POTOMAC,!MD!!March!21,!2012!!A!coalition!of!concerned!Montgomery!County!citizens!today! filed!a!Maryland!Public!Information!Complaint!(MPIA)!for!injunctive!and!declaratory!relief! against!Montgomery!County!and!the!Montgomery!County!Department!of!General!Services! (DGS).!!County!Executive!Ike!Leggett!and!David!Dise,!the!Director!of!DGS,!are!in!violation!of!the! MPIA,!and!the!Plaintiffs!are!demanding!that!they!comply!with!the!Maryland!law!in!making! records!available!to!the!public.!The!full!MPIA!complaint!is!attached.!! The!lawsuit!is!an!action!to!compel!the!production!of!records!willfully!and!wrongfully!withheld! in!regard!to!the!Plaintiffs!MPIA!request!for!documents!submitted!on!November!9,!2011.!! Maryland!law!requires!a!response!within!30!days.!!The!complaint!also!alleges!that!the! Defendants!have!claimed!some!documents!as!privileged!that!are!not!in!fact!privileged!and! therefore!should!be!provided!to!the!Plaintiffs.! ! Ike!Leggett!and!David!Dise!have!been!stonewalling!the!public!regarding!plans!made!in!secret!to! build!a!commercial!sports!complex!on!the!residential!Brickyard!site.!!The!Plaintiffs!made!more! that!five!follow!up!requests!for!documents!which!were!not!produced!by!the!County.!!The! lawsuit!seeks!to!compel!the!production!of!these!records!on!matters!of!vital!public!concern,! namely,!records!from!January!1,!2007!to!the!present!that!relate!to!the!use!a!20"acre!parcel!of! land!in!their!neighborhood!identified!as!the!Brickyard!Middle!School!Site!on!Brickyard!Road,! Potomac,!Maryland.!!The!complaint!also!seeks!to!compel!the!release!of!records!related!to!MSI! and!its!directors,!officers,!staff,!and!Jerry!Pasternak,!a!well"connected!lobbyist!hired!by!MSI.! ! The!plaintiffs!in!this!action!consist!of!several!non"profit!citizens!organizations,!including!the! West!Montgomery!County!Citizens!Association,!the!Civic!Association!of!River!Falls,!Inc.!and!the! Brickyard!Coalition.! ! *End*!
