OU UTILIZAR. No deve utilizar nem carregar este software e qualquer outro tipo de material ass ociado (colectivamente designado por "Software") antes de ler cuidadosamente os seguintes termos e condies. Ao carregar ou utilizar o Software, est a concordar com os termos deste contrato. Se no concordar com os termos deste contrato, no deve i nstalar nem utilizar o Software. Tambm deve ter em conta o seguinte: * Se for um fabricante original de equipamento (OEM), um fornecedor independente de hardware (IHV) ou um fornecedor independente de software (ISV), este CONTRAT O DE LICENA aplica-se na totalidade; * Se for um utilizador final, s se aplica o Anexo A, o CONTRATO DE LICENA DE SOFTW ARE DA INTEL. Para os OEM, IHV e ISV: LICENA. Este Software est licenciado para ser utilizado apenas com produtos de com ponentes da Intel. A utilizao do Software com produtos de componentes que no sejam da Intel no se encontra licenciada neste contrato. De acordo com os termos deste contrato, a Intel concede-lhe uma licena a nvel internacional, no exclusiva, intran smissvel, totalmente paga, em conformidade com os direitos de autor da Intel para : a) utilizar, modificar e copiar o Software internamente para fins de pro gramao e manuteno; e b) modificar, copiar e distribuir o Software, incluindo trabalhos result antes do Software, aos seus utilizadores finais, mas s em conformidade com um con trato de licena cujos termos sejam, pelo menos, to restritivos quanto os termos co ntidos no contrato de licena de utilizador nico, final da Intel, includo como Anexo A; e c) modificar, copiar e distribuir aos utilizadores finais a documentao for necida com o Software, mas apenas a que estiver relacionada com o Software. Se no for o fabricante ou fornecedor final de um sistema informtico ou de um progr ama de software que inclua o Software, pode transferir uma cpia do Software, incl uindo trabalhos resultantes do Software (e a documentao para utilizadores finais r elativa a este software), para o seu destinatrio, de forma a que ele possa utiliz ar o Software de acordo com os termos deste contrato, desde que esse destinatrio fique vinculado aos termos referidos no presente documento. Caso contrrio, no deve atribuir, conceder sublicenas, alugar nem transferir ou divulgar o Software a te rceiros. No deve descompilar, desmontar nem proceder engenharia de inverso do Soft ware. Salvo se estiver expressamente referido neste contrato, no se concede qualquer di reito ou licena directamente ou por deduo, incitao, caducidade ou por qualquer outro motivo. A Intel tem o direito de controlar ou mandar um perito independente cont rolar os seus registos relevantes, a fim de verificar o cumprimento dos termos e condies deste contrato. CONFIDENCIALIDADE. Se quiser que um consultor ou subcontratante ("contratante") execute o trabalho em seu nome e se esse trabalho implicar o acesso ou utilizao do Software, tem de exigir ao contratante a assinatura de um contrato de confidenc ialidade por escrito, com termos e obrigaes relativos ao acesso ou utilizao do Softw are to restritivos quanto os referidos neste contrato e excluindo os direitos de distribuio, bem como a utilizao do Software para outros fins. Caso contrrio, no deve divulgar os termos ou a existncia deste contrato nem utiliza r o nome da Intel em publicaes, anncios ou outros avisos, sem obter o consentimento prvio, por escrito, da Intel. No tem direito de utilizar os logtipos ou as marcas

comerciais da Intel. PROPRIEDADE DO SOFTWARE E DIREITOS DE AUTOR. O ttulo de propriedade de todas as cp ias do Software permanece propriedade da Intel ou dos seus fornecedores. O Softw are est protegido pelas leis dos direitos de autor e pelas leis dos Estados Unido s da Amrica e de outros pases, bem como por disposies de acordos internacionais. Os avisos de direitos de autor no podem ser removidos do Software. A Intel pode, a q ualquer momento e sem aviso prvio, fazer alteraes no Software ou nos itens referido s neste documento, mas no est obrigada a prestar servios de assistncia nem a actuali zar o Software. Salvo se estiver expressamente indicado em contrrio, a Intel no co ncede quaisquer direitos expressos ou implcitos ao abrigo de patentes, direitos d e autor, marcas comerciais ou outros direitos de propriedade intelectual da Inte l. O Software s pode ser transferido se no guardar cpias do Software e se o destina trio concordar em ficar vinculado aos termos deste contrato. GARANTIA LIMITADA DE MEIOS. Se o Software tiver sido entregue pela Intel em supo rte fsico, a Intel garante que esse suporte estar livre de defeitos fsicos, por um perodo de noventa (90) dias a contar da data de entrega pela Intel. Se for detect ado um defeito desse tipo, o suporte deve ser devolvido Intel para substituio ou e ntrega alternativa do Software, de acordo com o livre arbtrio da Intel.

EXCLUSO DE OUTRAS GARANTIAS. EXCEPTO COMO ESTABELECIDO ACIMA, O SOFTWARE FORNECID O "COMO EST" SEM QUAISQUER GARANTIAS EXPRESSAS OU IMPLCITAS DE QUALQUER TIPO, INCL UINDO GARANTIAS DE COMERCIALIZAO, NO VIOLAO OU ADEQUAO A UM OBJECTIVO ESPECFICO. A In no garante nem se responsabiliza pela preciso ou integridade dos grficos, informaes, texto, ligaes ou outros itens contidos no Software. LIMITAO DE RESPONSABILIDADE. EM NENHUM MOMENTO, A INTEL OU OS SEUS FORNECEDORES SE RO RESPONSVEIS POR QUAISQUER DANOS, SEJAM ELES QUAIS FOREM (INCLUINDO, MAS SEM LIM ITAO, PERDA DE LUCROS, INTERRUPO DA ACTIVIDADE COMERCIAL OU PERDA DE INFORMAES), RESUL TANTES DA UTILIZAO OU INCAPACIDADE DE UTILIZAO DO SOFTWARE, MESMO QUE A INTEL TENHA SIDO ALERTADA DA POSSIBILIDADE DE OCORRNCIA DE TAIS DANOS. ALGUMAS JURISDIES PROBEM A EXCLUSO OU LIMITAO DE RESPONSABILIDADE NO QUE DIZ RESPEITO A GARANTIAS IMPLCITAS, DANOS CONSEQUENCIAIS OU ACIDENTAIS, PELO QUE A LIMITAO SUPRA PODE NO SE APLICAR AO SEU CASO. No pode efectuar a engenharia de inverso, a descompilao nem a desmontagem do Soft ware. 4. No pode atribuir sublicenas nem permitir a utilizao simultnea do Software por mais do que um utilizador. 5. O Software pode conter o software ou outra propriedade de outros fornecedores , parte do qual pode ser identificada em, e licenciada de acordo com qualquer fi cheiro "license.txt" includo ou com outro texto ou ficheiro. If the Software has been delivered by Intel on physical media, Intel warrants the media to be free from material physical defects for a period of ninety (90) days after delivery by Intel.
