" in order to check in with Officers Cornwell , Powell, and Hilliard. I met
with them briefly and was told they were finishing up with their witness statements. Officer Cornwell told me the
consensus of the witnesses was that the decedent came loose during the first descent of the ride. When the ride

went over the second "bump" the decedent was thrown forward violently and may have hit her head on something
inside the cart because she then slumped to the floor of the cart. Eventually as the ride neared the third
ascenUtwisUdecent the decedent was thrown from the cart. Several witnesses believed they heard a "popping"
sound from the decedent's seat when the cart came down on one of the descents.
I then met with Investigator Corley at the current location of the decedent's family in order to speak further with
both Ronal Segovia and Aracely Esparza Segovia. I met with them, the decedent's husband, Antonio Esparza,
the decedent's sons: Amado Esparza, Arnold Esparza, and Antonio Jr., and other various family members.
Ronal told me they arrived at the park earlier in the day with the decedent, his sister, and her children.
Ronal said he had ridden the "Texas Giant" earlier in the day and thought it to be a fun ride. At approximately
18:30 hours, Ronal, Aracely, and the decedent decided to ride the "Texas Giant" and got into line. Aracely
described her mother as excited to get onto the ride and did not seem anxious. When the train arrived into the
station, the current riders exited and the three got onto the train. Ronal said he and Aracely were in the second
row with Ronal in the left seat and Aracely in the right seat. The decedent sat directly behind Ronal in the third
row by herself.
After loading onto the train with their safety restraints checked, they left the station and began the ride. As the ride
continued past the first major descent, both Ronal and Aracely began hearing yelling from behind them. Aracely
turned around on the second "bump" and saw her mother slumped over in the cart. Aracely described her mother
as almost completely upside down with her head near the floor of the cart and her feet almost straight up in the
air. As the ride began the third ascent into the turn, Aracely observed her mother being tossed out of the cart.
Neither Aracely nor Ronal saw her hit anything either during the ride or after she was tossed out.
When the ride concluded, they immediately began telling Six Flags employees about the decedent being tossed
from the ride. Both Ronal and Aracely appeared upset at the Six Flags employees' responses as they described it
as "they acted as if they didn't believe us". After the ride released them from the cart, Ronal and Aracely
continued telling the employees to go look for the decedent before Ronal finally called 911. I viewed Ronal's cell
phone which showed he called 911 at 18:43 hours.
Because of the emotional state of both Ronal and Aracely, I elected to not seek a formalized statement from them
at that time. They agreed to meet with me at a later time in order to provide one. Investigator Corley then
proceeded to complete his instructions to the decedent's family.
After this meeting with the family, Investigator Corley, CSI Fernandes, and I changed our location to the "Texas
Giant's" train depot portion of the ride in order to view the carts. When we arrived at the loading/unloading dock,
the red train was in the same position since its last trip around the track. I viewed the cart and did not notice any
obvious signs of stress, damage, or other abnormalities when compared to the other carts.

ic pressure and therefore would be no mechanical "clicking" sound when the restraint was
lowered. Each restraint is connected to an electronic sensor that is only illuminated in the "safe mode" when the
restraint is lowered to its predetermined position. Once this sensor is illuminated, the train then sends a signal to
the operating panel confirming the restraints position. If the restraint isn't lowered properly, or either the panel or
cart sensor malfunctions, then the train will not function and would not be allowed to depart the train depot.
Furthermore, after the safety checks are performed by the loader/unloader staff for the "Texas Giant" they too
must push a "safe" button at their respective stations. If any of these safety measures are not passed, then the
train will not depart the station.
As a/l of the restraints had been raised after the last ride, thus letting our witnesses depart, I was unable to
determine the restraints last position during the decedent's ri de. However, I did lower a restraint on an adjacent
cart so observe the safety sensor Illumination in order to gain perspective. I asked bot . and
sensors and restraints were working properly today, and was advised they were working during
daily checks. They were unaware of any other reports otherwise throughout the day. 80tt1llll .

