We are unable to present any originals oI this Bill oI Lading to claim delivery oI the cargo as to our
knowledge the document is (here give reason why applicant Ior delivery cannot produce the
Bill oI Lading, e.g. lost, delayed in mail, accidentally destroyed, etc.) As you, your aIIiliated or
associated companies and your sub-contractors have agreed to deliver the cargo without production
oI the Bill oI Lading to us or our nominee we hereby undertake:
(a) to indemniIy you, against any and all
(i) claims that may be made against you or them by reason oI the delivery oI the cargo;
(ii) losses, expenses, damages and penalties that you or they may sustain through the delivery
oI the cargo;
(b) to pay the Iull legal costs that you or they may incur in deIending any claim brought with
respect to the cargo;
(c) to redeliver the cargo iI still in our possession at the time oI this claim;
(d) to continue to make diligent search Ior the Bill oI Lading and surrender it to you as soon as
we receive possession oI it;
(e) on demand to put up security to obtain the release oI any property that may be detained in
connection with the release oI the cargo, and any bail that may be demanded to prevent the
arrest oI the carrying ship.
Our undertakings to you under paragraphs (b) and (e) apply regardless oI the merits oI the claim
made against you.
As security Ior our undertaking our Bank has agreed to join in this indemnity and accepts the
undertakings in paragraphs (a) to (e) as its own.
