I am Director ofInvestigations for a national project called Investigating Innocence. The mission ofour not-for-profit organization provides investigative support to indigent inmates,lawyersand Innocence ProjectsthroughouttheUnited Stateswhoseektoprovepost-conviction claims of actual innocence.2.Ibegan conductingthepost-conviction investigationfor thedeath penalty appealofGordon "Randy" Steidl in Jan. of 1992, working as an investigator for attorneyMichael Metnick. Mr. Steidl had been condemned to death in1987for the murdersofDykeandKaren RhoadsinEdgar County, Paris, Illinois.In2003,federal JudgeMichael P. McCuskey ordered the reversal of Mr. Steidl's conviction. Mr. Steidl wasreleased from prison on May 28, 2004. On March 27, 2013, US Federal DistrictJudge Harold Baker entered a final order in Mr. Steidl's civil case against the City ofParis and Edgar County that asserted a claim of actual innocence, effectively endingall litigation in the civil case through an out-of-court settlement of their claims.3.I also directed the post-conviction investigation for Herbert Whitlock (Mr. Steidl'sco-defendant), who was also convicted of the murder of Karen Rhoads. Mr.Whitlockwasacquittedin1987of themurderofDyke Rhoadsin acompromisedjury verdict. Working with his attorneys RichardKlingand Suzanna Ortiz, myinvestigation provided additional evidence exonerating Mr. Whitlock. In reversingMr.Whitlock'sconviction,the 4thDist. Appellate Court reliedon andcitedmyinvestigation. Herb Whitlock was released from prison on Jan. 8, 2008. He too,filedacivil lawsuitandreceivedasettlementof hisclaimsofbeing wrongfullyconvicted.4.On April 27, 2011, I traveled to Livingston, Texas and interviewed death rowinmate Tommy Lynn Sells. Mr. Sells is a convicted serial killer who resided inMissouriduring much of his life. During my interview Mr. Sells provided informationandadmissions that convincesmethathe was theperson responsiblefor themurdersofDykeandKaren Rhoads.5.Tommy Lynn Sells grewup inHolcomb, Missouri,anarea neartheMississippiRiver in thesoutheast partof thestatein anarea knownas the"Bootheel".He iscurrentlyunderadeath sentencefor themurderofKaylene Harristhatoccurredonorabout Jan.31,1999,in DelRio, Texas;and for a theApril1999,murderofMaryBeaPerezinBexar County, Texas.6.Afterhisarrestin Del Rio inJanuary 2000, Sells confessedto themurderofKaylene Harris. Sells claimed thathecommittedthemurder becausethefatheroweda$5,000 drug debt.Hethen began confessingtoother murders. Sellsclaimstohave killedasmanyas 70people overatwenty year period beginningwhenhe was ateenager. Sells stopped cooperating with Texas Rangers duringanincident that occurredinWinnemucca, Nevada, while attemptingtolocatethebodyof one of hisvictims there. Sellswasupset overascuffle withacorrectionalofficer,afterhe had to be forcefullysubdued.HedeclaredtoTexas Rangers thatthere were more murdershecommitted that theyhad yet totalk about.7.IbeganmyinvestigationofTommy Lynn SellsinMarchof2000, after readingmediareportsof hisconfessionto themurderof theDardeen familyfrom Ina,Illinois.TheDardeen family,awifeandhusband,achildand aninfant,weremurdedbySellsonNov.18,1987.Ifirst heard abouttheDardeen caseinNov.1988,whenIreadanAssociated Press story aboutthe oneyear anniversaryof themurders.Notlong after reading this articleI had aconversation withaclientfromthat areawho hadbeen charged with trafficking kilosofcocaine.Myclienthadbeen involvedintransporting cocaine from Floridato theareaofOlney, ILduringthe mid1980's.Helivednot farfrom Ina.Heaskedme if I hadever heardof theDardeen murders.Hetoldmethatthe"rumor"wasthatthemurders were drugrelated.Hethen begantotellmethatthehusband's penishadbeen severedandstuffedin hismouthandthatthevictim'scar

