A failed to comply with the order of the City Mayor, so the Office of the City Engineer caused the demolition of the building. A complained alleging the constitutional provision that no person shall be deprived of his property without just compensation. Is A correct? EXPLAIN.

4. A mortgages his land to B for a period of five (5) years. A fails to pay his mortgages obligation. However, B also fails to file an action to foreclose the mortgage within the period prescribed by law. When A demands for the release of the mortgage; B refuses claiming that his right to the land has already prescribed for his failure to redeem the land within the prescribed period. A files an action against B for quieting of title alleging therein that Bs claim constitute a cloud on his title to the land. In his answer to the complaint, B raises the defense that A has no more right to the land for his failure to redeem the mortgage, and has no cause of action against B. Is the action of A for quieting of title the proper remedy, and is the contention of B correct? EXPLAIN YOUR ANSWER.

5. A,B, and C are the co-owners of an agricultural land in equal parts. A later on files an action for partition of the land against B alone. During trial on the merits, it is brought to the attention of the court that the land is owned in common among A, B, and C in equal shares, and renders judgment ordering the partition of the land among the three (3) of them in equal shares. Can C bring another action against A and B for the partition of the same land considering that there is already judgment ordering its partition? EXPLAIN
