GENERAL REQUIREMENTS 1.0 1.1 WORK UNDER THIS CONTRACT Work to be Done 1.1.1 The work to be done under this specification consists of the design, fabrication, inspection, shop testing, cleaning, assembly, painting, delivery, start-up & commissioning, training and guarantee of one(1) chilled water booster pump for the Cornell University Lake Source Cooling Project The contract shall include the supply by the Manufacturer of materials not herein specifically mentioned, but which may be found necessary to complete or perfect any portion of the work in compliance with the requirements of this specification. No installation craft labor is included in this contract. Delivery costs F.O.B. Cornell are to be included in this contract. All equipment covered by this contract is to be delivered to the Heat Exchange Facility (HEF), located at 983 East Shore Drive, Ithaca, New York.

Scope of Work 1.2.1 The scope of the work in all Sections of this Specification, shall consist of the furnishing of all shop labor, materials, equipment and other appliances and the performance of the Work required by the Contract Documents, joining all parts of this Work with itself and the Work of others to form a complete, functioning entity. Items not specifically mentioned in this Contract or shown on the drawings, but which are inherently necessary to make a complete working installation, shall be included.

Items to be Supplied by the Manufacturer 1.3.1 The Manufacturer shall provide chilled water pumps and accessories for Cornell University, Lake Source Cooling Project which shall include but is not limited to the following: A. B. C. One(1) 100% duty chilled water pump. Electric motor, coupling, coupling guard, baseplate, and all other accessories required for the above pump. Factory testing as specified.

One (1) complete set of special tools (as required). Five (5) sets of drawings, instructions, and operating & maintenance manuals. Home-office assistance to facilitate field supervision and to answer questions of the installation contractor and the Owner (as required and in a timely manner). Commissioning assistance. Performance guarantees. Access to Manufacturers and his subcontractors facilities to monitor progress of the work.

Items to be Supplied by the Owner The Owner will provide the following: A. B. C. Labor to unload and install the pump. 480 Volt, 3 phase, 60 Hz power supply Variable speed drive.

2.0

DEFINITION OF TERMS The use of the word (or words): Provide and furnish means supply and deliver to job or where directed; As approved or approved means Engineers or Owners approval; As directed means Engineers or Owners direction or instruction; To do, provide, furnish, install, etc., in these Specifications are directions given to the Manufacturer. Manufacturer means the Proposer and not the suppliers of subcontracted components. Labor means all direct or subcontracted labor necessary to manufacture, assemble, test, and ship any specified equipment; Purchaser or Owner are equivalent. Work means the Manufacturing and delivery of the lake water circulating pumps.

3.0

STANDARDS AND CODES The manufacturing and testing of the chilled water pumps shall be executed in accordance with the codes, requirements and regulations as outlined in the technical requirements. All references to codes, specifications and standards referred to in the Specification Sections shall mean, and are intended to be, the latest edition, amendment and/or revision of such reference standard in effect as of the date of these Contract Documents.

4.0

QUALITY ASSURANCE The requirements for Quality Assurance shall apply to Contractor as well as Contractors subcontractors to any tier who shall furnish material, components, or services as part of the Work. The Contractor shall have a documented quality assurance program to assure that the equipment and/or services furnished comply with the technical requirements and all referenced and applicable codes and standards. Generally, the suppliers quality assurance program shall comply with the requirements of a nationally recognized Quality System Standard. A copy of the Manufacturers quality assurance program shall be available for review by the Purchaser. Prior to award and during the life of the Contract, the Purchaser and/or Purchasers representative shall have the right of reasonable access to the Contractors facility and that of subcontractors in order to evaluate the implementation and effectiveness of the quality assurance program and work associated with this Contract. At least two (2) weeks prior to the start of fabrication, the Manufacturer shall submit a detailed list of planned inspection and test points. These shall be identified and referenced to their respective point in the manufacturing and/or fabrication cycle. The Manufacturer is responsible to notify the Purchaser or Purchasers Representative at least five (5) working days prior to performing those witness points designated by Owner. Failure to do so may be cause for non-acceptance or repetition of the activity at the Contractors expense. The Manufacturer is responsible for the performance of all required inspections and tests. All personnel performing welding or non-destructive testing shall be qualified and certified to the extent applicable. Inspections/tests witnessed or performed by the

