Interview:
‘On the above date and time, | was informed that the Cheshire Police Department was investigating a residential
robbery/arson at 300 Sorghum Hill Road that resulted in the deaths of three of the occupants and a serious head
injury to a fourth person of the residence. At approximately 1225 hours, | arrived at the police department to wait
further assignment. Sgt. Joseph Quilty subsequently assigned Detective Chris Consorte and I to interview one of the
perpetrators namely, Steven Hayes, DOB 05/30/1963,
Investigators removed Hayes from the cellblock and escorted him to the detective bureau where his handcuffs
were removed. Hayes was asked if he was under the influence of any drugs and or alcohol and he replied, “no”. At
approximately 1310 hours, Hayes was read his ‘Notice and Waiver of Rights’, which he signed and waived (see
attached form). Investigators began questioning Hayes in regards to his involvement in this crime. During the
interview, Hayes was fed and allowed to use the bathroom facilities. Hayes also stated that he had obtained a GED
and is able to read and write.
Hayes verbally reported that he first met Joshua Komisarjevsky approximately 1 % years ago at a half way house
in Hartford. He said over this time he and Joshua would attend AA and NA together and said they became good
nds. Hayes said that he currently lives with his mother and younger brother in Winsted, but itis not a good
situation for him. He said that lately life sucked and he was on a downhill slide. He said that he has no money, no
car and not enough food to eat. He said that he recently had a job working construction for a guy named ‘Phil, as a
laborer in Stamford until his mother would not allow him to use her car anymore. He also said that his mother gave
him until the end of the week to move out. Hayes said that with no money and no place to go, he was very
desperate make some money. Hayes said that he and Josh discussed starting a home improvement company but it
never was more than an idea.
Hayes said that on Sunday, July 22, 2007, he spent the day drinking in various bars in Waterbury and
‘Thomaston. He said that he was able to get to the bars by borrowing ‘Phil's’ red GMC pick-up truck. Hayes said tha
during the day he called Josh on his cell phone via his (Verizon) cell phone. He told Josh of his dilemma and was
desperate to get some quick money. Hayes said that Josh asked him how serious he was and Hayes told him, “ver,
serious". Hayes said that he told Josh that he would do anything to get some money. Hayes said that it was then
that he and Josh decided to break into a house in Cheshire. Once inside, they would tie the people up, take the
money and jewelry, and get out as fast as they could,

Interview cont:
Hayes said that sometime around 9:00PM Josh picked him up in his red van (mother’s van) at one of the bars in
Waterbury. During the interview, Hayes changed his story and said that he drove a red GMC pick-up truck that he
borrowed from ‘Phil. Hayes then said he drove Phil's GMC to the Stop & Shop in Cheshire where he met Josh who
was driving his mother’s red van. He said that they left the red GMC in the Stop & Shop parking lot and Josh drove
them to a Wal-Mart. Hayes said that both he and Josh went into the store where they purchased a black colored BB
handgun that cost approximately $40.00. He said that they wanted the gun just to scare the people in the house.
Hayes said that Josh purchased the gun but he provided the money. Hayes said that after they left Wal-Mart, Josh
drove them to a bar in Cheshire where they had a shot and beer each,
Hayes stated that they then drove around in Josh's van until sometime after 2:00am. He said that Josh then
parked the van down some street and they put masks on to cover their faces. Hayes said that he used a black
colored hat that he cut the holes out so that he could see to cover his face. He said that Josh used a tan colored
shirt or tan nylon stocking to cover his face, He said that he was wearing blue jeans with a blue fleece sweater and
sneakers. He said that he does not know what else Josh was wearing with exception of the mask.
Hayes said that they walked through a residential area until they came to a large house. He said that they
walked through the backyard and saw a light on in the rear porch and a man asleep on the couch. Hayes said that
they tried to get in the house but the doors and windows were locked. He said that Josh then checked the basement
doors and found that they were unlocked. Hayes said that Josh entered the house through the basement doors and
he remained outside and watched fo make sure the man did not wake up. Hayes said that he looked up through the
basement windows and saw Josh pick up a baseball bat. Hayes said that as he remained outside he saw Josh enter
the porch area from inside the residence and approach the sleeping man. Hayes said that he then observed Josh
walk up to the sleeping man and begin to hit the man in the head 4-5 times with the baseball bat. Hayes said the
1 began screaming and there was blood all over the place.
Hayes reported that Josh then unlocked the porch door and let him in. He sald that they told the man to keep
his mouth shut and that all they wanted was the money. Hayes said that the man said he would cooperate. Hayes
said that they then tied the man up using rope that they found’in the house. He said that he and Josh began going
through the house checking wallets and pocketbooks looking for money and jewelry. Hayes said that there was not
much money and they figured there had to be more money somewhere.
Hayes said that he and Josh then went upstairs where they found three women sleeping. He said that in the
master bedroom they found a woman, presumably the mother and her young daughter sleeping in the bed. Hayes
said that they woke both the mother and daughter up and told them to remain calm, as they just wanted the money.
Hayes said that they took the young child and put her in another bedroom and tied her up to her bed and put a pillow
case cover over her head. Hayes said that they also tied the mother up to her bed and also put a pillow case cover
over her head. Hayes said that they also located an older daughter sleeping by herself. Hayes once again said that
they tied her up and also put a pillowcase cover over her head. Hayes said the reason they put the pillowcase covers
over the females was so that they could not be recognized.

