AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:
That the undersigned affiants, Detective Brian Salkeld and Officer Daniel Richter are duly sworn member
of the Hartford Police Department, Hartford, Connecticut, and have over seventeen years of police experience.
The affiants are presently assigned to the Major Crimes Division of the Hartford Police Department The
undersigned affiant's duties include but are not limited to the investigations of homicides, robberies, burglaries
and serious assaults. These affiants have investigated cases similar to the one set forth below which has led to
the arrest and convictions of such offenders.

On August 19,2010 at approximately 1500 hours the Undersigned Detective was notified by Sergeant
Garth Perri that a possible larceny had occurred involving an employee of the City Of Hartford. Sergeant
Perri had received information from James Rovella, the State's Chief Inspector, that involved an individual by
the name of Hiriam Martinez, DOB 10/27/64, an employee of City of Hartford Public Works Department.
James Rovella stated an individual by the name of ElhajEl-Haji-Bey; who is a retired employee of The City
Of Hartford, had contacted him about the incident. Haji-Bey told Rovella that he had witnessed an employee
of the City of Hartford that he knows as one Hiriam Martinez, transfer a drill from a City Of Hartford truck to
a private contractors vehicle. Hali-Bey is very familiar with Hiriam Martinez and has known him for
approximately ten years. Haji-Bey was also familiar with the individual in the private contractor track.
Haji-Bey recognized the private contractor to be that of an old acquaintance by the name of David Robbin. In
addition the contractor truck that David Robin was operating had his name and phone number on the side of
it. Haji-Bey had called to report the incident on the day he observed the transfer but was not satisfied with the

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

result Haji-Bey contacted Rovella in an attempt to get some police action on the incident.

The undersigned spoke to Haji-Bey on the phone who confirmed that on August 12, 2010 at approximately
1520 hours he had seen the transfer of a Milwaukee drill from Hiriam Martinez's truck to David Robbin's
vehicle. Haji-Bey stated he has known Hiriam for years and actually hired and supervised him when he was
employed by the City Of Hartford. Haji-Bey was parked in his vehicle approximately fifteen feet away from
both Hiriam and Robbin during the transaction and had a clear view with no obstructions. Haji-Bey observed
Hiriam take the drill out of the back of the City of Hartford van and remove the Milwaukee drill case out of
the brand new box and place it on Robbin's personal plumbing vehicle. Haji-Bey stated that he immediately
called the Hartford Police but was transferred to the Windsor Police. In addition Haji-Bey called the City Of
Hartford Public Works Department and spoke to a Genero Sepulveda who was Hiriam's current supervisor at
the Public Works Department. Genero told Hiriam not to speak to anyone else about the incident and that he
would take care of it internally. Haji-Bey came to the Hartford Police Department and gave a written sworn
statement to the undersigned explaining in detail the incident.

It should be noted that the undersigned confirmed that Haji-Bey did call the Hartford Police Department at
approximately 1522 hours and reported the incident but it was referred to Windsor Police Department by the
Hartford Police Dispatcher. The Windsor Police did in fact respond to the City Of Hartford Public works
Department on August 12,2010 at approximately 1600 hours. The Windsor Police Department was unable to
contact any of the involved parties and referred it back to the Hartford Police Department.

On August 24,2010 at approximately 1600 hours the undersigned conducted an interview with David
Robbin DOB 05/08/65, at the Hartford Police Department. David Robbin provided a sworn written statement
explaining details about a transaction between himself and a City of Hartford employee by the name of
Hiriam Martinez. Robbin explained that he had received a call out of the blue on his cell phone by Hiriam
Martinez. Robbin had known Martinez for almost twenty years but hadn't heard from him in a long time.
Robbin stated that Hiriam wanted to know if he could use a Milwaukee Hole Howg Drill and if he would like
to buy one. Robbin is a plumber and knew that the drill would sell new for almost $400,00. Hiriam told
Robbin that he would sell the drill to him for $250.00. Robbin agreed and they arranged to meet in a parking

The undersigned affiant, being duly sworn, deposes and says:

lot in the Windsor Center that same day. Robbin stated late that afternoon he observed Hiriam pull into the
parking lot in Windsor with his City of Hartford truck. Hiriam gave Robbin the drill and he gave Hiriam the
$250.00. Robbin stated that on the following morning he relieved a phone call again from Hiriam. Hiriam
told Robbin that he needed the drill back immediately because someone had seen it missing. Robbin and
Hiriam met in the parking lot of the U.S.S. Chowder Pot in Hartford around 0900 or 1000 hours that morning.
Robbin stated he gave the drill back to Hiriam in exchange for his money back. Hiriam only gave Robbin
$225.00 back and told Robbin that he didn't have the ML $250.00 at this time. Robbin did not want to deal
with Hiriam again and told him not to worry about the rest of the money and has not heard from him since.

