PENJELASAN ATAS PERATURAN PEMERINTAH REPUBLIK INDONESIA NOMOR 41 TAHUN 2004 TENTANG TATA CARA PENGANGKATAN DAN PEMBERHENTIAN HAKIM AD-HOC PENGADILAN HUBUNGAN INDUSTRIAL DAN HAKIM AD-HOC PADA MAHKAMAH AGUNG

PRESIDEN REPUBLIK INDONESIA, Menimbang : a. Bahwa dalam rangka melaksanakan ketentuan Pasal 72 Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial, maka perlu ditetapkan Peraturan Pemerintah tentang Tata Cara Pengangkatan dan Pemberhentian Hakim Ad-Hoc Pengadilan Hubungan Industrial dan Hakim Ad-Hoc pada Mahkamah Agung; Mengingat : 1. Pasal 5 ayat (2) Undang-Undang Dasar 1945; 2. Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial (Lembaran Negara Tahun 2004 Nomor 6, Tambahan Lembaran Negara Nomor 4356).
I. UMUM Perubahan Undang-Undang Dasar 1945 telah membawa perubahan dalam kehidupan ketenagakerjaan khususnya dalam pelaksanaan kekuasaan kehakiman. Berdasarkan perubahan tensebut ditegaskan bahwa kekuasaan kehakiman dilaksanakan oleh Mahkamah Agung dan badan peradilan yang berada di bawahnya yaitu Lingkungan Peradilan Umum, Lingkungan Peradilan Agama, Lingkungan Peradilan Militer, Lingkungan Peradilan Tata Usaha Negara, dan Mahkarnah Konstitusi. Dalam Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial mengatur penyelesaian perselisihan hubungan industrial melalui pengadilan dan di luar pengadilan. Penyelesaian Penselisihan di luar pengadilan dilakukan melalui penyelesaian bipartit, mediasi, konsiliasi dan arbitrase. Penyelesaian penselisihan melalui pengadilan berdasarkan undang-undang ini dilakukan melalui Pengadilan Hubungan Industrial yang merupakan pengadilan khusus yang berada pada lingkungan peradilan umum. Hakim Ad-Hoc yang diatur dalam Undang-undang Nomor 2 Tahun 2004

Menetapkan : PERATURAN PEMERINTAH TENTANG TATA CARA PENGANGKATAN DAN PEMBERHENTIAN HAKIM ADHOC PENGADILAN HUBUNGAN INDUSTRIAL DAN HAKIM AD-HOC PADA MAHKAMAH AGUNG

mempunyai kekhususan dibandingkan dengan Hakim Ad-Hoc pada pengadilan lainnya. Hakim Ad-Hoc Pengadilan Hubungan Industrial dan Hakim Ad-Hoc pada Mahkamah Agung bersifat permanen karena setiap perkara perselisihan hubungan industrial penyelesaiannya selalu dilakukan oleh majelis hakim dengan komposisi hakim karier sebagai Ketua Majelis dan 2 (dua) orang Hakim AdHoc masing--masing sebagai anggota Majelis Hakim. Meskipun pengangkatan Hakim Ad-Hoc diusulkan oleh serikat pekerja/serikat buruh dan organisasi pengusaha namun dalam persidangan harus bersikap netral dan tidak berpihak pada organisasi yang mengusulkan. Dalam melaksanakan tugasnya Hakim AdHoc berada dalam pembinaan Mahkamah Agung baik mengenai teknis yudisial maupun organisasi, administrasi dan finansial. Peraturan Pemenintah ini mengatur tentang tata cara pengangkatan dan pemberhentian Hakim Ad-Hoc Pengadilan Hubungan Industrial dan Hakim Ad-Hoc pada Mahkamah Agung. Sedangkan tentang tata cara pengangkatan Hakim Karier karena sudah diatur dalam peraturan perundangundangan lain, tidak diatur lagi dalam Peraturan Pemenintah ini.

