On 07-05-09 Novak reported to Deputy Sheriff (D/S), Calendine that afer spending the day with his
former fance, -_ during which they both had consumed beer and alcohol, they were involved in a
verbal argument which resulted in them splitting up and leaving at different times in different vehicles. He
stated that he and his fiend Davis lef together in a taxi and returned to Davis' home, at which time
arrived at the house at the same time. He said that he and Davis confronted the driver of the
car that arrived in because he snuck through the gate while it was open for their taxi. Novak
reported that while he was speaking with that driver, got into his Jeep Wrangler and was tying
to dive away so he stopped her because he felt she was too intoxicated to drive. He claimed she locked the
door and rolled the manual window up which resulted in his fingers being pinched in the window, so he
junnped into the back open portion of the Jeep and tied to grab the keys fom the ignition, while
scratching and hitting him the whole tie. Novak stated while this was
bit him on the forearm and he eventually gave into his anger and punched
on the one time. He said when he did this he stopped, jumped fom the vehicle and ran
into bushes and hid until lef the area. He related that he did not immediately make a report
to BCSO, but afer advising his supervisors he was directed to do so.
Contact with Novak:
On 07-08-09 I met with Novak at the Hilton Head BCSO Ofices. asked him to tell me what happened
and he asked if could tell him what the purose of this investigation is so told him it is a CDV
investigation to determine who the primary aggressor is then to seek an arrest wamnt for that person. He
stated that he did not mean any disrespect but he did not want to participate if there was any chance of
being atTested. told him that the CDV law did not leave a lot of room for personal desires there
said that he would not cooperate or participate with any criminal prosecution

arrested for anything to include CDV. He said that he was directed by his supervisors to make this report
and that was the only reason he made the report. told him that would inform others of his desire not to
have anested. asked him how long he had known and he said they have been living
together in his house since September 2008. He said that in February, just prior to Valentine's Day he
asked her to marry him, he said it was one of the happiest days in his life, he said that Tom Berringer even
attended the Engagement Party. He ftther stated that the wedding plans were progressing and his fiend
Glenn Davis, who is a business man on Hilton Head Island, had agreed to be the best man and even helped
them in reserving an eight million dollar house for the wedding party and Novak's family to stay in for the
entire week leading up to the wedding. He said that's parents had agreed to give them $5,000.00
towards the wedding and he was putting in $3,000.00 of his own money, plus they sold-'s car to
help save more money. He then related that everything was great until early June when 's parents
told her they were not going to be able to give them the money they promised and that was putting a lot of
stress on and that was causing problems between tem. He then stated is a loving
and caring person until she drinks alcohol. He said that she is also taking Phenermine, a prescription
weight loss drug, which causes her to have mood swings and ups and downs ofen, especially when she
drinks alcohol. He said that it was getting to the point that he did not want to be around her when she
drank because of these swings. He said that he had also taken the same pills when he lost a lot of weight
last year, but that his doctor would only allow him to take the pills for three months then would not give
him anymore. Novak said that 's doctor has been prescribing these pills for her since he met her
last year. He said that he is not sure how she is allowed to stay on it for so long. He then stated that afer
they sold.'s car he was allowing he to use his personal Jeep Wrangler all of the time. He said that
he did tell her there were certain rules for her to follow, like no driving when she was drinking alcohol, she
was only supposed to drive it to and from work and she was not allowed to have any unknown men in the
car. He then said that during mid June he came home late fom work, not getting home tmtil around 2230
and she was not home. He said he began calling her cellular telephone and some of her fiend's phones to
find out where she was and was told they were in Bluffton at the Winery and that they had been drinking
wine. He said he then went to the spare bedroom and locked the door. He said he laid down to get some
rest and went into that room so he would not have to deal with her when she got home because she had
been drinking. He said after she anived home she stayed downstairs for awhile then came and tied to get
into the door, he said he told her to go to sleep that he did not want to talk to her since she had been
drinking and he needed some rest. He said she picked the lock and came in demanding to talk now. He
said that he eventually got up, picked up his BCSO issued pistol, loaded it, put it into his holster and lef

