Sub: SUbmjission of relevant information as Per the Order ofthe Hon'ble CIC

This is with ference to the captioned Order wherein the Hon'ble CIC has upheld that
the terms of e Agreement between M/s Airline Allied services Ltd. (Alliance Air) and
M/s India Ce ents Ltd., Chennai to operate the Chartered Flight on 20.04.2010 falls
under the exemption of section 8(l)(d) of the RTI lid. and, therefore, the terms and
conditions of !the Agreement dated 20.04.2010 are not to be disclosed. The Hon'ble
CIC, however, has directed Alliance Air to provide to you the remaining information
including request for the operation of the Chartered Flight and all other
corresponden e between the parties (namely Alliance Air and India cements) including
date of receip of full payment and other documents/correspondence.

In compliance with the Order, it may be noted that the request for operating the charter
was received way of an e-mail dated 19.04.2010, copy whereof is being provided for
your You may kindly note that the said e-mail is sent by Mr Sundar who is a
personnel ofl the BCCI (Board for Cricket Control of India) and involved in the
organization and facilitation for the IPL T-20 Toumament. It may also be noted that the
said mail has been marked as a copy to Mr N. Kasi who is the representative of M/s
India Cements Ltd.

In this it may also be noted that any party/person seeking to avail charter
operations Air India and/or its subsidiaries, usually approaches the Commercial
Deprtment in I the Region or at the Headquarters. In the present case the request for
operation of flight was received by Commercial Department of Air India at
Mumbai and the request for the same was forwarded by the concemed department onto
Alliance Air normal procedure. Alliance Air received the e-mail of the request for the
charter after .00 p.m. on 19.04.2010. Thereafter, due to closure of Alliance Air Offices
and the paucty of time, the communications between Alliance Air and India Cements
were principa Iy coordinated over the phone and there are no other communications in
this regard tnat can be provided,

In the intera ion with India cements, it was informed that payment for the charter
along with ecution of the Charter Agreement and related documents need to be
carried prior 0 the operation of charter flight. In compliance with the same India
cements ex' uted the charter agreement and made the payment on 20.04.2010.
As stated in e order of the Hon'ble OC, Alliance Air is not required to provide you with
a copy of the Charter Agreement, however, you are informed that the said agreement
was dulv ex uted on stamp paper of appropriate value and the same was signed and
executed by r P.S. Rajan for India Cements Ltd. at Chennai.
You are requ ed to take note of the above information as well as find enclosed copy of
the relevant -mails exchanged as well as proof of receipt of payment by Alliance Air.
By providing e aforesaid information, Alliance Air hereby has complied with the Order
of the Hon'bl Oc.

ORDER
The aforementioned complaint and appeal are being disposed of together
through this one order since the 2nd appeal in case No. CIC/SS/A/2011/0001172
emanates from an earlier RTI application filed by the applicant Shri Subhash
Chandra Agrawal regarding which he has filed a complaint petition
No.CIC/SS/C/2011/000389.
In his complaint filed before the Commission, the complainant Mr.
Subhash Chandra Agrawal submits that the Respondent has only provided
partial information in compliance of CIC order dated 23.2.2011. The Respondent
vide its letter dated 22.3.2011 had informed the appellant that the chartered flight
on 20.4.2010 was operated at the request of M/s India Cements Ltd., Chennai,
but the copy of the rules permitting the authorities to accede to such a request
was not provided despite clear directions of the CIC to provide this information.
Nor did Alliance Air provide related documents/correspondence/file notings etc.
to the information seeker
The Appellant has, through RTI application dated 26.3.2011, requested
that he be provided a copy of complete documents/ correspondence/file notings
etc. dealing with request of M/s India Cements Limited, Chennai for chartered
flight operated on 20.4.2010 including a copy of the request letter of India
Cements Limited Chennai and confirmation letter from Alliance Air on the
request made by M/s India Cement Limited Chennai for the said chartered flight
as referred to in Alliance Air letter dated 22.3.2011 which was sent to the
appellant in respect to CIC verdict in order No. CIC/SS/A/2010/000931 &
CIC/SS/A/2010/000933 dated 23.2.2011 wherein it was disclosed that the
chartered flight was operated on 20.4.2010 on the request of M/s India Cement
Ltd., Chennai.
In his appeal filed before the Commission, the appellant submits that
CPIO after seeking time to respond vide his letter dated 28.4.2011, ultimately
declined the information/documents sought for as exempted u/s 8(1)(d) of RTI
Act, vide response reference No. AASL/CS/HQ/2011/215 dated 18.5.201. The
appellant submits in his appeal that section 8(1) (d) clearly stipulate that
disclosure would be made if larger public interest warrants such disclosure. In
this matter larger public interest would be served in revealing this information.
The Respondent, on the other hand, submits that a copy of the agreement
entered into between M/s Alliance Air and M/s India Cement Ltd., Chennai to
operate a charter flight on 20.4.2010 cannot be provided to the appellant since
the document contains information the revelation of which would adversely affect
their commercial confidentiality and therefore attracts the exemption provision of
section 8(1)(d) of RTI Act. They however, did inform that full payment was made
by M/s India Cement Ltd., Chennai ahead of the date of the chartered flight.
After hearing the parties, the Commission is of the view that the terms of
agreement between Alliance Air and M/s India Cement Ltd., Chennai to operate
the chartered flight on 20.4.2010 attracts the provision of Section 8(1) (d) of RTI
Act since the terms & conditions of the agreement between the parties could
affect their commercial confidentiality which in turn may affect their competitive
position. However, the Commission finds no reason to deny the rest of the
information requested for by the appellant. The Commission therefore directs the
Respondent to provide to the appellant, free of cost the request letter of M/s India
Cement Ltd. Chennai requesting for operation of the chartered flight on
20.4.2010 and all other correspondence between the two parties including the
date of receipt of full payment, and from whom received for operating the
chartered flight and complete file notings and other documents/correspondence
etc. in this regard, except the terms of agreement between the parties for
operating chartered flight on 20.4.2010. The directions of the Commission are to
be complied by the CPIO within 15 days of receipt of this order.
The Commission observes that Shri Arun K. Goyal, PIO/Company
Secretary, Alliance Air has only partly complied with the directions of the CIC
contained in order dated 23.2.2011. The CPIO is hereby directed to provide
complete information to the appellant and to show cause why a penalty of
Rs.25000/- u/s 20 of the RTI Act should not be imposed on him for causing a
delay of more than 100 days in providing the information to the appellant. A
separate Show Cause Notice will issue.
