Comes now, Petitioner, unto this Honorable Office, most respectfully states that:

1. Petitioner, FERMINA CALIPAYAN PAYAN, is of legal age, widowed, and a

resident of Alonzo Payan St., Purok Lapu-Lapu, Brgy. Dawis, Digos City, Davao
del Sur;

2. Petitioner is the registered owner of a certain real property covered by TCT No.
144-2012001504 of the Registry of Deeds for Digos City, Davao del Sur;

3. Annotated on the said title are liens covered by Section 4, Rule 74 of the Rules of
Court, to wit:

THE PROVISIONS OF SECTION 4, RULE 74 OF THE RULES OF

COURT REGARDING THE RIGHT OF ANY HEIR OR CREDITOR WHO
MIGHT HAVE BEEN DEPRIVED OF HIS OR HER LAWFUL
PARTICIPATION IN THE ESTATE OF THE DECEASED SPS.
MANGULON & TAKURA (CALAGAN) FOR A PERIOD OF TWO (2)
YEARS FROM NOV. 7, 1995. (NOTE: LIEN IS CARRIED OVER FROM
TCT NO. T-59428).

: SUBJECT TO THE PROVISIONS OF SECTION 4, RULE 74 OF THE

RULES OF COURT REGARDING THE RIGHT OF ANY HEIR OR
CREDITOR WHO MIGHT HAVE BEEN DEPRIVED OF HIS OR HER
LAWFUL PARTICIPATION IN THE ESTATE OF THE DECEASED
ASUNCION VDA. DE PAYAN FOR A PERIOD OF TWO (2) YEARS
FROM JUNE 29, 1998. (NOTE: LIEN IS CARRIED OVER FROM TCT
NO. T-59428).

LIABILITIES UNDER SECTION 4 RULE 74 : TO CREDITORS, HEIRS,

AND OTHER PERSONS UNLAWFULLY DEPRIVED OF
PARTICIPATION IN THE ESTATE OF THE DECEASED MADRAZO
PAYAN AS EXTRAJUDICIALLY SETTLED FOR A PERIOD OF TWO (2)
YEARS PURSUANT TO SECTION 4 RULE 74 OF THE RULES OF
COURT.
DATE OF INSTRUMENT: JUNE 9, 2010.

 4. The two (2)- year period provided for under Section 4, Rule 74 of the Rules of
Court for the filing of claims against the estate of the deceased already lapsed
without any claim having been filed, thus the necessity of cancelling the said liens.

PRAYER

WHEREFORE, premises considered, petitioner respectfully prays for the

cancellation of the liens pertaining to Section 4, Rule 74 of the Rules of Court on
TCT No. TCT No. 144-2012001504 without any judicial pronouncement.
