FORESHORE LEASE APPLICATION (per DENR Adm. Order No. 2004-24 dated August 24, 2004)

WHO MAY APPLY: 1. Any Filipino citizen of legal age 2. Corporation, associations or partnerships duly constituted and organized under Philippine laws, at least 60% of the capital is owned by Filipino citizens. APPLICATION FORM AND SUPPORTING DOCUMENTS: 1. Application shall only be accepted properly filled-out under oath by the applicant, or by its President, General Manager or duly authorized representatives in the case of judicial person. 2. Documents required: a. if applicant is a naturalized filipino citizen, a copy of his certificate of naturalization duly signed by the proper agency. b. In case of corporation, association or partnerships: - Articles of Incorporation and - Certificate of Registration from the Security and Exchange Commision (SEC) - Three (3) copies of Board Resolution authorizing the President or organization representatives to apply FLA c. If applicant uses a name, style or trade name, other than his/its true name, three (3) copies of Certificate of Registration, such as name, style or trade name from the DTI and SEC. d. Approved plan and Technical Description of the land applied for, shall be approved by the RTD for LMS. e. Certification from Regional Heads, that the land applied for is not needed for public use: - DOT (Dept. of Tourism) - PPA ( Phil. Ports Authority) - Municipal/District/City Engineers Office with the concurrence of Regional Director of DPWH and/or - PEA (Public Estates Authority) f. A development sketch/plan of t he area stating the financial and technical capability of the applicant. APPLICATION FEES: New and Renewal of FLA/contract shall be accepted only with application fee (non refundable) P 1,000.00 for corporations, association, partnership P 500.00 for individual plus documentary stamps

SIGNING AUTHORITY FOR APPRAISAL, CONDUCT OF PUBLIC BIDDING AND FORESHORE LEASE AGREEMENTS

1. PENR Officer

NOTE: PUBLIC BIDDING shall be conducted in accordance with Sections 34, 35, 36 and 37 of CA 141. APPRAISAL/REAPPRAISAL shall be in accordance with the manner prescribed in DAO 98-20. The area used and improvements thereon shall be re-appraised every ten (10) years from the date of approval. In the event that new improvements/developments have been introduced prior to the 10th year, immediate appraisal/re-appraisal shall be effected.