1. Calon Hakim Ad Hoc dari unsur pekerja/buruh diusulkan oleh Serikat pekerja yang tercatat pada instansi yang bertanggung jawab di bidang ketenagakerjaan dan calon Hakim Ad Hoc dari unsur pengusaha kepada Menteri. 2. Pengusulan calon Hakim Ad Hoc Pengadilan Hubungan Industrial di usulkan oleh Serikat/Serikat buruh dan organisasi pengusaha sebagaiman dimaksud dalam ayat (1) dilakukan di lakukan oleh serikat pekerja/serikat buruh dan organisasi pengusaha setempat kepada Menteri. 3. Pengusulan calon Hakim Ad Hoc pada Mahkamah Agung di ajukan oleh serikat pekerja/serikat buruh dan organisasi pengusaha tingkat nasional kepada Menteri. 4. Menteri melakukan seleksi administrative serta menetapkan daftar nominasi calon Hakim Ad Hoc untuk di usulkan sebagai mana yang di maksud pada ayat (1). 5. Penetapan daftar nominasi calon Hakim Ad Hoc dilakukan secara tertulis. 6. Ketentuan mengenai seleksi administrative, tata cara pelaksanaan tes tertulis dan penetapan daftar nominasi sebagaimana dimksud dalam ayat (1) dan ayat (5) diatur dengan keputusan Menteri.

PASAL 3
Ayat (2) Yang dimaksud dengan kata setempat dalam ayat ini adalah calon Hakim Ad-Hoc Pengadilan Hubungan Industrial diusulkan oleh serikat pekerja/serikat buruh atau organisasi pengusaha tingkat propinsi yang wilayah kerjanya meliputi daerah hukum Pengadilan Hubungan Industrial pada Pengadilan Negeri yang bersangkutan. Sedangkan untuk calon Hakim Ad-Hoc Pengadilan Hubungan Industrial pada Pengadilan Negeri yang daerah hukumnya meliputi Kabupaten/Kota, diusulkan oleh serikat pekerja/serikat buruh atau organisasi pengusaha di Kabupaten/Kota yang wilayahnya kerjanya meliputi daerah hukum Pengadilan Hubungan Industrial pada Pengadilan Negeri Kabupaten/Kota yang bersangkutan. PASAL 4
1. Daftar penetapan nominasi sebagaimana dimaksud dalam pasal 3 ayat (4), disampaikan oleh Menteri kepada ketua Mahkamah Agung. 1. Ketua Mahkamah Agung setelah menerima daftar penetapan nominasi sebagaimana di maksud dalam ayat (1), melakukan seleksi kopetensi melalui penyelenggaraan pendidikan dan pelatihan calon Hakim Ad Hoc sesuai kebutuhan. 2. Calon Hakim Ad Hoc yang telah dinyatakan lulus pendidikan dan pelatihan sebagaimana dimaksud ayat (2) diusulkan oleh Ketua Mahkamah Agung kepada Presiden untuk di angkat menjadi Hakim Ad Hoc sesuai dengan formasi yang tersedia.

PASAL 4
Ayat (2) Yang dimaksud dengan sesuai kebutuhan dalam ayat ini adalah sejumlah calon Hakim Ad-Hoc yang dipanggil mengikuti seleksi kompetensi dengan mempertimbangkan formasi yang tersedia. Ayat (3) Yang dimaksud dengan formasi dalam ayat ini adalah sejumlah Hakim Ad-Hoc yang diperlukan pada Pengadilan Hubungan Industrial dan pada Mahkamah Agung sesuai kebutuhan. Pengangkatan Hakim Ad-Hoc dilakukan dengan memperhatikan keseimbangan jumlah Hakim Ad-Hoc dan unsur serikat pekerja/serikat buruh dan organisasi pengusaha.
PASAL 5
1. Ketua Mahkamah Agung menetapkan penetapan Hakim Ad Hoc dalam daerah hukum pengadilan Hubungan Industrial di tempat Hakim Ad Hoc yang bersangkutan diusulkan oleh organisasinya. 2. dalam hal penempatan Hakim Ad Hoc sebagaimana dimaksud dalam ayat (1) tidak dapat di laksanakan, maka Ketua Mahkamah Agung dapat menempatkan Hakim AD Hoc dari daerah lain.