as to see if there was any mechanical malfunction.
At the end of this conversation, I returned to the Six Flags Office and met one more time with Officers Cornwell,
Powell, and Hilliard. While there, I was provided with a copy of both the surveillance video and still "Your photos"
from the "Texas Giant" by Six Flags Personnel on a "USB flash drive". I maintained custody of this item and
cleared the scene at 23:47 hours.
On July 22, 2013, I was contacted by Garrett Chambers, who informed me he would be representing the
decedent's family in the upcoming civil suit against Six Flags Over Texas. Chambers agreed to meet with me in
order to have Ronal and Aracely provide their formalized statements. We agreed to meet later that morning.
I viewed the videos and photos collected from Six Flags. It is clear from the "Your photos" (or photos taken of
passengers of the "Texas Giant" while the ride is operational) which rider actually observed the incident. The
video which showed the loading, safety check, disembarkment of the train, and its eventual return was extremely
dark and of poor overall quality. I could make out major shapes and body types, but could not identify anyone
from the video. However, from this video I did observe the previously mentioned illuminated safety sensor on the
train cars. Due to the positioning of the rider in the #4 car, I was unable to view the decedent's safety sensor to
see if it too was illuminated.
I met with Detective T. Eby #1357 of our Economic Crimes Unit and requested him to also view the video and
attempt to enhance the quality of the video if possible so as to make it easier to view. Using a copy of the video,
Detective Eby attempted to lighten the contrast of the video which only marginally assisted with the viewing of the
video. The original video was later booked in as evidence (item CLB-01). A property transmittal was completed
for the items disposition.
At 11 :00 hours, I met with Chambers, Ronal, and Aracely at the Main Police Station. We discussed the current
status of the case and I provided them with as much information about the investigation as I could. Ronal and
Aracely both confirmed to me that the decedent was looking forward to riding the "Texas Giant" and did not voice
any concern about her restraints to anyone. Aracely said her mother speaks very limited English and if a concern
would have been voiced, she would have told either Ronal or Aracely about it first. Neither remembered the
decedent speaking to any of the Six Flags staff during the loading and safety check processes.
Afterward, I requested a formal statement from both Ronal and Aracely in either a written or oral format.
Chambers requested an opportunity for their statements to be typed up and provided at a later time. I agreed. It
should be noted that as of the time of this report, I still have not received their formalized sworn statements.
At 13:27 hours, I attempted to contact a representative for Six Fljjj-?Ver T .

I next called the Department of Insurance Loss Control Regulation and spoke to the Director, Richard Baker.
Baker informed me that his agency does not investigate these types of accidents, but is a collector of any injury or
fatality reports. Baker said the owners of the amusement rides must send his agency a quarterly injury report
regardless if there have been any injuries or not. Baker checked his records and said Six Flags Over Texas has
been current with their record keeping and would provide me with copies of the most recent injury reports.
When it comes to the annual inspections, Baker said his agency does not conduct those either. Instead, either the
ride owner or the insurance company for the ride owner would hire a third party inspection company to inspect
the ride and deem it safe. The owner would then file their findings with his agency. Baker again described his
agency as more of a collector of amusement ride insurance certificates and annual inspections certificates. Baker
also explained that the owner of the rides is responsible to have their rides insured for no less than $1 million per
occurrence for Class B Amusement rides. Baker again looked through his database and found Six Flags Over
Texas to be within compliance for all regulations. Baker forwarded me the most recent yearly inspection
certificate.
After reviewing all of the paperwork Baker forwarded me, I too observed that Six Flags Over Texas was in
compliance with all state regulations. This paperwork showed the ride to be insured through the Hartford Fire
Insurance Company for the year 2013 for various amounts depending on type of occurrence with the minimum of
$1 million being met. This paperwork also showed the "Texas Giant" ride was inspected by Don Hankins of the

PLH & Associates, Inc. located at P.O. Box 93496 in Lakeland Florida with telephone number #863-816-1862 and
filed on February 22, 2013. The most recent quarterly injury report showed there to be only one occurrence of
injury with that being this incident.
On July 23, 2013, I reviewed several tip emails that had been forwarded to me from either our Media Unit or from
the Investigations in box. Most of these e-mails were of little value, but one e-mail did stand out. I received the
e-mail forwarded to me by Sgt. Fryer originally from a citizen, Lorenda Sands dated July 19, 2013 @21 :50 hours.
Sands said in her e-mail she had been riding on the "Texas Giant" the day before the incident. Sands loaded onto
the red train at approximately 06:30-06:35 p.m. Once on the train, the employees walked both sides of the train,
starting at the front, checking the restraints. When they finished, the operator announced "all clear" over the
speaker. Immediately after announcing "all clear", Sands saw the operator look down then immediately announce
"check car 3" over the speaker just before our train was released to go. One of the employees who had
previously checked the restraints immediately came back to her car and rechecked her restraint. Afterward, the
"all clear" announcement was made and the ride began.
Sands indicated she had not heard any details of the incident, but wanted us to be aware of her experience "just
in case it happens to be the same car this person was in during the accident today."
I also was provided a copy of the 911 phone calls related to this incident. I listened to the two phone calls, one
from Ronal and the other from his sister. No new information was learned from these calls.

