JOINT PETITION
Comes now, Petitioners, unto this Honorable Office, most respectfully allege:

1. That public petitioner DAR Municipal Office of Mandaon II represented by

Marietta R. Viterbo, the current Municipal Agrarian Reform Program Officer (MARPO), is
of legal age, Filipino, single, with office address at Poblacion, Mandaon, Masbate, where
she may be served with notice and other processes of this Honorable Office;

2. That private petitioner Bernardo B. Magallanes, Jr., is of legal age, Filipino,

married and a resident of Brgy. Alas, Mandaon, Masbate, where he may be served with
notice and other processes of this Honorable Office;

3. That the property is in Brgy. Alas, Mandaon, Masbate, a Government-Owned

Land (GOL), and subsequently distributed to qualified Agrarian Reform Beneficiaries
(ARBs) on November 28, 1993;

4. That as a result of the distribution, Original Certificate of Title (OCT) No.

CLOA O-1416 (collective) was issued in the name of JERRY B. MAGALLANES, et.
al., located in Barangay Alas, Mandaon, Masbate containing an area of eighty-three
thousand one hundred twenty-three (83,123) square meters, more or less. A Certified
True Copy of OCT No. CLOA O-1416 is hereto attached as Annex “A” and made an
integral part of this petition;

5. That during the application, identification, screening and selection of the

potential ARBs in the above subject landholding, there was no actual survey conducted
and all those qualified were immediately included in the subject CCLOA;

6. That during the actual survey conducted on October 20 – 22, 2016, Bernardo B.
Magallanes, Jr., was duly identified as an actual occupant and tiller of Lot No. 125-A
with an area of 16,627 square meters, PSD-05-049910 (AR), covered under
OCT No. CLOA O-1416. A certified true copy of Approved Survey Plan (ASP), Psd-05-
049910 (AR) is hereto attached as Annex “B” and made an integral part of this

7. That the area, location, and boundaries allotted to potential farmer beneficiary is
particularly described in the Narrative Technical Description of ASP No. PSD-05-49910
(AR). A certified true copy of the Narrative Technical Description (NTD) is hereto
attached as Annex “C” and made an integral part of this petition;

8. That the said occupation is certified by the Brgy. Chairman of Brgy. Alas,
Mandaon, Masbate, said certification is hereto attached as Annex “D”, and made an
integral part of this petition;

9. That upon the conduct of CARP Survey Profile by DARMO Mandaon II on it was
identified that Lot No. 125-A of OCT CLOA O-1416 was actually occupied and tilled by
Bernardo B. Magallanes, Jr. A certified true copy of CARP survey profile is hereto
attached as Annex “E” and made an integral part of this petition.

10. That Bernardo B. Magallanes, Jr., was duly identified, screened and included as
potential ARB by the DARMO Mandaon per Carper Lad Form 28. A copy of the said
CARPER LAD Form is hereto attached as Annex “F” and made an integral part of this
petition.

11. That upon field investigation and validation conducted by the personnel of
DARMO Mandaon II and the Support to Parcelization of Lands for Individual Titling
(SPLIT) Team, Bernardo B. Magallanes, Jr., was found to have in actual possession and
cultivation of Lot No. 125-A, Psd-05-049910 (AR) covered by OCT No. CLOA O-1416
(collective); A copy of Field Investigation Report is hereto attached as Annex “G” and
made an integral part of this petition.

12.That there is a need to include the name of FB Bernardo B. Magallanes, Jr. in the
OCT No. CLOA O-1416 to conform to his actual area of tillage and occupation based on
the ASP of the subject property and to avoid conflicts of title in and to real estate.

WHEREFORE, premises considered, it is most respectfully prayed unto this

Honorable Office that, after due notice and investigation, an order be issued to include
the name of Bernardo B. Magallanes, Jr. in the OCT No. CLOA O-1614.

Such other relief as may be deemed just and equitable under the premises are
likewise prayed for.

legal age, Filipino citizens, with office address at DAR Mandaon, Poblacion, Mandaon,
Masbate and a resident of Brgy. Alas, Mandaon, Masbate, respectively, after having been
duly sworn to in accordance with law, do hereby depose and say:

 1. That we are the Petitioners in the above-entitled case, that the same was
prepared at our instance and direction; that we have read it and to the best of our own
personal knowledge and belief the allegations are true and correct and based on authentic
documents;

2. That we have not heretofore commenced and/or aware of any other action or
proceeding involving the same case or issue in any court, tribunal or quasi-judicial agency,
and to the best of our knowledge, no such action or proceeding is pending therein;

4. That if we thereafter learned that a similar action or proceeding has been filed or
is pending before in any court, tribunal, or quasi-judicial agency, we will promptly report
such fact to this Honorable Office within five (5) days therefrom.