PASAL 5
Ayat (2) Penempatan Hakim Ad-Hoc dan daerah lain dimaksudkan untuk mencukupi kekurangan atau untuk mengisi kekosongan Hakim Ad-Hoc pada Pengadilan Hubungan Industrial, dalam hal Hakim Ad-Hoc yang diusulkan dari daerah setempat belum mencukupi atau tidak lulus mengikuti seleksi kompetensi.

a. meninggal dunia; b. permintaan sendiri; c. sakit jasmani atau rohani terus menerus selama 12 (dua belas) bulan; d. telah berumur 62 (enam puluh dua) tahun bagi Hakim ad hoc pengadilan hubungan industrial dan telah berumur 67 (enam puluh tujuh) tahun bagi hakim ad hoc pada mahkamah agung; e. tidak cakap dalam melaksanakan tugas; f. atas permintaan organisasi pengusaha atau organisasi pekerja/organisasi buruh yang mengusulkan ; atau g. telah selesai masa tugasnya. 2. Pemberhentian dengan hormat sebagaimana dimaksud dalam ayat (1) diusulkan kepada Presiden oleh Ketua Mahkamah Agung.

1. Hakim Ad Hoc diberi kesempatan untuk membela diri dalam tenggang waktu 30 (tiga Puluh) hari kerja setelah diterimanya pemberitahuan hasilpemeriksaan sebagai mana dimaksud dalam pasal 7 ayat (3).

2. Pembelaan diri sebagaimana dimaksud dalam ayat (1) dilakukan di depan: a. Majlis Kehormatan Hakim bagi Hakim Ad Hoc Pengadilan Hubungan Industrial; dan b. Majlis Kehormatan Mahkamah Agung bagi Hakim Ad Hoc pada Mahkamah Agung.

Dalam hal alasan sebagaimana dimaksud dalam pasal 7 ayat (1) tidak terbukti, maka dilakukan pencabutan pemberhentian sementara sebagaimana dimaksud dalam pasal (9) ayat (1) dari jabatan Hakim Ad-Hoc dan hak-haknya dikembalikan seperti semula.
PASAL 10 Yang dimaksud dalam hak-haknya dikembalikan seperti semula adalah meliputi pengembalian uang kehormatan dan hak-hak lainnya sesuai ketentuan peraturan perundangundangan yang berlaku terhitung sejak dikenakan pemberhentian sementara sebagai Hakim Ad-Hoc.

PASAL 11
1. Majelis Kehormatan Hakim atau Majelis Kehormatan Mahkamah Agung memberikan pertimbangan, pendapat dan saran kepada Ketua Pengadilan Negeri atau Ketua Mahkamah Agung atas pembelaan diri Hakim Ad-Hoc sebagaimana dimaksud dalam pasal 8 ayat (2). 2. Pertimbangan, pendapat dan saran sebagaimana dimaksud dalam ayat (1) disampaikan oleh Majelis Kehormatan dalam tenggang waktu paling lama 30 (tiga puluh) hari kerja setelah diterimanya pembelaan diri Hakim Ad-Hoc yang bersangkutan. 3. Dalam hal Majelis Kehormatan memandang perlu adanya penjelasan tambahan atas keterangan yang dituangkan dalam pembelaan diri Hkim Ad-Hoc maka tenggang waktu sebagaimana dimaksud dalam ayat (2) dapat diperpanjang untuk paling lama 30 (tiga puluh) hari kerja.

Setelah menerima Keputusan Presiden tentang pemberhentian sementara atau pemberhentian dengan hormat atau pemberhentian tidak dengan hormat sebagai Hakim Ad-Hoc sebagaimana dimaksud dalam Pasal 6 atau Pasal 7 atau Pasal 9, Ketua Makhkamah Agung memberitahukan kepada Hakim AdHoc yang bersangkutan.