getting into his Jeep. Lou said he ran over to her and told her she could not drive because she
was told her to just go into the house and she could sleep there. He said she locked the door and
started to roll the manual window up as he was trying to stop her by holding the window at which tme his
fmgers became stuck in the fiame. Novak's fmgers, just below the knuckles, had slight redness and his lef
hand was slightly swollen. He said the frame to the window was damaged during this time. Novak said
when he got his fingers fee he then jmnped into the back of the Jeep that was open because the top was of
and was tying to pull the keys fom the ignition when began hitting him with her purse and other
things and also scratched him. He said that he continued to ty to keep her away from him by shielding
himself with his lef atm and was trying to get the keys with his right hand. He described his position as
his legs being up over the back seat, his upper body was between the two bucket seats. Novak said during
this time- bit him so hard it broke the skin and he instinctively punched her one time on the right
side of her face between the eye and the ear area. He said once he hit her he realized what he did and
stopped, he said he immediately saw her face swelling and turning red. Novak said he then jumped out of
tl1e back of the jeep and ran to hide in some bushes hoping that would allow her to calm down and maybe
go inside. Novak said afer a few minutes he saw her leaving in the Jeep, he said she was yelling his name
as she was leaving the area trying to get him to come out from hiding. Novak said he ttied to call his father
and have him pick him up, but his father could not get to him at that time so he retured to Glenn's house.
Novak said he did not realize how bad his own injuries were until he got up the next moring and then
he knew that he could not stand duty looking like he did so he called Sgt. Runnion and asked him to cover
the duty for him and explained what happened. He said that Runnion called SSgt Viens who in tur
notified Capt McSwain who directed him to fle a police report. He also said that he went to the hospital to
have his ifuries looked at, but he said he lied to them telling them that he fell down. He provided me a
copy of the hospital papers he was given. Novak said he is working on a written statement and would
provide it to me when he gets it finished. He also said he is having his father and his father's girlfiend

Telephone Voicemail:
On 07-09-09 activated my cellular telephone and discovered that had a voicemail from the previous
night from@. She said that two of Lou's fiends had called her and one told her that all of BCSO
was having a manhunt trying to fmd her and that was going to arrest her when !found her. She also said
that one said she should not say anything to me and that she should get a lawyer. !told her that was not
going to arrest her when !saw her that was doing an ofcial investigation and thus Jwanted to interview
her in person. told her that once !was done interviewing her was going to leave and she was fee to do
whatever she felt like doing at that time. She said could meet with her at her ofice in Hilton Head
Hospital at 1000. asked her who called and she said Paul Linton and his wife called afer Paul spoke with
Lou.
Contact with@:
On 07-09-09 !met withat her ofice. advised her that !would like to audio tape the
interview and she said OK, and then said she did not want the interview taped, saying it made her nervous,
so stopped the recorder. asked her when she fust contacted BCSO for assistance and she said when she
went to work Sunday night and the people at the hospital saw her black eye they said BCSO had to be
called, She said she met with Deputy Pmsinowski and his supervisor Karen Denim. She said that she had
already provided a detailed statement and that she could not think of anything that she wanted to change in
that statement. told her that !had read the statement and was familiar with what she reported so that
wanted to review a few things with her and she agreed.
She initially related nearly the same history as Novak had detailed in his interview, to include how
everything went so well until her family decided they would not be able to give them the $5,000.00 that
they initially thought they would be able to do. She said that Lou always felt this was a sign that they did
not want her to marry him, when in fact it was just that they could not afford to give them the money. She
said that once that happened Lou's entire attitude changed and he started to get upset and start yelling for
no apparent reason. She said he became extremely moody and had extreme mood swings. She said she
tried to tell him they did not need such a fancy expensive wedding but he always said they had already told
everyone what they were doing and is was embarrassing to back down now. She said the entire plan fell
apart during the month of June and they ended the engagement because of these issues and his anger issues.
asked her about the incident she mentioned in her statement about a pistol and she said that was partly
her fault for going out with her friends and not telling him, she said she knew that if she went out without
telling him he would get mad, but she did it anyway and that when she got home he locked himself in the