I next contacted Investigator Barbara Wilson of the U.S. Consumer Product Safety Commission in order to consult
with her about what exact items of information would be most beneficial for the investigation. Wilson's advice
was sought due to her experience with similar investigations. Wilson provided me with the following list of items
she would request from Six Flags:
1) All training/safety checklists for the "Texas Giant" ride.
2) All ride guidelines for the "Texas Giant".
3) Any drug testing results from any employee tested as a result from this incident.
4) Any certifications for the "Texas Giant" ride Supervisors.
5) A manufactures manual for both the track and carts including any documentation or engineer report as to why
the carts were chosen/authorized for the tracks.
6) All documentation on maintenance records including any non-destructive testing or complete overhauls for the
past three years as well as any pre-opening or daily safety check records for the past year on both the tracks and
carts.
7) Any certified engineer inspection reports conducted on the "Texas Giant" pre-incident.
8) Any certified engineer inspection reports conducted on the "Texas Giant" post-incident.
9) The notification of fatality report reference the death of Rosa Ayala-Gaona Esparza.
10)Any reports, complaints, or correspondence related to safety issues of the "Texas Giant" ride at Six Flags if
they exist.
Wilson also provided me with a list of items she would further request from the Department of Insurance Loss
Control Regulation:
1) All notices of annual inspection for the "Texas Giant" since it was built.
2) All quarterly injury reports for the "Texas Giant" since it was built.
3) The notification of fatality report reference the death of Rosa Ayala-Gaona Esparza.
4) Any reports, complaints, or correspondence related to safety issues of the "Texas Giant" ride at Six Flags if
they exist.

I then began reviewing the audio recorded witness and employee statements obtained by Officer Cornwell. The
following are synopses of these interviews. Please see the audio recordings for full details:
Outside Witnesses (i.e. non-workers or red train riders)
1) : Standing in line for third row was next to get on. Saw victim getting checked by
ride operators. Saw ride depart. When ride returned they didn't see victim and heard the people in the second
row yelling that their mother had fallen out Heard ride operators calling it in. When the car pulled forward
saw that the restraint was leaning back. Estimated they were in line at 1845 hours.
2) John Putman: Waiting on the red car next to family (above) when he heard people yelling that someone had
fallen out of the ride. He too saw the restraint on the third row and said it looked like it was in the correct position.
3) Francisco Rodriguez: Was watching the ride near rail road station. Saw the victim ejected from the ride, hit
something, and "splattered like a watermelon". Estimated time was around 1840-1845. Then landed on metal
roof. Did not see her in the coaster.
4) Josephine Martir and Narholm Martir: Was on blue train. Heard someone fell off of the train in front of them.
Was on blue train and couldn't get off due to stuck behind red train. Was told by Six Flags employees that
something had dropped off red train. Saw ambulances and people running around. Was told someone fell off. It
looked like there was a lot of confusion.
Red Train Riders
5) Dillon Chambers: Around 1840 hours. Was sitting behind victim. After first drop and came back up heard "a
little thing unlatch, she kinda bounced up and we were so tight me and my friend, like we couldn't help her. We
couldn't?we would have grabbed her if we could, but we couldn't And uh, she bounced up and we hit like a turn
or something and she flew head first into her seat and her feet were straight up in the air. And then we hit another
turn and that's when she flew out." Doesn't remember anything else after that. Didn't seem the restraint was
latched very well. Thought the restraint came up a little easy. Was by herself. Went headfirst into seat next to
her. Was at the start of the ride."
6) Cody Rush: Was on ride between 1830-1845 hours. Sitting next to Dillon. Saw the safety check on him and
assumed they checked her. They went down the first "little dip" and everything seemed fine. They went up a
second bump and it looked like her "seat popped open". He heard her scream and then possibly passed out or hit
her head because she went limp. He saw her legs hanging. She stayed in the cart until the next turn when she
rolled out. He didn't believe she was conscious. When he saw her feet up, both he and Dillon tried to grab onto
her, but they couldn't reach.
7) Josh Fleak: Was on ride around 1845. First hill everything was okay. Went over 2nd little hill just before the
big curve his brother starts to freak out and points in front of them. About two seats up, he sees a lady's legs in
the air. When they reached the curve, he observed her fly off to the right and hit her head somewhere on the
coaster.
8) John Fleak: Was on ride around 1845 hours. Possibly three rows behind victim. Had two people come by
and check their restraints accordingly. Was cleared for departure. As they went finished with the first hill and
going up the second hill he noticed his two friends become worried and uneasy. He looked past his friends and
saw the lady had come up out of her seat. She appeared conscious at this point On the small dip after the
second hill it looked like she was thrown forward and she hit her head. She went limp and her head went down to
the floor with her feet up in the air. As they approached the left turn she "fell out of the cart". Saw the splatter.
Couldn't see the lap bar, but assumes it opened up. Restraint was cinched down tight on him. Again, saw her hit
her head as she went forward before she went downward into her seat/floor. Was upset about Six Flags
employees who thought they were joking.
9) Ben Warden: Was on ride around 1830 hours. Got on ride and after first drop everything was okay. Didn't
see anything other than his friend's reactions. Was told by his friend that they saw a girl fall off of the ride. Was
told to hold on.

