OR DE R: In the Government Order 2nd read above, orders were issued constituting Pay Revision Commission and Government appointed Sri J. Rambabu, IAS., (Retd) as Pay Revision Commissioner. In the Government Order 3rd read above, the terms of reference of the Pay Revision Commissioner were laid down. 2. The Pay Revision Commission submitted its report to the Government on 30-06-2005 and recommended, inter alia, that: (i) (ii) The Minimum Pension be fixed at Rs.1925/- a month. Dearness Relief be allowed for the Pensioners along with serving Government employees treating the pension as pay and also to extend the same fitment as in case of serving employees. (iii) The Financial Assistance may be raised to Rs.1500/- per month.

3. In the Government Order, 5th read above, orders have been issued revising the Pay Scales of the State Government Employees in pursuance of the recommendations of the Pay Revision Commissioner and discussions with Employees Associations with effect from 01.07.2003 with monetary benefit from 1.4.2005. 4. After careful consideration of the report, Government hereby order that for the existing Pension/Family Pension/ compassionate Pension/ Compassionate Allowance, in respect of those pensioners who retired or died while in service before 01-07-2003, 16% of increase in the said basic pension and the Dearness Relief as on 01-07-2003, shall be merged and will be known as Revised Consolidated Pension. This Revised Consolidated Pension shall come into force with notional effect from 01-07-2003 and with monetary benefit payable with effect from 01.04.2005. No difference on Retirement Gratuity and Commutation shall be

allowed in the pension notionally fixed as above. The arrears from 01-04-2005 up to 31-07-2005 shall be paid in 4 installments. The first installment will be paid in April, 2006, 2nd installment in August, 2006, 3rd installment in December, 2006 and 4th installment in April, 2007 along with the regular pensions. 4.1. While calculating the above increase in the basic pension, the part of rupee so arrived should be rounded off to the next higher rupee. 4.2. The Interim Relief sanctioned at the rate of 8.5% percent on pension to the pensioners/ Family Pensioners in the reference 4th read above shall be adjusted in the Revised Consolidated Pension now ordered with effect from 01-04-2005.Interim Relief paid for the month of March, 2005 shall not be recovered. Interim Relief paid for the period beyond 01-04-2005 will be adjusted from the monetary benefit payable on account of revision of consolidated pension. 4.3. A ready reckoner has been framed and appended to this order as Annexure I. This ready reckoner can be used for payment of the arrears of pension and fixation of Consolidation of Pension as ordered above. 5. The employees who retired between 01-07-2003 and 1-4-2005 are eligible for revision of their pay in the Revised Pay Scales, 2005 notionally as per the orders issued in the G.O. 5th read above. As such, the pensions of these employees may be revised notionally as per the revised pay in Revised Pay Scales, 2005 and monetary benefit should be allowed from 01-04-2005. No difference on Retirement Gratuity and Commutation shall be allowed on the pension notionally fixed as above and this is subject to outcome of the Special Leave Petition (Civil) Nos. 5394-5470 of 2004 pending in Hon`ble Supreme Court. 6. The Legal heirs of the pensioners who retired after 01-04-2005 but died subsequently shall be entitled to arrears. In such cases the Dearness Relief admissible on the Revised Consolidated Pension from 01-04-2005 has to be worked out in each individual case before making payment. The Legal heirs shall submit an application for payment of Life Time Arrears in the proforma prescribed in Annexure-II to the Pension Disbursing Authority. The general rules governing payment of pensionary arrears of deceased pensioner will equally apply for payment of pensionary arrears. 7. Government also hereby order for payment of Dearness Relief on the Consolidated Pension as well as on the Pension fixed with reference to the pay drawn in the Revised Pay Scales 2005 @ 7.536 % with effect from 01-04-2005. The Dearness Relief will be rounded off to the next rupee. 8. These orders are applicable to: (1) (a) All Government Pensioners in receipt of Service Pensions, Family Pensions under Revised Pension Rules, 1951, the survivors of class-IV employees of Nizam-E-Jamiath of Ex-Hyderabad Government, A.P. Liberalized Pension Rules 1961 and Andhra Pradesh Government Servants (Family Pension) Rules, 1964.

