PETITION

COMES NOW, Petitioner, __________________________, unto the

Honorable Office, most respectfully alleges that:

1. Petitioner is a Filipino, married, of legal age, and with postal address

at __________________________;

2. Petitioner is the registered owner of a certain real property covered

by TCT No. ______________________ of the Register of Deeds of
Davao del Norte;

3. Annotated on the said title is the two (2)-year lien covered by “Sec.
4, Rule 74, of the Rules of Court” which was annotated on 9 August
2010;

4. The two (2)-year period provided for under Section 4, Rule 74 for the
filing of claims against the estate of the deceased already lapsed
without any claim having been filed, thus the necessity of cancelling
the said annotation.

PRAYER

WHEREFORE, premises considered, and by virtue of the provisions

of LRC Circular No. 119, Petitioner respectfully prays for the cancellation
of the annotation pertaining to Sec. 4, Rule 74 of the Rules of Court on TCT
No. _____________________, without any judicial pronouncement.
