SCAIs response Delhi Shops & Establishment Act, 1954 Present Registration of Establishment The registration was mandatory

under the Act prior to 23.11.1989 since when the same has been kept in abeyance. Proposed (Your inputs needed) 1. Online registration to be put in place. 2. Automated Renewals on yearly basis to be applied. 3. Fees to be based on approved sq. ft. 1. Shops to be opened for 24 hours, 365 days 2. No permission should be required for the shops to be open for 24 hours/365 days. 1. It is to be left to the shop/commercial establishment to determine the working hours and shifts for male & female workers. A staff should get weekly day off atleast on rotation basis. However, a shop can run for 24h hours and 365 days.

Opening and Closing Hours (Sec 15)

No shop or commercial establishment may be opened earlier than such hour or closed later than as may be prescribed i.e. 9 AM and 7 PM in winter, 9.30 Am to 7.30 PM in summer and 8.00 AM to 6 PM for establishment.

Employees Working Hours

For not more than nine hours on any day or 48 hours in any week. Further no woman or a young person can be required to work, whether as an employee otherwise in any establishment between 9 P.M to 7 A.M during summer season and between 8 P.M to 8 A.M during winter. Every shops & establishment shall remain closed for one day in a week

Maintenance of Records

The occupier of every Shops or Establishments shall for the purpose of this Act maintain such other records and registers and display such other notices as may be prescribed. (Section 33 )

All self compliance basis records to be maintained.