On September 02, 2010 at approximately 1630 hours the undersigned interviewed Hiriam Martinez at the
Hartford Police Department. Hiriam Martinez, although not under arrest at the time, was read his rights and
waived them both verbally and in witting before giving the undersigned a sworn voluntary written statement
about the incident. Hiriam Martinez stated that he had been told by his supervisor from City Yard, Genero
Sepulveda, to get a quote for a How-Hog drill. Hiriam Martinez had gone to Graingers located at 75 Maxim
Road in Hartford Connecticut a couple of days before August 12,2010 to get this quote. It should be noted
that the City Of Hartford Public Works Department has an open purchase order with Graingers. Hiraim
Martinez stated that the quote was for around $300.00 and the drill usually sells for $400.00. Hiriam Martinez
stated that he told the employee at Graingers to go ahead and purchase the drill under the City of Hartford
account. Hiriam Martinez claimed that he had purchased items before in this manner and that the supervisor
would allow him to do so. Hiriam Martinez stated that he had gone back to Graingers and picked up the drill
at exactly 1508 hours. Hiriam Martinez knew the time was 1508 hours because that is what it said on the
receipt It should be noted that the undersigned acquired a copy of the receipt in question from Graingers and
it in fact showed a time of 1508 hours. Hiriam Martinez told the undersigned that he had left the drill locked
in the City of Hartford truck that evening. Upon returning to work on the following morning Hiriam's other
supervisor, Daniel Guertin had spoken to him. Daniel Guertin had told Hiriam Martinez that some
accusations were made against Tn'm in reference to the drill. Hiriam stated that he became nervous because he
purchased the drill without his supervisors approval. Hiriam Martinez also thought that an individual named
Elhaj El-Haji-Bey does not like him and will make things up to slander his name. Hiriam did tell the
undersigned that he heard someone said he was supposed to have been in Windsor Center at like 1520 hours.
Hiriam Martinez stated that he could have never been there because the receipt from Graingers shows 1508
hours. The undersigned did not mention anything to Hiriam Martinez about the accusations that were made or

AFFIDAVIT
The undersigned affiant, being duly sworn, deposes and says:

about the statement that David Robbin had given about the transaction with the drill. Hiriam Martinez
stated that he simply returned the drill to Graingers that morning so he wouldn't get in trouble for purchasing
it without the supervisor's approval. The undersigned also obtained a return receipt for the drill from
Graingers on the morning of August 13,2010 showing a time of 1015 hours. It should be noted that 1015
hours is after the time that David Robbin had stated he met with Hiriam Martinez on that same morning to
give the drill back to him. Hiriam continued to explain that he had explained to supervisor Daniel Guertin
that he return the drill to Graingers. Hiriam Martinez stated that his supervisor told him that it would look
suspicious to return the drill and suggested he go back to Graingers for the drill. Hiriam Martinez in fact did
return once again that afternoon to Graingers and brought the drill back to City Yard. Hiriam Martinez never
mentioned the selling of the drill to David Robbin. Hiriam Martinez swore to the truth of his statement and it
was notified by Sergeant Brandon O'brien and witnessed by the undersigned and Officer Daniel Richter.

On September 20,2010 at approximately 1310 hours the undersigned recovered the Milwaukee
Hole-Hawg Electric Drill/Case placed it in the Hartford Police Property room under receipt number
AA115980. The undersigned also traveled from Graingers in Hartford to the Windsor Center, approximately
ten miles. This distance is highway miles and took approximately eleven minutes. This time allowed for
Hiriam Martinez to have made the original purchase of the drill at 1508 hours and be in the Windsor Center
for approximately 1522 hours.

On September 28,2010 at approximately 1430 hours the undersigned spoke to both supervisors Daniel
Guertin and Genero Sepulveda at 40 Jennings Road, Hartford, Connecticut. Daniel Guertin stated he did
speak to Hiriam Martinez the morning of August 13,2010 about the incident. Daniel Guertin knew of the
accusations because the Windsor Police had come to City Yard looking for Hiriam Martinez on August 12,
2010. Daniel Guertin did in fact tell him to return to Graingers for the drill after he had returned it because it
looked suspicious. Genero Sepulveda stated that he was in the Hospital on August 12,2010 when the incident
had occurred. Genero Sepulveda is familiar with Elhaj El-Haji-Bey and had received a call from him on
August 12, 2010 at approximately 1541 hours. Genero Sepulveda stated that Elhaj El-Haji-Bey had told him
of the transaction that he had witnessed between Hiriam Martinez and David Robbin. Genero Sepulveda
showed the undersigned the incoming call from Elhaj El-Haji-Bey on his cell phone at 1541 hours. Genero
Sepulveda stated that Hiriam Martinez did not have approval to purchase any drill and was only supposed to
get quotes.
