PETITION

PETITIONER, through the undersigned counsel, unto this Honorable Board,

most respectfully states:

1. That JUAN DE LA CRUZ is of legal age, Filipino, married, and with

residential address at Brgy. San Isidro, Talisay, Camarines Norte, where
he may be served with summons/notice of hearing and other legal
processes of this Honorable Board;

2. That respondent Register of Deeds of the Province of Camarines Norte

is the government agency tasked with the execution of laws relative to the
registration of lands, more particularly Presidential Decree. No. 1529,
Republic Act No. 496, and other related laws with office address at Daet,
Camarines Norte where they may be served with summons, notice of
hearing and other legal processes of this Honorable Board;

3. That petitioner Juan dela Cruz is a farmer beneficiary of the Agrarian

Reform Program pursuant to R.A. No. 6657, as amended by R.A. No.
9700 and was accordingly awarded with TCT No. XXXXXXX (CLOA
No.XXXXXX) identified as Lot 123-A, Psd-00-XXXXX with an area of 875
square meters located at San Isidro, Talisay, Camarines Norte;

Philaris copy of TCT No. CARPXXXXXX is hereto attached and marked

as Annex “A”,

4. That in the said title, inscribed therein in numeric figure was 875 square
meters; however in words, what was inscribed was eight thousand
seventy five square meters; therefore a discrepancy occurs between what
was inscribe with respect to the numeric figures in square meters vis a vis
to the words in square meters;
5. That in the Narrative Technical Description both signed by Geodetic
Engineer Jooel Santos, Chief, Surveys and Mapping Division of the
Department of Environment and Natural Resources, indicated therein is
the true and correct area of NINE HUNDRED SEVENTY TWO (875)
SQUARE METERS, more or less; moreover, in the Approved Survey Plan
for Lilo Mars, the former landowner, Lot No 1-C reveals an area of 875
square meters and not 8075 square meters;

Copy of the Narrative Technical Description is hereto attached as Annex

“B”. Copy of the Approved Survey Plan for Lilo Mars is hereto attached as
Annex “C”;

6. That in a Certification dated March 3, 2000 issued by Saturn Est,

Municipal Agrarian Reform Program Officer of Talisay, Camarines Norte,
he certified that the petitioner was awarded with eight hundred and
seventy five (875) square meters and NOT EIGHT THOUSAND
SEVENTY FIVE square meters as what was erroneously reflected in said
title;

Copy of the said Certification is hereto attached as Annex “D”.

7. That the petitioner executed an Affidavit attesting that the true and correct
area of his tillage is 875 square meters and NOT EIGHT THOUSAND
SEVENTY FIVE square meters;

Copy of the said Affidavit is hereto attached as Annex “E”.

8. Lastly, the CARPO for Operations of the DAR Provincial Office of

Camarines Norte issued a Certification dated February 29, 2000 attesting
to the fact that the land area covered by the said title was 875 square
meters in figures, but inadvertently , what was inscribed in words was nine
thousand seventy two square meters; and interposes no objection to the
said correction of entry.

Copy of the said Certification is hereto attached as Annex “F”.

WHEREFORE, premises considered, it is most respectfully prayed of this

Honorable Board that after due notice and hearing, judgment be rendered:

1. Ordering the DAR Provincial Office to cause and effect the correction
of the inscription in the subject title by deleting the word EIGHT
THOUSAND SEVENTY FIVE AND INSTEAD be replace by the words
eight hundred seventy five being the true and correct land area;

2. Ordering the Register of Deeds of the Province of Camarines Norte to

effect the registration of the corrected land area to reflect the words
EIGHT HUNDRED SEVENTY FIVE being the true and correct land
area in the same title.

Other reliefs just and equitable under the premises are likewise prayed for.