ELUCIDATION ON GOVERNMENT REGULATION OF THE REPUBLIC OF INDONESIA NUMBER 41 OF 2004 CONCERNING PROCEDURES OF THE APPOINTMENT AND DISMISSAL OF AD-HOC JUDGES OF THE INDUSTRIAL RELATIONS COURT AND AD-HOC JUDGES OF THE SUPREME COURT
GOVERNMENT REGULATION OF THE REPUBLIC OF INDONESIA NUMBER 41 OF 2004 CONCERNING PROCEDURES OF APPOINTMENT AND DISMISSAL OF AD-HOC JUDGES OF INDUSTRIAL RELATIONS COURT AND AD-HOC JUDGES OF THE SUPREME COURT
PRESIDENT OF THE REPUBLIC OF INDONESIA, Considering : a. That, in order to implement Article 72 of Act Number 2 of 2004 concerning Dispute Settlement of Industrial Relations, it is necessary to stipulate a Government Regulation concerning Procedures of Appointment and Dismissal of AdHoc Judges of Industrial Relations Court and Ad-Hoc Judges of the Supreme Court; In view of : 1. Article 5 subsection (2) of the 1945 Constitution of the Republic of Indonesia; 2. Act Number 2 of 2004 on Dispute Settlement of Industrial Relations (State Gazette of the Republic of Indonesia of 2004 Number 6, Supplement to the State Gazette of the Republic of Indonesia Number 4356);
I. GENERAL Amendment to the 1945 constitution has entailed to the change in manpower matters particularly in the implementation of judicial power. Based on the amendment, it has been affirmed that the judicial power shall be exercised by the Supreme Court and judicial bodies under its supervision, namely General Courts, Religious Courts, Military Courts, State Administrative Courts, and Constitution Court of Justice. Act Number 2 of 2002 concerning Dispute Settlement of Industrial Relations regulates settlement of industrial relations disputes inside and outside of the court. Settlement of dispute outside the court is conducted through the settlement of bipartite, mediation, conciliation and arbitration. The dispute settlement inside the court based on this act is conducted through Industrial Relations Court that constitutes a special court under aegis of the district court. Ad-Hoc Judges as provided in the Act No. 2 of 2004 has specialty in comparison to the Ad-Hoc Judges in other courts. The AdHoc Judges in the Industrial Relations Court and Ad-Hoc Judges in the Supreme Court are permanent in nature because every case of

To Stipulate : GOVERNMENT REGULATION CONCERNING PROCEDURES OF APPOINTMENT AND DISMISSAL OF AD-HOC JUDGES OF INDUSTRIAL RELATIONS COURT AND AD-HOC JUDGES OF THE SUPREME COURT
industrial relation dispute is always settled by a Tribunal of judges composed of a career judge as the Chief Judge and 2 (two) Ad-Hoc Judges each as member of the Tribunal of Judges. Even though the appointment of Ad-Hoc Judges is proposed by the trade union/labour union and employer organization, however, in courts sessions they must be neutral and impartial to the proposing organization. In performing their duties, Ad-Hoc Judges are under supervision of the Supreme Court, regarding with both judicial techniques, organization, administration and financial. This Government Regulation provides procedures of appointment and dismissal of AdHoc Judges of the Industrial Relations Court and Ad-Hoc Judges of the Supreme Court. Whereas, procedures of appointment of Career Judges, since regulated yet in other statutory regulations, are not anymore provided for in this Government Regulation.

ARTICLE 3
(1) Ad-Hoc Judge Candidate from employee/labour element is proposed by trade union/labour union that is registered with the authority in charge of manpower, and Ad-Hoc Judge candidate from employer element is proposed by employer organization to the Minister. (2) The proposal Industrial Relations Court Ad-Hoc Judge candidate by trade union/labour union and employer organization as contemplated in subsection (1), is conducted by the local trade union/labour union and employer organization to the Minister. (3) Ad-Hoc Judge candidate of the Supreme Court is proposed by trade union/labour union and employer organization at national level to the Minister. (4) The Minister conducts administrative selection and determines the list of Ad-Hoc Judge nominees for proposal as contemplated in subsection (1). (5) The list of Ad-Hoc Judge nominees is determined based on written test. (6) Provisions of administrative selection, procedures of written test and determination of the list of nominees as purported in subsections (4) and (5) above are regulated by Ministerial Decree.
ARTICLE 3 Subsection (1) Sufficiently clear Subsection (2) In this subsection, local terminology shall mean that the Ad-Hoc Judge candidate of the Industrial Relations Court is proposed by trade union/labour union and employer organization at provincial level whose work territory covers jurisdiction of the Industrial Relations Court in the relevant District Court. Whereas, for the Ad-Hoc Judge candidate of the Industrial Relations Court in the District Court covering jurisdiction of regencies/Municipalities, is proposed by trade union/labour union and employer organization in the Regency/Municipality whose territory covers jurisdiction of the Industrial Relation Court in the District Court of relevant Regency / Municipality. (1) List of nominees as contemplated in Article 3 subsection (4), is submitted by the Minister to the Chairman of Supreme Court.

