To either of the Constables, of the Town of Adams in the County of Berkshire in
said Commonwealth:
Greetings:
In the name of the Commonwealth, you are hereby directed to notify and warn the
Inhabitants of the Town of Adams qualified to vote in Town affairs to meet at th
e C. T. Plunkett School Auditorium on Tuesday, the twenty-sixth day of April 201
1, at 7:00 P.M., then and there to act on the following articles, to wit.
Article 1 To see if the Town will vote to accept, acquire or take by eminent dom
ain several easements necessary for the construction and maintenance of the Ashu
willticook Rail Trail extension (from Hoosac Street to Lime Street), or take any
action in relation thereto:
A. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land from Stephentown
Management Group, Inc., at no cost to the Town, for the purpose of construction
and maintenance of the Ashuwillticook Rail Trail Extension in accordance with pl
ans entitled “Preliminary Right of Way Plans (Federal Aid Project No. 605041),” prep
ared by Massachusetts Department of Transportation, Highway Division (MassDOT),
dated February 25, 2011, under terms and conditions that the Board of Selectmen
deems in the best interest of the Town, or take any other actions in relation th
ereto.
B. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land from Shine Wire P
roducts, Inc., at no cost to the Town, for the purpose of construction and maint
enance of the Ashuwillticook Rail Trail Extension in accordance with plans entit
led “Preliminary Right of Way Plans (Federal Aid Project No. 605041),” prepared by M
assDOT, dated February 25, 2011, under terms and conditions that the Board of Se
lectmen deems in the best interest of the Town, or take any other actions in rel
ation thereto.
C. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land

from Adams Plumbing & Heating, Inc., at no cost to the Town, for the purpose of
construction and maintenance of the Ashuwillticook Rail Trail Extension in accor
dance with plans entitled “Preliminary Right of Way Plans (Federal Aid Project No.
605041),” prepared by MassDOT, dated February 25, 2011, under terms and condition
s that the Board of Selectmen deems in the best interest of the Town, or take an
y other actions in relation thereto.
D. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land from Raymond K. K
areh, at no cost to the Town, for the purpose of construction and maintenance of
the Ashuwillticook Rail Trail Extension in accordance with plans entitled “Prelim
inary Right of Way Plans (Federal Aid Project No. 605041),” prepared by MassDOT, d
ated February 25, 2011, under terms and conditions that the Board of Selectmen d
eems in the best interest of the Town, or take any other actions in relation the
reto.
E. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land from MLCC Propert
ies, LLC, at no cost to the Town, for the purpose of construction and maintenanc
e of the Ashuwillticook Rail Trail Extension in accordance with plans entitled “Pr
eliminary Right of Way Plans (Federal Aid Project No. 605041),” prepared by MassDO
T, dated February 25, 2011, under terms and conditions that the Board of Selectm
en deems in the best interest of the Town, or take any other actions in relation
thereto.
F. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land from Greylock Vie
w Industrial Complex, LLC, at no cost to the Town, for the purpose of constructi
on and maintenance of the Ashuwillticook Rail Trail Extension in accordance with
plans entitled “Preliminary Right of Way Plans (Federal Aid Project No. 605041),” p
repared by MassDOT, dated February 25, 2011, under terms and conditions that the
Board of Selectmen deems in the best interest of the Town, or take any other ac
tions in relation thereto.
G. To see if the Town will vote to authorize the Board of Selectmen to accept, a
cquire or take by eminent domain easements to a parcel of land from Berkshire Mi
lls Associates, LP, at no cost to the Town, for the purpose of construction and
maintenance of the Ashuwillticook Rail Trail Extension in accordance with plans
entitled “Preliminary Right of Way Plans (Federal Aid Project No. 605041),” prepared
by MassDOT, dated February 25, 2011, under terms and conditions that the Board
of

Selectmen deems in the best interest of the Town, or take any other actions in r
elation thereto.
H. To see if the Town will vote to authorize the Board of Selectmen to convey ea
sements to a parcel of land from the Inhabitants of the Town of Adams, at no cos
t to the Town, for the purpose of construction and maintenance of the Ashuwillti
cook Rail Trail Extension in accordance with plans entitled “Preliminary Right of
Way Plans (Federal Aid Project No. 605041),” prepared by MassDOT, dated February 2
5, 2011, under terms and conditions that the Board of Selectmen deems in the bes
t interest of the Town, or take any other actions in relation thereto.
Article 2 To see if the Town of Adams will vote to authorize the Board of Select
men to accept an easement to a parcel of land from Barry F. Sullivan and Deborah
D. Sullivan, at no cost to the Town, for the purpose of reconstructing the reta
ining wall on Enterprise Street in accordance with a plan entitled “Plan of Easeme
nt” to be granted to the Town of Adams, Massachusetts by Barry F. Sullivan and Deb
orah D. Sullivan, drawn and stamped by Hill Engineers Architects Planners, and d
ated September 17, 2010, under terms and conditions that the Board of Selectmen
deems in the best interest of the Town, or take any other action in relation the
reto.
Article 3 To see if the Town will vote to accept the provisions of Mass General
Laws Chapter 64G, Section 3A to impose a local room occupancy excise tax at a ra
te of 2%, to take effect on July 1, 2011, or to take any action in relation ther
eto.
Article 4 To transact any other business that may legally come before said meeti
ng.
