Background On June 25, 2005, the Maryland-National Capital Park and Planning Commission (M-NCPPC) approved the site plan for Clarksburg Village. That site plan dedicated a 13.05-acre parcel of land for the construction of a future elementary school and park. M-NCPPC approved a site plan reflecting a conceptual school configuration and site location acceptable to Montgomery County Public Schools. A July 21, 2005, geotechnical report provided by the developer, Elm Street Development, certified the material under the conceptual school building footprint met requisite compaction requirements for construction of the building. On June 9, 2009, Clarksburg Village, LC conveyed the 13.05-acre Parcel A, Block N, Clarksburg Village, to M-NCPPC. Subsequently, and by deed dated January 7, 2011, M-NCPPC conveyed a 9.2924-acre portion of that property to the Board of Education of Montgomery County for the construction of Clarksburg Cluster Elementary School (Clarksburg Village Site #1). In October 2011, Grimm + Parker Architects completed a feasibility study for the new Clarksburg Cluster Elementary School (Clarksburg Village Site #1). During the feasibility study, it became necessary to enlarge the school and shift its location on the site to accommodate the current Montgomery County Public Schools educational specifications and to comply with Montgomery County traffic and site access requirements. This modification shifted portions of the building beyond the limits of the certified fill. An initial Phase 1 Environmental Site Assessment was performed in conjunction with the Clarksburg Village development; however, extensive site grading was required to bring the entire site to the required subgrade elevation. The existence of unsuitable soils could not be determined or quantified without excavating the site.

On February 12, 2013, the Board of Education awarded a contract to Hess Construction + Engineering Services for the construction of the new Clarksburg Cluster Elementary School (Clarksburg Village Site #1). Upon commencement of grading and excavation for the construction of foundations, the site contractor encountered unsuitable soils. Compaction tests were performed in those areas where unsuitable soils had been encountered and it was determined that the proposed building foundation systems had to be modified to meet structural requirements. The additional cost associated with the removal, off-site disposal and replacement of unsuitable soils, and the modifications to the building foundation system will require a change order to proceed with site work and building construction. The project budget included a contingency to address potential site concerns related to the increase in building size and shift in location. Therefore, I recommend approval of the following resolution to execute the change order: WHEREAS, A contract was awarded to Hess Construction + Engineering Services on February 12, 2013, for the new Clarksburg Cluster Elementary School (Clarksburg Village Site #1) construction project; and WHEREAS, Geotechnical investigations have identified the presence of unsuitable soils; and WHEREAS, The construction documents contain unit prices for the removal, disposal, and replacement of unsuitable soils, which could not be quantified prior to the commencement of site work; and WHEREAS, The building foundation systems have been redesigned by Grimm + Parker Architects to reflect current site conditions; and WHEREAS, Funds were programmed in the new Clarksburg Cluster Elementary School (Clarksburg Village Site #1) construction project for the mitigation of unsuitable soils associated with the final size and location of the building; and WHEREAS, The construction manager, Hess Construction + Engineering Services, will compile costs as the work progresses and submit final costs upon completion of the work; and WHEREAS, The project architect and Department of Facilities Management staff will review the change order to ensure that it complies with the contract specifications and the costs are reasonable; now therefore be it Resolved, That the Board of Education approves a change order in an amount not to exceed $1.8 million to the contract with Hess Construction + Engineering Services for the removal, disposal, and replacement of unsuitable soils, and modifications to the building foundation system for the new Clarksburg Cluster Elementary School (Clarksburg Village Site #1) construction project.