Purchaser do not relieve the Manufacturer of the obligation and responsibility to furnish all items in accordance with the requirements of this Work and applicable referenced codes and standards. Any deviations to the Contract must be documented and approved by Purchaser prior to disposition. 5.0 TESTING BY MANUFACTURER During manufacture of the equipment, the Manufacturer shall perform all tests necessary to demonstrate compliance in all respects with the requirements of these specifications including all required tests. The Purchaser shall be notified in advance of all tests which are to be made, and shall be permitted to have his representative witness the tests. Performance tests shall be as specified in the TECHNICAL REQUIREMENTS specifications. The Manufacturer shall include in the Schedule of Values in the Proposal Forms, the cost to carry out these tests. Cornell may, at its own option, carry out the required tests. However, if the tests show that the requirements have not been met, the Manufacturer shall, at his own expense, make all necessary corrections to the equipment and for any retesting. 6.0 SHIPPING All equipment, materials and parts are to be shipped F.O.B. Cornell University Lake Source Cooling Heat Exchange Facility located at 983 East Shore Drive, Ithaca, New York. The cost of shipping shall be included in all items For each separate shipment, an itemized packing list shall be made showing the Purchasers purchase order number, item number, or equipment number, and a description identifying each article in the shipment. All equipment, all parts which are shipped loose, and all containers shall be suitably marked, with wired-on waterproof or metal tags showing the Purchaser's purchase order number, item number, and equipment number. All loads are to be appropriately weatherproofed for shipping. The weatherproofing shall be intact upon delivery and suitable for a six (6) month term outdoor storage in freezing weather. Crating and packing shall be adequate to prevent damage to equipment while in transit and storage. The Manufacturer shall identify equipment and devices requiring inside climate controlled atmosphere. All loads in excess of 1000 lbs shall be provided with lifting eyes or lugs. The Owner shall be notified when any shipment leaves the manufacturing facility and shall be notified 24-48 hours in advance of any actual deliveries. Failure to notify the customer may result in non-acceptance of the delivery for a minimum of 24 hours, while unloading preparations are made. Any special storage requirements for the equipment being shipped shall be stated at this time.

No deliveries will be accepted on legal holidays or University holidays or before 9:00 a.m. or after 2:00 p.m. Unloading will be provided by the Owner. The Owner will report any apparent damage to the Manufacturer prior to or during unloading and advise the Manufacturer of any known shortage at the time of delivery. The Owner or agent will not assist in unloading any trailer to gain access to equipment which is otherwise not accessible due to other loads. The Owner will refuse delivery of any items not properly loaded or that has suffered damage. All tubing, instrumentation, and flange connections shall be properly capped and sealed to keep out dirt, moisture and other debris. All threaded end connections shall be capped. All other openings in equipment shall be protected by a temporary closure. The Manufacturer shall be responsible for all shipping related back-charges, due to failure to meet the requirements of this section. 7.0 CLEANING, CORROSION PROTECTION AND COATING All material supplied under this contract shall be clean and free of foreign material. All manufacturing waste shall be removed from the equipment. All mill scale, rust, oil, grease, chalk, crayon, paint marks and other deleterious material shall be removed from interior and exterior surfaces. All material surfaces shall be adequately protected against corrosion and damage during shipment and outdoor storage. Bags of desiccant shall be placed in enclosed equipment where suitable prior to shipment. Manufacturer shall refer to the Painting Section in the TECHNICAL REQUIREMENTS specification for surface preparation and painting requirements. 8.0 MARKING AND IDENTIFICATION Each major piece of equipment supplied shall be provided with a stainless steel nameplate with a standoff mount to allow viewing outside of the insulation layer. As a minimum, the following shall be stamped on the nameplate unless otherwise approved by the Owner in writing: Manufacturer name address and phone number Model Number Date of Manufacture Electrical data if applicable Serial Number Cornell Purchase Order (P.O.) Number All design parameters such as pressure, temperature, flow, speed, head, power consumption, surface areas, etc.

