Reference is made to all other reports written under West Haven Police Department Case Number 2010016075, On Saturday June 5, 2010 at approximately 2330 hrs this Detective responded to the area of Peck Avenue and Noble Street on a report of a person shot. Upon arrival | met with the on scene patrol officers who explained that Lester McClease, age 27 of 339 }Blohm Street in West Haven had been transported to Yale New Haven Hospital with life threatening injuries which were possibly the result of a gunshot wound. McCioase would not survive his injuries and was pronounced dead at 2354 hrs. by Dr. Lui. Several }witnesses on scene reported hearing a single gunshot and socing a black vehicle leaving the area shortly thereafter. A short while after my arrival | was informed by dispatch that they had received a call from a male identifying himself as Mikeal Breary. JAccording to Breary, he was a witness to the shooting on Peck Avenue. A short while later Breary arrived at police headquarters: where twas able to interview him. ‘This Detective along with Detective Sgt. Casey met with Mikeal Breary of 18 Latanzi Street at police headquarters. Breary jexplained that he was the driver of the black Honda Accord that was seen leaving the scene immediately following the shooting at Peck Avenue and Noble Street. During the interview Breary stated that he smokes marijuana occasionally and that his source of [supply is @ white guy that goes by the name of J.D. Breary stated that he called J.D. early in the evening on June 6 and asked J.D. if he could get some marijuana, V.D. told Breary to come to his house and J.D. would take care of him. Breary stated that he arrived at J.D.'s house, located at 82 William Street some time after 2200 hrs. Breary stated that he and J.D were hanging out and smoking }when J.O. received a call from a customer looking for some marijuana. According to Breary, J.D. agreed to meet the male euustomer Jand asked Breary for a ride. Breary stated that since he was on his way home, he agreed to take J.D. to meet the customer. Broary stated that he and J.D. got into Breary's car, a black Honda Civic and drove around the corner where they met up with a black male }who J.D. only knows as “Bamboo.” Breary stated that Bamboo got into the back of Breary's car and told Breary to dive. Breary stated that after driving only a few feet, Bamboo, in an apparent robbery attempt, pulled out a gun and put the gun to the head of J. D. Breary stated that J.D. Immediately grabbed the gun and began to wrestle it out of Bamboo's hand. Breary stated that he immediately stopped his car and jumped out. Breary stated that he ran away from the car and watched from approximately 36 feet jaway as J.D. ard Bamboo fought over the gun, Breary stated that during the fight both J.D. and Bamboo fell out of the ear onto the road, through the open drivers side door, Breary stated that J.D. and Bamboo were still wresting over the gun when he heard the Jgun go off one time. According to Breary, after the gun was fired, J.0. stood up holding the gun and Bamboo was lying on the Jground. Breary stated that after the gunshot, J.D. then ran north on Peck Avenue. Breary stated that when J.O. ran away, Breaty ran back to his car. Breary stated that when he ran to his car he saw Bamboo lying on his stomach breathing very loudly. Breary stated that he did not know if Bamboo was injured or angry so Breary drove away. Breary stated that he drove home and upon arriving home and speaking with his cousin, he decided to call the police. it full name was. Breary stated that he only knew J.D. as J.D. According to Breary, J.D. lived am Street with his girlfriend however we were unable to locate J.D. at that residence. A statement was obtained from /Mikeal Breary detailing his version of the incident. While we were interviewing Mikeal Breary, | was informed that J.D. had been located at a residence on Dana Street. | was informed that J.D was cooperative and was being transported back to the crime scene to point out where the handgun was, This writer returned to the crime scene where | met with J.D. who's real name Is Joseph Vreeland. Vreeland was able to show us where he tossed the gun as he was running away from the scene of the shooting. The .380 caliber semi automatic chrome colored handgun was located in a shrub a few feet away from the crime scene. After showing us the location of the handgun, Vreeland was transported by this writer and Sgt. Casey to headquarters where he was interviewed. Prior to being interviewed, Vreeland was {given his Miranda rights and asked to sign a rights waiver form, which he did voluntarily. At that time Vreeland provided a [statement detailing his version of the incident. Vreeland stated that he has known "Bamboo" (Lester McClease) for a short while jand that he and Bamboo