    POTOMAC,MDMarch8,2012TheBrickyardCoalition,Inc.filedlegalnoticeswiththe MarylandStateTreasurerofpossiblemonetaryclaimsagainsttheMontgomeryCountyBoard ofEducation(BOE)inregardtotheBrickyardsite.Thenoticesstatethatthemembersofthe BrickyardCoalitionslegal,property,civil,andconstitutionalrights(bothstateandfederal) wereviolatedbytheBOEsegregiousactionsinregardtotheBrickyardschoolsite.Thisnotice isrequiredbylawifcitizenswishtosueandseekmonetarydamagesfromtheBoardof Educationoranyofitsofficials.Overfourhundredindividuals,aswellasmultiplecivic organizations,filedthenotice.Eachclaimantcouldreceiveupto$100,000. ThenoticeofclaimwasfiledoneyearaftertheBoardofEducationvotewithoutcommunity inputonMarch8,2011,toleasetheBrickyardpropertytoMontgomeryCounty.TheCounty Executivesproposedplanistoconstructacommercialsoccercomplexcontaininguptofour soccerfields,parkinglotsforalmost300carsandfacilitiessuchasconcessionsandrestrooms, onthispubliclandforprivateuse.Thissoccercomplexwilloverwhelmandcausenegative repercussionstotheresidentialneighborhoodsonBrickyardRoadaswellasthesurrounding roadsandcommunities. TheBrickyardCoalitionbelievestheproposalviolatesthePotomacMasterPlanandwillcreate serioustraffic,safetyandenvironmentalproblemsinthearea.Yearsofcareful,patient, inclusiveandtransparentplanningthatallowedMontgomeryCountyto developzoningregulationsandguidelineswithinthemandateofthewellthoughtoutMaster PlanwillhavebeenbothwastedandflauntediftheCountyExecutiveisallowedtoproceedin thismanner.TheMasterPlanwascraftedwithessentialcommunityinputMontgomery Countywaspreviouslyrenownfor. TheBrickyardcommunityhasbeenorganizinginoppositiontoMr.Leggettsproposalsinceit firstdiscoveredthattheCountyExecutivehasbeensecretlyplanningsinceNovemberof2009 todeliver20acresofpubliclandonBrickyardRoadinPotomactoaprivatecorporationfor development.Ifthisispermittedtohappen,itwillsetaterribleprecedentandnocommunity withinMontgomeryCountywillbesafefromsuchschemes,secretplanningandprivate developmentonpublicland.

    TheBoardofEducationhastwicebeenfoundtohaveviolatedtheOpenMeetingActinregard totheBrickyardsite.Specifically,theBOEtwiceexcludedthepublicfromdiscussionofitsplans tolease,withoutcompetitivebid,thispubliclandtotheCountyExecutivewhenthelaw requiredittopubliclydiscusssuchplans. TheBrickyardCoalitionisanumbrellaorganizationofcivicgroupsandprivatecitizensjoinedin oppositiontotheproposedsoccercomplexinourpeaceful,residentialneighborhood. ParticipatingorganizationsincludetheWestMontgomeryCountyCitizensAssociation (WMCCA);theCivicAssociationofRiverFalls(CARF);andtheBrickyardRoadCitizens Association. *End*