Interview cont:
Hayes said that as they were looking for more money and jewelry they found a Bank of America account that
contained $20,000-30,000. Hayes said that at this point, the plan changed and they decided that they would wait
until morning and have the mother go to the bank and withdraw money from the account. Hayes said that they spent
the rest of the night drinking beer from the family refrigerator.
Hayes said that later in the moming sometime around 4-5:00 am, he drove the family's cream colored mini-van
to a gas station in Southington. He said that at first, he had trouble finding the keys, but eventually he found them in
the kitchen. Hayes said that he took 2-3 milky colored plastic containers from the garage and filled them up with gas.
Hayes said when he retumed he put thé gas containers on the porch and went inside. He said that he noticed that
Josh had taken the father and put him in the basement. Hayes said that he observed that the father's hands were
stil ied and he was sitting on several pillows.
Hayes said that he and Josh discussed how they were going to get the mother to the bank at 9:00am. Hayes
said that the original plan was that he would take the mother to the bank in the cream colored vehicle. He said that
meanwhile Josh was to take the remaining family members and put them in the other family car, Hayes sald then
they Would set the house on fire to destroy any evidence of them being in the house.
Hayes said that he left the house with the mother driving the cream vehicle at approximately 9:00am. He said
that he sat in the passenger front seat and was carrying the black colored BB gun. Hayes said that as they got to the
Bank of America the mother exited the vehicle and he then drove the vehicle to the other end of the parking lot.
Hayes said he began to get nervous because it appeared to him that the mother was taking a lot of time in the bank.
He said that he called Josh and advised him of his concerns, but Josh told him to give it some time. Hayes said that
the mother then exited the bank and he drove up to the bank, where she subsequently got into the front passenger
vat, Hayes said that the woman told him that she was able to withdraw $15,000.00, which she had in a bag
Hayes said that when he arrived back at the house they walked inside and Josh tied the mother back up and
placed her on the living room couch. Hayes said that he and Josh began arguing because Josh felt he was not
doing any of the dirty work. Hayes said that Josh inferred that he had sex with the younger of the two girls and made
her take a shower. Hayes said that he did notice that that the younger girs clothing was different since the time he
left for the bank. Hayes said that Josh told him that he had to have sex with the mother to square things up. Hayes
said that at this point, he pulled the mothers pants and panties off and put her on her back. He said that he pulled hi
pants down and had vaginal intercourse with the mother. He said that it only lasted a minute and he did not
ejaculate because he was nervous.
Hayes said after he had sex with the mother things began to get out of control. He said that he smelled gas
and then Josh told him that the father had escaped from the basement and they had to get out of there. Hayes said
that he ran into the sunroom, grabbed the money and ran out the door into the family’s cream colored vehicle. He
said that he put the gun in the back pocket of his pants. He said that Josh drove the vehicle and struck several
police cars before they were stopped. He sald that the jewelry and money and masks they were wearing should still
be in the family vehicle.

At approximately 1420 hours, investigators advised Hayes that the verbal statement he made would be
reduced to 2 written statement. Hayes advised that he wanted to consult with an attorney before giving a written
statement At this time, the interview was stopped. | then showed Hayes the notes that were written down during his
verbal statement. He reviewed the notes as well as the documented time the interview ended. Hayes agroed the
notes fo be an accurate account of what he told investigators, Hayes subsequently signed that notes indicating that
questioning had stopped at 1420 hours.
At this point, Detective Consorte and | then began the task of setzing the clothing that Hayes was wearing
Guring the commission of this crime for’evidentiary value. After this process was complete investigators asked
Hayes who he wanted to call for an attorney. Hayes asked if it would cost him anything and | responded that | did
not know. Hayes sald that he changed his mind and did not want to consult with an atiomey. | then asked Hayes it
he wanted to continue his interview and he said, "yes"
‘At 1450 hours, Hayes signed a second Notice and Waiver of Rights. Hayes was then informed that interview
would be documented by the use of a tape recorder. At this point, Hayes once again invoked his right to consult witk
an attomey before further questioning. The interview was terminated and Hayes was escorted to a holding cell in the
police department.
