Article 6 of the Convention establishes the basic procedural right to "fair trial", so it is
rightly termed as the "procedure of the European Convention." This article presents
all those "institutional" safeguards, which both make the protection of fundamental
rights and also deepening the rule of law within the meaning of the provision of legal
(judicial) protection.
The most important aspects of the right to a fair trial, which is explicitly guaranteed
by the present article are: a) the right to a fair trial in the strict sense, which, in turn,
includes the right of free access to the court, the principle of equality of arms and
procedural rights of access and representation by a lawyer, b) the principle of
openness of the process, c) the principle of reasonable duration of the process, d) the
authority of the legal establishment, independence and impartiality of the court, e) the
presumption innocence of the accused and f) the rights of the accused (procedural
safeguards). But there are some aspects that occur or interpretation of Article 6 or by
the law of the ECtHR. These are: a) the enforcement of judicial decisions, b) the
reasons for judicial decisions, c) the right to a hearing of the run, d) the principle of
legal certainty, e) the prohibition of interference unrelated provisions in legislation
and f) the requirement for question to the ECJ.
The right of the accused to examine witnesses of accusation and defense guaranteed
by article 6 para.3. d of the ECHR is a specific aspect of the right to a fair trial,
enshrined in Paragraph 1 of Article 6 of the Convention. For this reason, the Court
finds the complaints submitted to it in light of the provisions of paragraphs 1 and 3 of
article 6 in combination, to determine whether the process as a whole considered, was
fairly within the meaning of Article 6 par .1 ECHR, taking into account all relevant
circumstances of the case of the case.