(2) The Chairman of Supreme Court, after receiving the list of nominees as contemplated in subsection (1), conducts a competency based selection through the implementation of education and training for Ad Hoc Judge candidates as necessary. (3) The Ad-Hoc Judge candidates who have passed the education and training as contemplated in subsection (2) are proposed by the Chairman of Supreme Court to the President for his/ her appointment to be Ad-Hoc Judges pursuant to the available formation.
Subsection (2) In this subsection, as necessary shall mean a number of Ad-Hoc Judge candidates who are called to join in the competency based selection in consideration to the available formation. Subsection (3) In this subsection, formation terminology shall mean a number of Ad-Hoc Judges required by the Industrial Relations Court and the Supreme Court according to the need. Appointment of Ad-Hoc Judges is conducted in consideration to the balanced number of Ad-Hoc Judges from trade union / labour union element and employer organization element. ARTICLE 5 Subsection (1) Sufficiently clear Subsection (2) Placement of Ad-Hoc Judge from another region would aimed at fulfiling shortage or at filling-in vacancy of Ad-Hoc Judge at the Industrial Relations Court, in case the proposed Ad-Hoc Judge from local region were insufficient or not passed the competency selection.
ARTICLE 5
(1) The Chairman of Supreme Court determines the placement of Ad Hoc Judges in the Industrial Relations Court jurisdiction according to the place where the Ad Hoc Judge had been proposed by his/her organization. (2) In case the placement of Ad-Hoc Judge as contemplated in subsection (1) were impracticable, then the Chairman of Supreme Court would place an Ad-Hoc Judge from another region.
CHAPTER III AD-HOC JUDGE DISMISSAL FIRST PART HONOURABLY DISMISSAL ARTICLE 6
(1) Ad-Hoc Judges of the Industrial Relations Court and AdHoc Judges of the Supreme Court shall be honourably dismissed from his/her position due to: a. pass-away; b. on his/her own-request; c. physical or mental disease for 12 (twelve) months consecutively; d. reach to 62 (sixty two) years old for Ad-Hoc Judge in the Industrial Relations Court and 67 (sixty seven) years

old for Ad-Hoc Judge in the Supreme Court; incapable of performing tasks; upon request of the proposing employer organization or employee organization/labour organization; or g. his/her term of position ends. (2) The honourably dismissal as contemplated in subsection (1) is proposed to the President by the Chairman of Supreme Court. e. f.
ARTICLE 8
(1) The Ad-Hoc Judge is given with opportunity to defend him/ herself within 30 (thirty) working days as of his/her receipt of notice of hearing results as contemplated in Article 7. (2) The defence as purported in subsection (1) shall be conducted before: a. The Honourable Tribunal of Ad-Hoc Judges of the Industrial Relations Court; and b. The Honourable Supreme Court Tribunal of Judges for an Ad-Hoc Judge of the Supreme Court

ARTICLE 10
In case the reasons as contemplated in Article 7 subsection (1) were not evidenced, then the suspension of his/her position as Ad-Hoc Judge, as contemplated in Article 9 subsection (1), would be revoked and his/her rights shall be resumed.
ARTICLE 10 The terminology of his/her rights shall be resumed means that it shall include resumption of rewards and other rights in accordance with the prevailing statutory regulations effective as of the commencement of suspension of Ad-Hoc Judge. ARTICLE 11 Sufficiently clear
ARTICLE 11
(1) The Honourable Tribunal of Judges or the Honourable Supreme Court Tribunal of Judges gives the Chairman of the District Court or the Chairman of Supreme Court recommendations, opinions and advices on defence of the Ad-Hoc Judge as contemplated in Article 8 subsection (2). (2) The recommendations, opinions and advices as purported in subsection (1) shall be submitted by the Honourable Tribunal within 30 (thirty) working days as of its document acceptance of defending issues of the captioned Ad-Hoc Judge.

(3) In case the Honourable Tribunal considered necessary to hear additional explanation on information contained in the document of defending issues of the Ad-Hoc Judge, then the period as purported in subsection (2) might be extended for at the latest 30 (thirty) working days.
ARTICLE 13
After receipt of the Presidential Decision concerning the suspension or honourably dismissal or dishonourably dismissal as the Ad-Hoc Judges oas meant in Article 6 or Article 7 or Article 9, The Chairman of Supreme Court Shall notify the relevant AdHoc Judge.
