Only hearings for Summary and Default Judgmentsmay be scheduled on the Tuesday, Wednesday andThursday dockets before Judge Daniel Monaco.These timeslots will be in 5 minute increments. (DONOT schedule any other kind of motions on thisdocket.) All motions other than MSJ and DJ will becancelled by Court Administration. No additionalmotions will be heard with the Summary/DefaultJudgments before Judge Monaco.For scheduling question please contact Nancy orDiane at (239) 252-8133 or (239) 252-8785. For anyquestions pertaining to the Judges' procedurescontact Karen at (239) 252-8119. The administrative assistant will contactthe attorney's office to schedule these hearings, soplease provide contact information. Include in thewritten request cases number and style, amount of time needed, motion description, and who theattorney is representing (plaintiff or defendant).These hearings will be scheduled by theadministrative assistant only and will be heard infront of Judge Monaco.
Emergency Hearings
must be requested in writingto Judge Daniel Monaco. Describe the nature of theemergency and estimate the hearing time needed.Do not argue your motion in the letter.
Theadministrative assistant will contact the attorney'soffice to schedule these hearings.Miscellaneous Hearing Notes:
Except for cancellations, there can be no changes,additions, swapping, or other alterations of themotion calendar. Attempts to accommodate suchrequests in the past have resulted in unnecessaryconfusion and inadequate notice of opposingcounsel.A party/attorney scheduling a hearing must
concurrently notice
the matter in conformance withthe Florida Rules of Civil Procedure and ensure timelynotice is served on all pro-se parties and counsel of record in advance of the hearing. The original noticemust be timely filed with the Clerk of Court. TheJudges' and Magistrates ask that NO courtesy copiesbe sent to their offices on foreclosure cases only.If you CANCEL a hearing, you are required to file aNotice of Cancellation. If you are cancelling yourhearing ten (10) working days before the hearingdate you can go to JACS and cancel on-line byfollowing the instructions. If you are cancelling lessthan ten (10) working days please, immediatelycancel the hearing, by FAX'ing you're a request to(239) 252-8870 attention Karen. Include the reasonfor cancelling, our case number and style with dateand time of hearing and what party you represent.You do not need to attach the Notice of Cancellation(just send the original to the Clerk of Courts).
Whencancelling hearings over 30 minutes (Special Set)you are required to write to the Court for approvalor provide written proof the Issue is Settled.
Once a motion is scheduled through JACS,subsequent motions may not be "piggybacked"using the time reserved for the first motion absentprior approval of the Court. This does not precludean independent reservation of another timeslotduring the same hearing period for a differentmotion the same case, provided the timeslot isappropriate in length of time for the motion.Generally, each attorney/party with a stake in theoutcome of a motion scheduled to be heard will beentitled to a proportionate share of the reservedhearing time.

appearance will
NOT
be permitted for any foreclosure hearing before theSenior Judge.If you need 30 minutes, ask for 30 minutes. Pleasedon't say, "Can I get in sooner if I only ask for 15minutes?" The Judge will limit the length of thehearing to the time requested. If the hearing is notfinished in time, the motion will have to berescheduled. When estimating necessary hearingtime, remember to include opposing counsel's time!

Exceptions MUST be filed with the Clerk of Courts. If an exception to the Recommendation of theMagistrate is filed, please contact the Judge's officeto schedule a hearing. A Motion for Rehearing orReconsideration must be submitted in writing. Thepresiding Judge will then decide whether to referback to Magistrate.