have had conversations about the high grade marijuana a.k.a. "haze" that Vrecland is able to obtain and distribute. Vreeland stated that during the early evening hours of June 5, 2010, he was out on Campbell Avenue and was spotted by Bamboo who was driving past. Vreeland stated that Bamboo stopped and asked him if he had any marijuana to sell, stating that he was interested in purchasing two ounces of “haze.” Vreeland told Bamboo to call him later on and Vreeland would see how /much marijuana, "haze" he could get. Vreeland stated that he was at his glriftiend’s residence at 82 William Street, with Mikeal [Breary when Bamboo called asking Vreeland to mect him and bring the two ounces of marijuana that Bamboo had requested leariier. Vreeland stated that he told Bamboo that he only had a ite over an ounce and the price would be five hundred fifteen dollars, ($515.00). Vreeland stated that Bamboo agreed and told Vreeland that he would meet Vreeland on Blohm Street. Bamboo further told Vreeland that he would be on foot. Vreeland stated that he became nervous about Bamboo being on foot. Vreeland stated that due to his sudden nervousness, he asked Breary if Breary would accompany him to the meeting with Bamboo. Breary agreed and both Vreeland and Breary got into Breary’s black Honda Civic and drove around the comet to meet with Bamboo. Vreeland stated that wien they arrived at the corner of Blohm Street and Peck Avenue they saw Bamboo standing at the comer. Vreeland stated that thoy pullod over and Bamboo got into the back seat ofthe car and sat behind him. Vreeland stated that Bamboo told Breary to rive up tho streot because he had seen a police car go by. Vreeland stated that as Breary drove south on Peck Avenue Vreeland started to turn around to get the transaction started. Vreeland was just about to ask Bamboo to give him the money for the marijuana that he had sitting in his lap. Vreeland stated that as soon as he turned around, Bamboo pulled out a gun and placed it to the side of Vreoland's head. Vreeland stated that Bamboo demanded that Vreeland give up the marijuana and any eash he may Jrave had. Vreoland stated that his first instinct was thatthe gun was not real, so he grabbed the gun and attempted to wrestle t faway from Bamboo. Vreeland stated that as he and Bamboo were wrestling over the handgun, Breary stopped the car and got out. \Vreoland stated that he and Bamboo continued to fight for the gun. Vreeland stated that during the fight, Bamboo wound up climbing over the back seat and eventually wound up on top of Vreeland in the front seat, Vreeland stated that as the fight over the Jgun progressed, Bamboo was yelling “give up everything or Tm gonna let one fly". Vreeland stated that both he and Bamboo tumbled out of the open drivers door of the car and landed on the street. Vreeland stated that Bamboo was on top of him as they [continued to wrestle over the gun. Vreeland stated that during the fight with Bamboo, Vreeland's sweatshirt was pulled up over his head cutting off his vision. Vreeland stated that although he could not see, he could feol that ho was gaining control of the gun and had the majority of his let hand around the gun when it went off. Vresland stated that after the gun went off Bamboo rolled off of him, Vreeland stated that he got up, gun in hand, and looked down at Bamboo who was face down leaning on his hands in a push lup position. Vreeland, not knowing if Bamboo was injured, ran north on Peck Avenue, tossing the gun into the bushes as he ran Vreeland stated that he knew the gun went off because he could fee! itn his hand however the sound of the gunshot was muffled Jand Vreeland stated that he was still unsure if the gun was ove real, Vreeland stated that he did not know that Bamboo had bee injured and thought that Eamboo, who could have seen him run to his girlfriend's house, was going to come after him again which ]was why he left the house and walked to 68 Dana Street where he was late located, ih OSE ssrlootzs. Numbor:CT00015500 Mikeal Breary's black Honda Civic was located at Breary's residence, 18 Latanzi Street, and has been impounded at police headquarters awaiting a search warrant at which time the vehicle will be searched for evidence. At this time there Is a quantity of marijuana in plain view in the front of the vehicle which we believe to be the marijuana Vreeland Intended to sell to Lester McCleaso a.k.a. Bamboo. ‘The handgun recovered at the scene with the assistance of Joseph Vreeland has been secured as evidence to be processed ata ater time. Based upon our investigation to this point, in conjunction with the statements obtained from Mikeal Breary and Joseph Vreeland, |Joseph Vreeland is being charged with Manslaughter 2nd Degree 53a-56, Possession of Marijuana, 21a-278e, Possession of [Marijuana W..T.S, 21a-27b.