wasparkedinBenton,ILwherethefederal courthouseislocated"tosendamessage".Iknew frommyprevious workon amajor drug conspiracy case thatwastriedinfederal courtinBenton,in theSpringof1986, that therewas awide-ranging federalinvestigationofnarcoticstrafficking,andthat this investigation involved cooperating informants fromtheareaofwestern Indianaandeastern Illinoisin thesouthern partofthose states.Ialsoknewfromthediscovery fromthefederal conspiracy case that that unindictedco-conspiratorsresidedin theDanville,Illinois area,in closeproximitytoParis, Illinois. 8.Themonth before reading about Sell's confessionto theDardeen murdersinIna,Illinois,I received information that a confidential informant had provided newevidence to federal prosecutors in Peoria, Illinois, concerning the murders of DykeandKaren Rhoads. This informant stated Randy Steidlwasinnocent,andthatthemurders were carriedout bymembersof theSonsofSilence motorcycle gangfrom Paris,IL.This informantwas theex-wifeofHerbert "Duke" BoardJr. Sheprovided information that re-opened a homicide investigation of an unsolveddouble murder that was believed to have occurred in Paris, Illinois in 1984. Thisunsolved case involved the murders of rival Diablo motorcycle gang membersGilbertandLanslaw.They were last seen at a bar inTerreHaute,IndianaonSept.18,1994, that servedas theclubhousefor theSon'sofSilence motorcyclegang. Theirvan wasdiscovered abandoned with blood inside just across fromtheIllinois border in Indiana. Their bodies were never found. Later that year, HerbertBoard and his brother Jerry were indicted for the murders of Gilbert and Lanslawbasedon there-investigationof thecase fromtheinformation thatwasprovidedbythisinformant.9. After receiving this information, on March 2000, I wrote a letter to Sam Nolan,Directorof the IllinoisState Police requesting that they reopen theirinvestigationoftheRhoads homicide caseinlightofthis informant's information.Isubsequentlyinterviewedtheex-wifeand had theimpression that these statementssheallegeswere made by her ex-husband were designed to intimidate her. In the context oftelling her that he was involved in the murders of Dyke Rhoads she told Sgt. MikeBritt of the Illinois State Police on May21,1999, that Dyke's penis was severedandstuffedin hismouth. (SeeEx. #1) ISPdismissed this statementasbeinginconsistent withthecrime scene evidencein theRhoads case. However,Irecognized this statement as beingconsistentwiththefactsof theDardeencase,as related to me by my former drug traffickingclient.10.After Sells was arrested for the Del Rio, Texas murder, an investigator with theIllinois State Police contacted Texas Rangers to inquire whether Sells ever spokeof killingafamilyinIllinois.OnFeb. 21, 2000, "Sells suddenly volunteeredthathehadmurderedafamily somewhere," accordingto areport preparedbyTexasRanger. It goes on to report that on March 1, 2000, Det. John Kemp of theJefferson CountySheriff'sofficeand twoother investigators fromtheIllinois StatePolice interviewed Sells regardingtheDardeen murder. "Sellswasabletoprovidesufficient detailstoconvince Kempandother investigators that onlyhecouldhavebeen responsiblefor theDardeen quadruple murder," accordingto theTexasRanger report. (See Ex. #2) 11.OnApril27,2011,Itraveledto thePolunsky UnitinLivingston, Texas,whereIconducted an interview of Tommy LynnSells.Prior to the interview I sentSellsaletterand enclosed photographs that I got from his sister-in law of the weddingreception that was held in St. Louis on June 14, 1986. I sent photographs of thewedding basedonadviceI hadreceived fromaninvestigator with Texas Rangers.The investigator told me that in their experience, showing Sells photographhelpedto refresh his memory. My intention was to have Sells recall where hewentin theweeks that followedhisbrother's wedding reception.12.On May 13, 1986, Sells was released from the Missouri Department ofCorrections. After his release from prison, he moved into anapartmentin St.Charles, MO, with his brother Timothy Sells and Tim's fiancee.

On June 14, 1986,Sells, pictured below, attended his brother'sweddingreception at a riverfront hotelinSt.Louis.Afterthereceptionheleftanddisappeared, accordingto hisfamily.Paris,ILis approximately 166 miles from where Sells was last knowntoreside.