10) Shahmeer Mirza: Was on the ride approximately 1845 hours. Was in second to last car of ride and heard
screams during the ride, but thought it was due to the ride itself. Toward the end he could tell something didn't
seem right. When the train pulled into station, he heard people yelling, she fell out. He was asked by Six Flags
people if everyone was there and they said yes. Got out of car and saw others pointing at cart and said she was
right here. Was told by other witnesses they saw the accident.
11) Sander Howard: Was on ride approximately 1830 hours. Was next to Mirza. Everything seemed normal
until they reached the tunnel and heard unusual screams. At the end of the ride, heard a commotion coming from
the front of the ride. Female attendant asked them if anyone fell out and his friend said no. When people were
exiting the ride, he saw the victim's daughter and her husband trying to tell someone about victim falling out of
ride. Heard from other riders that they saw the accident.
12) Daniel Marklin: Was on ride approximately 1830 hours. Was in last row with girlfriend. Friends with 10 & 11 .
Heard lots of screams, but thought they were due to ride. Saw attendant looking back toward ride and heard
someone had fallen out of ride. Looked back too, but didn't see anything. His restraints were fine. Saw male and
female Hispanic running around frantically. Heard male calling 911. Saw another white male telling attendant he
saw female fall out of ride.
13) Jennifer Evans: Was on ride approximately 1830 on red car. Switched to back rows due to shorter lines.
Heard a lot of screaming on the ride but thought it was just because it was a scary ride. Noticed something was
wrong when they pulled back into the station. Everyone was yelling at the attendants. Attendants asked her if
anyone fell out, but she didn't see anything so she said no. A lot of confusion. Saw victim's family asking about
how to look for victim. Saw witnesses talking to attendants. Her seat was checked by attendants.
14) Justice Serrano and Emma Troup: Was on ride approximately 1835. He was on the fifth rowan the left.
On the first drop he saw the lady fly out of her seat and come back down. On the second turn he didn't know if
she hit her head or not, but he saw her fly out of the cart. Was sitting next to Serrano. When they went down the
first hill, she saw her go up out of her seat. When they went into the valley, the female fell down to the ground like
she was lying at the bottom of the car. When they went around the first turn she saw the lady fall out of the car.
She closed her eyes and covered them when she saw the body exit the car.
Six Flags Employees
15 _______ Was unloading attendant for Texas Giant. Just came back from break at around 1830

