PROCESS FLOW FOR INJUNCTION CASES

START

Petitioner files PETITION FOR INJUNCTION with the (MAIN) DOCKET SECTION

LA may conduct hearings if necessary after notice to parties has been served

Parties adversely affected by the decision did not file MOTION FOR RECONSIDERATION within 10 days

Petition is forwarded to the Office of the Executive Clerk of Court IV for RAFFLING

Reviewer/LA submits report/draft decision/resolution/order to the Ponente/Commissioner

Office of ECC II issues ENTRY OF JUDGMENT

Case is RAFFLED in the office of the ECC IV before representatives of the 3 divisions

Deliberation will be conducted by 3 Commissioners, if necessary

After ENTRY OF JUDGMENT, decision becomes final and executory

Office of the ECC IV endorses Petition to the Office of the Executive Clerk of Court II for RECORDING PURPOSES

Office of Commissioner/Ponente circulates decision/resolution/order, along with the Petition, to the other Commissions of the Division for approval/concurrence

Enforcement

ECC II will request Legal and Enforcement Division to conduct ocular inspection in case of strike

Upon approval/concurrence of majority of the Commissioners in the Division, decision shall be PROMULGATED and SERVED to the parties

In case of defiance Contempt upon the the party who defied the judgment
