BETWEEN
THE MONTGOMERY COUNTY BOARD OF EDUCATION
AND
DR. JERRY D, WEAST
It is hereby this JY day of » 1999, agreed by and between the Board of
Education of Ne County, Marylahd (bereinaficr called the “Board") and Dr. Jerry D.
‘Weast (hereinafter referred to as the "Superintendent”) that the said Board, in accordance with
its action as found in the minutes of the meeting held on the 29th day of June, does hereby
appoint and employ Dr. Jerry D. Weast as Superintendent of Schools of Montgomery Coumy
for a four-year term terminating on June 30, 2003, upon the following terms:
1 Erofessional Duties and Responsibilities
A. The Superintendent will devote his best professional efforts and full time in
carrying out the duties and responsibilities of the position of Superintendent and
as Sectetary-Treasurer of the Board of Education. These duties and
Tesponsibilities will include, bur not be limited to, those set forth in the
Education Amticle and other applicable provisions of the Annotated Code of
Maryland as amended from time to ume; those duties set forth in the bylar
adopted by the State Board of Education; and the polices, rules and regulations
adopted by the Board of Education of Montgomery County and any amendments
to these bylaws, policies, and regulations as adopted by the Maryland State
Board of Eatucation and the Board of Education of Montgomery County from
me to time, These duties and responsibilities include, but are not limited 10,
the transfer and assignment of professional personnel and other employess under
bis supervision as in his judgment the needs of the system require, the
organization and arrangement of his administrative and supervisory staff,
including instruction and business affairs: the selection and nomination for
action by the Board of cenificated and non-centificated personnel for hire and
Fecommencation of professional staff for promotion; the promulgation or
amendmem ftom tume to time of regulations, rules and procedures deemed
necessary or desirable for the well ordering of the school system; and, in
general, the performance of all uhose duties as prescribed by the Board, the State
Board of Education and the laws of the State of Maryland.
B The Superintendent or his designee shall be entitled to attend all meetings of the
Board or its committees, consistent with the iaws of Maryland, including
SxeciTiVe sessions. except when his tenure, salary, or performance evaluation is
under consideration and the Superintendemt may advise the Board on any

mention of the Superintendent. The Board shall refrain from individual
imerference With the administration of school policies except through Board
action. The Superintenden: similarly agrees to share with the Board, as
appropriate, all criticisms, complaints, and suggestions concerning the school
system which may come to his attention.
‘The Superintendent will maintain throughout his term a valid and appropriate
certificate to act as Superimendent of Schools in the State of Maryland and the
failure to maintain such certification sball terminate his employment and all
obligations hereunder as of the date of loss of certification.
The Superintendem may engage in outside employment if such employment does
not interfere with the duties and responsibilities set forth herein and prior
notification has been given to the Board. Such notification will include the
‘identity of the employer and the general nature of the duties associated with such
employment. If these conditions are met, the Board President may grant to the
Superintendent, the opportunity to teach or serve as an adjunct professor or in
some other capacity at the college or university level on a part-time basis.
Under the conditions set forth in this paragraph, the Superintendent may accept
Private consulting and speaking engagements and may accept appointments 10
foundations. boards or commissions. The Superintendent will take vacation or
other leave time as defined by Board policy or available under this contract
while performing any private consulting or fee for service employment during
normal week day work hours, In no event will the Board be required 10
reimburse any expenses incurred by the Superintendent in the performance of
outside compensated employment
This is an agreement for the performance of professional services as
superintendent by the Superimendent. who shall not be assigned to any other
Position or have his duties reassigned to others without his consent.
1 Performance
A
The parties shall mect annually between July 1 and August 1, or at such other
lime as is mutually agreed upon, to establish the school system's goals and
objectives for the ensuing school vear. Specific performance standards for
achieving the goals and objectives shall be mutually agreed upon and reduced to
‘writing and shall be among the criteria upon which the Superintendent is
evaluated
‘The Board shall provide the Superintendent with periodic opportunities to
discuss the Superintendent-Board relationship. At least annually, the Board
stall meet and discuss with the Superintendent the working relationships
Page 2 of 8berween the Superimendent and the Board. The Board will conduct an annual
evaluation of the Superintendem's performance including the performance of the
School system for which the Board will hold bim accountable, During the
evaluation, the Superintendent will, as necessary, share his recommendations for
improving Board-Superimendent relationships. The Board will provide the
Superintendent 2 writen Teport on his evaluation and this report will be kept
confidential, except as may be required to be revealed in any proceedings in
which the Board and Superintendent are adverse panties.
Tl. Compensation and Benefits
A.
The Board agrees to pay the Superintendent for the first year of his term (pro
rata based on his first day of full-time occupancy of the Office) a salary in the
amount of Two Hundred Thirty Seven Thousand, Seven Hundred Ninery-Four
Dollars and Thirty-Six Cents ($237,794.36) paid in equal bi-weekly installments
and his salary for each succeeding year during said four-year term shall be equal
to the Washington/Bakimore metropolitan area CPI plus three percent (35)
Additional compensation may be provided in the form of bonuses at the
discretion of the Board taking into consideration the evaluation of the
Superintendent. Any modification in the salary set forth herein, other than the
automatic increase provided above, or in any benefits provided that are in
addition to those applicable to all twelve month administrative and supervisory
Personnel, during the term of the Contract shall be in the form of a written
modification. Any such modification shall not be deemed to constitute 2 new
‘contract mor to exten the termination date of this Contract.
The Board shall provide the same number of annual and sick leave days, except
2s modified by this contract, as are provided to all twelve-month administrative
and supervisory personnel, Annual and sick leave may be carried forward as
Provided to all twelve-month administrative and supervisory personnel. In
addition, the Board recognizes that the Superintendent does and will commit to
the services of the school system many hours of additional time, above and
beyond those necessary for the completion of his duties, including time spent
locally and ouiside the County in representing the schoo! system, ofien at night
and on weekends In recognition of these services, the Superintendemt shall
Feceive additional annual leave days so that he has available upon his
employment a total of twenty-five (25) days. Up to, but not in excess of, fifteen
(15) unused annual leave days per year shall be paid to the Superintendent on a
pro rala basis computed at 1/227 of his salary on June 30 of each fiscal year. 1p
addition, the Superimendent shall have the option of carrying over any or all
uunused annual leave. but in no event shall he be able to convert more than
fifteen (15) days leave per year as provided herein.
