d John Maloy with sexual assault one year after he inappropriately fondled a child while dressed as Santa Claus. Maloy posed as Santa Claus at a Wal-Mart in Macclenny, Fla., during Dec. 1994. The victim accompanied him dressed as an elf and took holiday pictures together with children. According to investigative reports, the victim told her mother one year later where her grandmother made her sit with Maloy. He touched my private, said the victim. Rochelle Morgan of the Child Protection Team interviewed the victim and said she gave a consistent story explaining where Maloy touched her under her elf skirt while she got her picture taken. After the incident, the victim told her mother she hated Maloy, and she did not want to be an elf anymore. Maloy gave the victims mother toys for the victim, but the victim threw them in the garbage. Andrea Leigh Rumsey took the photographs of the victim and Maloy in the Wal-Mart store. According to police records, Rumsey said, [He] kept wanting to kiss the victim on the cheek and kept talking about how pretty she was, then he did start kissing her on the cheek. Rumsey further explained Maloy wanted the victim to stand beside him and constantly wanted the victim to sit on his lap.

Afterward, witnesses saw the victim crying in a circle rack of clothes, and she would not come out of the rack. Kathy Thigpen worked in the Wal-Mart store on the day of the incident. Thigpen said the victim hid inside a clothes rack for approximately 20 minutes, scared and sat in a ball position. Thigpen then called the victims family to come get her. The victims uncle picked her up and left the store with her. State Attorney Rod Smith placed Maloy on probation Friday. Under his probation, the special conditions state Maloy will have no unsupervised contact with non-relative children under the age of 16, he will not play the role of Santa Claus, he will not possess any outfit resembling that of Santa Claus and he will not have any contact with the victim or her family.
