12-04-22 Invalid electronic records of the Detainees Courts of the State of Israel
The invalid electronic records of the Detainees Courts reflect the failure to establish adequate policies, laws
and regulations, and disregard for due process and human dignity, relative to some of the most vulnerable
People in the State of Israel.
A Sudanese, tortured in the Sinai Desert (Egypt). Africans risk their lives, crossing the Sinai Desert on their way to the Israeli border. A border fence is
under construction to prevent illegal entry. Almost 3,000 Africans are detained in the desert facility of Saharonim (Israel) alone. Charity Passover dinner
for Africans in southern Tel Aviv, where most of them congregate. By some estimates, their number will soon reach 100,000.

The Detainees Courts are managed as administrative courts under the Ministry of Justice for adjudication of the cases of
individuals, who unlawfully entered the State of Israel. The Courts have grown in significance with the swelling number
of illegal immigrants from the ongoing crises in Sudan and elsewhere. Some, including families with children, are held for
long periods in detention camps under harsh conditions.
The published electronic records of the Detainees Courts are invalid on their faces:
As is the case in other courts of the State of Israel, the identity of the server, on which the records are published,
is not certified, and the Ministry of Justice would not disclose under whose administrative authority it is held.
The records are published as insecure Word files, unsigned, and with no detainees names on the records.
For many of the Detainee Numbers no decisions exist in the database at all.
The Detainee Numbers are not correlated with the dates of the decisions, and discontinuities appear in the
Detainee Numbers of the decisions that are published online.
Most of the electronic records were created much later than the respective proceedings dates.
The records do not provide any evidence of functional offices of clerks in the Detainees Courts.
The Procedures of the Detainees Courts, published online by the Ministry of Justice, should be deemed a
simulated legal record with neither legal authority, nor validity.
The Ministry of Justice provided false and deliberately misleading information in response on Freedom of
Information requests regarding the number, names, and locations of the Detainees Courts, raising concerns that
black hole prisons with makeshift field courts have been established.
The vast majority of the decisions fail to refer to any law or regulation of the State of Israel. At least some of the
decisions, setting geographic restrictions on the residence and workplace of Detainees appear arbitrary and
capricious.
The invalid electronic records of the Detainees Courts reflect the failure to establish adequate policies, laws and
regulations, and disregard for due process and human dignity, pertaining to some of the most vulnerable People in
Israel. With it, the publication of selective, invalid records, appears as an attempt to cover it up.
The lack of integrity of the electronic records of the Detainees Courts is part of a pattern of invalid electronic record
systems, implemented over the past decade in the national courts of the State of Israel.
The survey of the electronic records of the Detainees Courts was produced by Human Rights Alert (NGO), as part of
submission for the 2012 Universal Periodic Review (UPR) of Human Rights in Israel by the Human Rights Council of the
United Nations. The 2012 Human Rights Alert submission is narrowly focused on Integrity, or lack thereof, of the
electronic records of the courts of the State of Israel.

The Detainees Courts are managed as administrative courts under
the Ministry of Justice, for adjudication of the cases of individuals,
who unlawfully entered the State of Israel. The Courts have
grown in significance with the increasing flow of illegal
immigrants from the ongoing crises in Sudan and elsewhere.
Some are held for years in detention camps.
Survey of electronic records shows:
Dramatic increase in the number of Detainees records over the