Teaching and non-teaching pensioners of Municipalities, Panchayat Raj Institutions and Aided Educational Institutions, in receipt of pensions under the A.P. Liberalised Pension Rules, 1961 and Andhra Pradesh Government Servants (Family Pension) Rules, 1964. Teaching and non-teaching staff in Aided Educational Institutions in receipt of pensions under the Contributory Provident Fund-cumPension and Gratuity Rules, 1961 and Andhra Pradesh Liberalised Pension Rules, 1961. Those drawing family pensions under the G.O.Ms.No.22, Finance and Planning (FW.Pen-1) Department, dated 16-01-1971 G.O.Ms.No.104, Finance and Planning (FW.Pen-1) Department, dated 13-04-1973 and G.O.Ms.No.25, Finance and Planning FW.Pen-1) Department, dated 02-02-1974. Pensioners in receipt of Compassionate Pension under the rules for Compassionate Pensions and Gratuities in the Hyderabad Civil Services Rules; and Those in receipt of Pensions under the Extraordinary Pension Rules. Jagir and Estate Pensioners and Pensioners Governed by Revised Pension Rules, 1980. Who retired or died prior to 01-07-2003 and also those who retired or died on or after 01-07-2003 without the benefit of Revised Pay Scales 2005.

The above consolidation of pension does not apply to: Those who have been drawing pay in the Revised Pay Scale 2005/ Revised U.G.C./ ICAR/AICT Pay Scales of 1986/1996 even if because of administrative reasons, they have not actually drawn the pay in their Revised Pay Scales as yet. (ii) Pensioners/Family Pensioners of the members of the Andhra Pradesh State Higher Judicial Service and Andhra Pradesh State Judicial Service. (iii) Financial Assistance grantees who are not getting Dearness Relief. (i)

9. Revised Consolidated Pension now sanctioned is worked out with reference to the total Pension i.e. including commuted portion of Pension. As such commuted portion of pension should be deducted from the Revised Consolidated Pension while making monthly disbursements. 10. In respect of pensioners and family pensioners who are re-employed/employed respectively, the notional relief on pension as on 01-07-2003, which would have been admissible to them but for their re-employment/ employment, shall be merged with basic pension with effect from 01-07-2003. The pay drawn by the re-employed pensioners during

the period of re-employment shall also be re-fixed taking into account the Revised Consolidated Pension. Dearness Relief beyond 01-07-2003 will not be admissible to them during the period of re-employment as per G.O.Ms.No.145, Finance and Planning (FW.PSC) Department dated 16-10-2000. 11. At the time of noting Revised Consolidated Pension on the Pension Payment Order, the Pension Disbursing Officer shall simultaneously calculate and note the corresponding Revised Consolidated Enhanced Family Pension and Revised Consolidated Normal Family Pension on the Pension Payment orders. Similarly, in case where Enhanced Family Pension is being paid, the Normal Family Pension to be payable in future would also be consolidated and noted on the Pension Payment Orders. 12. Government also hereby order that the existing Minimum Pension of Rs.1275/- per month shall be enhanced to Rs1925/- per month. This enhancement shall come into force with effect from 01-07-2003 with monetary benefit payable with effect from 01-04-2005 with arrears to be paid as prescribed in para 4 above. 13. In respect of pre 01-07-2003 pensioners, whose consolidated pension falls short of Rs.1925/-, the same shall be raised to Rs.1925/- per month. 14. Enhancement of minimum pension shall apply to those pensioners referred to in para 6 above and Pensioners who are in receipt of Family Pension under G.O.Ms.No.83, Finance and Planning (FW.Pen-1) Department, dated 05-03-1983 and G.O.Ms.No.314, Finance and Planning (FW.Pen-1) Department, dated 21-11-1983. 15. Government also hereby orders that the existing Financial Assistance of Rs.750/- per month shall be enhanced to Rs.1500/- per month. As before, no Dearness Relief will be admissible on this Financial Assistance. This enhancement shall come into force with effect from 01-07-2003 with monetary benefit payable with effect from 01-04-2005 with arrears to be paid as prescribed in para 4 above. 16. The minimum pension is inclusive of commuted portion of pension. As such commuted portion of pension will be deducted from the minimum pension of Rs.1,925/- per month while making monthly disbursement except in respect of pensioners whose commutation is restored as per the existing orders. 16 .1. In respect of pensioners drawing two pensions viz. Service Pension and Family Pension, both pensions shall separately be eligible for enhancement to a minimum of Rs.1925/- per month. However, the pensioners shall be entitled to Dearness Relief on only one pension, whichever is more beneficial to the pensioner. 17. The pensioners are not entitled to commute any portion of pension on the difference in pension now admissible as per these orders. 18. All Pension Disbursing Officers, i.e. all Treasury Officers/Pension Payment Officers are requested to implement these orders without any authorization from the Accountant General (A&E), A.P. Hyderabad. 19. The expenditure is allocable among the various States in accordance with the provisions of G.O.Ms.No.198, Finance, dated 10-07-1969.

20. The categories of employees who are not covered for payment through the Treasuries, the expenditure shall be debited to the Pension Funds of Zilla Parishads and Pension funds of the respective Municipal Councils in so far as the Non-Teaching, Non-Government Pensioners of the Municipalities are concerned and the relevant Head of Account of Government in so far as the teachers are concerned. 21.
