In Re: CYRUS, J. Request to Visit Franklin Barbecue


Delivered July 24, 2012 Syllabus CHIEF JUSTICE VILLALOBOS delivered the opinion of the Court. CHIEF JUSTICE VILLALOBOS announced the judgment of the Court and delivered the opinion of the court with respect to Parts I and II in which WISEMAN, and CYRUS, JJ., joined. I. Facts VILLALOBOS, C.J, WISEMAN, J., and CYRUS, J., and. have been, since the last conference at Hopdoddy's Burgers, trying to schedule a second conference. Due to the circumstances in each of the Justices lives, all three men have tried but not succeed in their endeavor. WISEMAN, J. takes classes, VILLALOBOS, C.J. has an internship, and CYRUS, J. plays on his iPad. To this day the three gentlemen have not met though there is no lack of trying on the part of each. On July 24, CYRUS, J. sent correspondence to VILLALOBOS, C.J. to set a "meeting in stone" on a time when we shall be, "ensure[d] we are served, whether we will have brisket or ribs, and which flavors of barbecue sauce shall grace our plates of meat." II. Time In order to answer the correspondence, we shall look at the questions in order. First, we answer the question of time.

Franklin Barbecue is a city wide renowned place to feast on BBQ. On weekends they are busier than on weekdays, but busy is a relative term here since being slow on a business day at Franklin Barbecue is being busy at any other food establishment. Moreover, Franklin opens at 11am Tuesday Sunday and runs out of food by 12pm. It is has been known that even those who wait in line and are towards the end only get limited options. With everything understood above and due to previous scheduling conflicts, it my opinion that we shall meet on Sunday July 29th at 9am on the porch of Franklin Barbecue. Due to fact that the last two questions are moot if the three gentlemen do not follow through with their scheduled time, it is the opinion of this Justice that this Court not need answer those questions at the present time. "Our consideration is limited to the present circumstances." Bush v. Gore, 531 U.S. 98 (2000). It is so ordered.