On July 29, 2013, I e-mailed my request letters with the items suggested to me by Investigator Wilson to both Six
Flags as well as the Department of Insurance Loss Control Regulation. I also requested from our Media Unit all
known and available media coverage from the incident to be provided for the case packet.
On July 31, 2013, I again met with Attorney Chambers and other members of his legal team in order to provide
them with an update on the investigation. Chambers informed me the case for the Esparza family had been
transferred over to Attorney Frank Branson and others in his legal team. I spoke at length with Branson and
informed him of the investigation thus far. At the end of this meeting, I again requested a formalized statement
from their clients. It should be again noted that at the time of this writing, I still have not received their statements.
On August 1, 2013, I received a phone call from Bryan Pope, who is the legal representative for Six Flags in
regards to this incident. Pope and I discussed my request letter and we were able to narrow the scope of the
search some due to some of the time frames requested being too lengthy. Pope advised this request would take
some time to complete, but Six Flags would cooperate with any legitimate request in order to assist with the
investigation.
On August 6, 2013, I received notification from Sgt. Fryer that the Tarrant County Medical Examiner's Office
(TCME) had ruled on the death. The TCME's notification listed the cause of death as multiple traumatic injures
due to fall from roller coaster. The manner of death was ruled to be an accident.
On August 15, 2013, I received a voice mail from a citizen, identified as Kim Kirby, in reference this investigation.
I called Kirby who informed me she, her daughter, and other friends of her daughter were at Six Flags one week
prior to the incident. Her daughter, Mikaela, and another friend rode the "Texas Giant" on that date. After waiting
in line, they boarded onto the train (unknown color) in the number three car. Mikaela lowered the restraint and
then set up her cell phone placing it in the netted pouch in front of her so that it would video record the upcoming
ride.
As Mikaela was getting the phone situated, her restraint spontaneously opened up. Mikaela immediately yelled
out to Six Flags employees to report her restraint issue. Kirby heard on the overhead speaker systems a Six
Flags employee tell the safety crew to check cars #3 and #4. The Six Flags employees went over and checked
the restraints and refastened them. Afterward, the ride went off without further incident. Kirby told me she would
forward me a copy of the video via e-mail.
Later that morning, I received a copy of the video. I watched the video and observed that from the phone's
vantage point, it is indeed contained within the netted pouch in front of the rider. The video shows two white
female riders in the car including one wearing a purple shirt (presumably Mikaela). Neither of the two riders' faces
can be seen during the video. I n the 16th second of the video, I heard a distinct "pop" sound and immediately the
two riders are heard yelling out, "Wait, wait, person!" I could not tell if the restraint moved from this perspective,
but soon after the riders call out, I heard over the loud speakers someone state, "Car three is unlocked. [pause]
Car three and car four are now locked. Recheck car three. Recheck car four." Afterward, I observed a hand
move into view and push down on something (presumably the restraint) in the lap area of the rider. The loud
speaker then says something that is unintelligible before the video shuts off.
On August 29, 2013, I met with Attorney Pope at the Main Police Station. Pope provided me with an envelope full
of paperwork in regards to my previous request. We looked through the paperwork and Pope explained to me the

paperwork's current organization. A letter was also provided with an explanation of each section of paperwork.
As I looked through the paperwork, I noted that two sections were left empty. Pope advised that section number
three was left empty as Six Flags did not conduct a drug screen of its employees after the incident and therefore
they did not have any results. Section number eight, the section dealing with any post incident engineers reports,
was also left empty. Pope explained that even thought a number of engineers have inspected the "Texas Giant"
post incident his client is not currently in possession of any written reports concerning their findings. Pope did not
know if or when these reports would be finalized or when they would be forwarded to Six Flags.
After meeting with Pope, I examined the paperwork he provided to me in a more thorough manner. From my
objective examination, it did not appear that Six Flags knew of any defect in the "Texas Giant" that they were
attempting to cover up for or in any way attempting to bypass. It appears they were routinely in good faith
checking on the ride and making repairs as needed. Furthermore, I did not observe through multiple readings of
the daily maintenance logs any clear, concise documentation of obvious problems with any safety mechanism or
omittance of their being checked.
Conclusion:
At the end of this investigation, I have yet to see any facts, signs, or acts of criminal misconduct that were
committed by employees of Six Flags or any other person associated with this case. Based on my investigation
and the ruling from the Tarrant County Medical Examiner's Office, the death of Rosa Ayala-Gaona Esparza will be
finalized as an accident. However, without the final post incident engineers report the cause of the incident is still
ultimately undetermined.
This will conclude the investigation. The case will be cleared administratively.

I spoke with my daughter today and he confirmed the cubbies she used for their drinks were
the 1st set near the back of the train. That is what I thought originally--so not sure what
color it is but it corresponds with the train color.
That day was pretty memorable since her bar opened, and while we were getting on a lady was
--{treaming her leg was trapped. She had her leg sticking out too far when the gates closed
that hold back the next riders--and it trapped her leg.

My nephew & I were at Six Flags over Texas on Thursday, July 18, 2013. Between approximately 6:30-6:35 p.m. we were loaded onto the red train of The New
Texas Giant. This was my 1st time riding the new version of this ride but my nephew has several times this season. When we loaded, the employees walked
both sides of the train, starting at the front, checking the restraints. When they finished, the operator announced "all clear" over the speaker. Immediately after
announcing "all clear", I saw him look down then immediately announce "check car 3" over the speaker just before our train was released to go. One of the
employees who had previously checked the restraints immediately came back to the car my nephew & I were in & rechecked our restraints. I remember saying,
"Should we be concerned?" to my nephew just as he commented, "That was odd." The employees never indicated anything was wrong so an "all clear"
announcement was made again & the ride began.
I received a text earlier from a cousin asking if I had heard about the accident on the Texas Giant today. Until his text, I had not. As of now, there have been no
details released so I am not aware if today's accident involved the same train/car we were riding in. I do not visit Six Flags enough to know if what happened to
us on the ride yesterday is common but I feel that I should report it just in case it happens to be the same car this person was in during the accident today.