past decade, particularly from Sudan, which may reflect the increase in the number of Detainees held in
the State of Israel over the past decade. (Tables 1, 2)
As is the case in other courts of the State of Israel, the identity of the server(s), on which the records are
published, is not certified, and the Ministry of Justice would not disclose, under whose administrative
authority it is held. [iv]
The records are published as insecure, unsigned Word files. No visible electronic signatures, pursuant to
the Electronic Signature Act (2001) have been implemented in the system.
The records fail to include the Detainees names.
The online database is not composed of complete court files with adequate dockets, only as assorted
decisions. For many, or most of the Detainees Numbers there are no decisions in the database at all. The
online database explicitly states:
It should be emphasized that the decisions published herein, are only part of the total decisions of the
Detainees Courts. From time to time new decisions are added. We strive to update the database so
that it would include up-to-date decisions. (Screen Print 1)
It remains unclear, on what basis the records were selected, which are published, and why other records
remain unpublished.
The Detainee Numbers are not correlated with the dates of the decisions, and discontinuities appear in the
Detainee Numbers of decisions that are published online. The failure to assign continuous Detainee
Numbers in an orderly fashion, should be deemed a key failure in integrity of the electronic records
system of the Detainees Courts. It enables the secret imprisonment of individuals, be it illegal immigrants
or others. (Chart 1, Table 3)
Most of the electronic records were created (based on the Word-file Properties data) a long time (at times
years) after the respective proceedings dates, as indicated in the bodies of the records. (Table 3)
The District Courts of the State of Israel have repeatedly criticized the lack of due process in operation of
the Detainees Courts, and have pointed out the key deficiency in the failure to establish offices of clerks in
the Detainees Courts. [i, ii, iii] However, the online database provides no evidence that functional offices
of clerks have been established in the Detainees Courts to this date. The Ministry of Justice refuses to
respond on a Freedom of Information request, pertaining to the identity of the clerks of the Detainees
Courts. [iv]
The Detainees Courts operate with no valid regulations. The Procedures of the Detainees Courts,
published online by the Ministry of Justice, should be deemed a simulated legal record with neither legal
authority, nor validity. [v]
The introduction to the Procedures explicitly states:
Along the years, various questions came up, in the course of the work of the Administrative Courts,
regarding the procedures and conduct of the Courts. In such framework, the idea was raised of
creating an internal assembly of core procedures, pertaining to the conduct of the Courts.

The above referenced is only a preliminary assembly is not comprehensive the full procedures,
pertaining to the conduct of the Courts. [emphasis in the original jz] We hope that the assembly
will lead to the establishment of additional procedures, particularly those that pertain to conduct of the
Courts in conjunction with related bodies.
The online publication of the Procedures, is part of a pattern of online publication of simulated, illegal
public records by the courts and the Ministry of Justice, including but not limited to the Guidelines of the
Supreme Court [vi] and the Apostille Certification procedure. [vii]
In response on Freedom of Information request, regarding the number, names, and locations of the
Detainees Courts, the Ministry of Justice provided false information only the names of two Detainees
courts. [viii] The electronic Detainees Courts records and attorneys web sites reveal additional locations,
where proceedings are held. (Table 3) [ix] Regardless, the Ministry of Justice refused to correct the false
information it had provided. [viii] The failure to disclose the number and locations of such courts, and the
invalid Detainee Numbers should raise concerns that black hole prisons with makeshift field courts
have been established. [x]
At times the Detainee is held in one part of the country, while proceedings in his/her regard are held in
absentia in another part of the country, with no stated explanation at all. (Table 3)
The vast majority of the decisions fail to refer to any law or regulation of the State of Israel as the legal
foundation of the decisions. At least in some cases, the residence and workplace of the Detainees are
restricted to specific geographic regions, in a manner that appears arbitrary and capricious. (Table 3,
Detainees Electronic Records, No 500, 63017)
In 2011, Haaretz daily reported a case of simulated proceeding and the entry of a simulated deportation
order in one of the Detainees Courts. [xi, xii] The response by the Spokesperson for the Ministry of
Justice was alarming, describing the report as a tempest in a teapot.
Some of the Detainees, including children, are held for months or even a year or two under harsh
conditions in detention camps in the Negev desert, in what may be a mixture of bureaucratic inefficiency
and deliberate punitive measure. [xiii] (Table 3, Detainees Electronic Records, No 85245)
The introduction page to the online electronic records of the Detainees Courts states: (Screen Print #1)
We see the publication of the decisions, a publication that enhances the right of the public to be
informed and the transparency. In addition, it would assist those engaged in the field or interested in it,
in learning regarding rulings of the Detainees Courts on subjects related to detention of those staying
illegally in the State of Israel.
A system, where the Ministry of Justice refuses to disclose how many Detainees Courts are operating in Israel
and their locations, and provides false and deliberately information in response to Freedom of Information
request on the matter, and where the Detainees Courts publish simulated Procedures, employ a deceptive
Detainee numbering system, and publish selective decisions as anonymous, insecure, unsigned electronic
records, which are at times generated years after the fact, is not a system that enhances the right of the public
to be informed and transparency.
The lack of integrity of the electronic records of the Detainees Courts is part of a pattern of invalid electronic
record systems, which have been implemented over the past decade in the national courts of the State of
Israel. [xiv]