9.0

Date of Fabrication

DELIVERY DATES The equipment supplied under this Contract shall be delivered to the Owners site, as specified in Section 6.0 of these General Requirements, in August/September of 2000. A preliminary delivery date will be established prior to award of the Contract. The delivery of the equipment will be scheduled by the Owner to minimize on-site storage. The Manufacturer shall deliver certified engineering information, as detailed in the Required Submissions section of the Instructions to Bidders, for Owners review and approval three (3) weeks after receipt of order. The Manufacturer shall not proceed with manufacturing until the above submittals have been returned and the order has been released for manufacture by the Owner.

10.0

TITLE Title shall pass to the customer upon approval and signed acceptance of a shipment and upon commencement of unloading at the site or other designated location. Shipping damage shall be the responsibility of the Manufacturer.

11.0

TAXES Cornell University is a tax-exempt institution.

12.0

PAYMENT SCHEDULE The following Schedule of Payments shall apply: Deliverable A) B) C) Engineering Information Certified for Construction Delivery of Pump and Ancillary Equipment Final Owner acceptance Payment (% of Full Contract Price) 5% 80 % 15%

Final payment will be made within 30 calendar days after receipt of an accurate application for payment that is accompanied by a notarized Release of Lien Statement stating that the Manufacturer has paid all suppliers and subcontractors. 13.0 OWNER ACCEPTANCE

Final Owner acceptance shall be deemed to have occurred when the following conditions are met: 1. The equipment shall have a) been in satisfactory operation for a period of thirty (30) days and b) met all specified performance requirements as demonstrated by Owners field performance evaluations. 2. Owner has received all approved O&M manuals and field documentation per the General Requirements.

14.0

OPERATION & MAINTENANCE MANUALS The Manufacturer shall provide five (5) sets of Operation & Maintenance Manuals compiled and edited for this particular project. Each set shall be bound in a hard cover swing hinge, linking arm, split prong binder, in the size and quantity required to include all hardware and software documentation and instructions. The cover and spine shall have printed; the Owner's name, the prime Manufacturer's name, the purchase order number and the date of order. Two copies of the proposed lettering in full scale shall be submitted to Owner for approval. The Operation & Maintenance Manuals shall contain, but not be limited to: A complete system materials and parts list with Manufacturer Model number, part number, and technical/material specifications. Custom written sections on system related or custom components describing operation and maintenance. Reduced size drawings of the general arrangement and equipment (all of them for the project). Custom written sections on system maintenance intervals.

Two (2) preliminary books shall be submitted for Owner review one (1) month prior to shipment. Allow three weeks for this review. 15.0 MANUFACTURER SUPPLIED DRAWINGS All drawings to be prepared and furnished by the Manufacturer shall become the property of the Owner upon payment to the Manufacturer of all fees and costs due and owing. All drawings shall be submitted for review and shall be approved by the Owner or its representative prior to release for manufacturing.

Typical required drawings include but are not limited to: Certified dimensional outline drawing and list of connections for the pump/motor/baseplate assembly. Cross-sectional drawing and bill of materials for the pump/motor/baseplate assembly. Bearing assembly, coupling assembly and mechanical seal drawings. Electrical elementaries and connection diagrams. Pump Performance curves. Allowable flange loading. Schedule of weights for major components and subassemblies. Alignment diagram and installation instructions.

Approval of any drawings by the Owner or its representative will not relieve the Manufacturer of responsibility for the accuracy and correctness of his work or for the construction and successful performance of the equipment furnished by him 16.0 MATERIAL AND WORKMANSHIP All materials shall be new materials of high quality which shall give long life of 30 years or more and reliable operation. Parts subjected to high temperatures shall be of such design that serious deformations shall not occur within the normal life of the equipment. All equipment shall be modern in design and shall not have been in prior service except as required by factory tests. The workmanship shall be of the highest quality in every detail.