spare bedroom and refsed to talk with her about their issues. She said that she popped the lock and
demanded to speak about the situation, but he refsed. She said that she knew she was pushing the issue
and that she knew that would make him mad. aid Lou got out of the bed, he was still dressed
picked up his BCSO pistol from somewhere, she was not sure but said maybe under the pillow and then he
dropped the thing that holds the bullets on to the floor fom out of the bottom of the pistol. She said he
picked it up and did something real loud with the pistol and walked out of the house. She said when he did
this with the pistol is scared her like she had never been scared before by him. She said after he left she
packed a few things and went to stay with a fiend for a couple days. She said that he apologized for doing
that with the pistol and said they should go to counseling for their issues together so she moved back home.
said all was well for a little while but the next time she went out with her friends he told her
that she had to move out and the engagement was off. She said her parents came the next day and helped
her move. She said while she was moving out their friends, the Lintons, from across the steet came to see
what was happening, they asked her if this was because of the incident and both said Lou was really
wrong for doing that to her.
asked her if she had any idea why Lou was having these mood swings and she said it's because he is
mixing his medicine with alcohol. She said he is taking a steroidal testosterone booster gel that he rubs
onto his skin each day. She said she is not exactly sure what it's for, but it's a steroidal substance so it is
causing him to be moody and to become angry for no apparent reason. She said that she is also taking
medicine for weight loss, called Phenermine, but that she is slowly cutting back because she has lost all the
weight that she wants to loose. She said this whole incident is mainly alcohol related in her opinion. She
said that Lou is normally a sweet and loving guy, but believes the stress of the wedding, the money issues
and his mixing the medicine with alcohol is too much for him and caused him to do something exteme.
She said she still loves him but realizes now they can not be together.

call Lou, but her phone broke so she could not get through to him. She said that they sat by the gate until a
cab pulled up and that was when they realized Lou and Glenn were in that cab so they followed them
through the gate to Glenn's house. She said Lou and Gleim got out of the cab and began yelling at the
driver saying he had no right to come through the gate. She said she got out of the van and into the Jeep to
dive home. -said her fiends then drove away and that was when Lou went crazy when he saw her
in the Jeep. She said he ran at her screaming so she locked the door and started to roll up the window
because he was screaming at her to get out of his Jeep and that she was not allowed to drive it anymore.
She said that he was pulling down on the window glass as she was rolling it up. She said he pulled so hard
on the glass it bent the door frame slightly outward and then he jumped into the back of the Jeep behind her
reached around with his lef pinnig her against the seat with his being across her neck and chest
area while he was also trying to get the keys. She said she was so scared at this point due to the way he ran
at her yelling and then bending the door frame that whle she was phmed to the seat she grabbed a Palmetto
Pass and swung it backwards over her right shoulder several times eventually hitting him hard enough that
he fell back across the back bench seat covering his face yelling she hit me. said she was scared
and looked back to see if he was OK. She said she turned and looked between the bucket seats and saw
him holding his face, then he looked at her and punched her very hard on the right side of her face by her
eye. She said it dazed her and she could feel he was grabbing at her again so she just began swinging,
scratching and punching at him to get him off her during which time she said she knows she also bit him at
least once. She said that she did not know what else to do because she was so scared from him punching
her. She said Lou eventually jumped out of the back of the jeep and ran into the woods to hide. She said
that was when Glenn, who was just standing outside the Jeep the whole time told her to come inside, so she
went inside to use the bathroom. She said she saw her face was already swollen and her eye appeared to be
black already. She said she grabbed her things from inside and then lef the area. She said while she was
doing this Lou was hiding in the woods.
said she drove to Lou's house to get her dog and she also took a spare cellular telephone, due
to hers breaking earlier as well as a few of other personal things from the house. She said that she texted
Lou to tell him that she had a black eye. She said he texted her "Please help me" so she called him and he
said he was hurt in the woods that something bit him and asked her to come get him. said she was
too scared to go back near him at that time. She said they texted back and forth several times later that
morng and he eventually told her that he filed a police rep0i and that he was loosing his job for this. She
then asked me if he was suspended or if he was going to loose his job. !told her he was not suspended at
this time and that could not say if he would loose his job. She said it was wrong what he did, but she did
not want him to loose his job, because he loves being a cop and she worried what he might do to
