NATIONAL LABOR RELATIONS BOARD

1099 14th STREET NW WASHINGTON DC 20570

September 6, 2013 Ozburn-Hessey Logistics, LLC Cases 26-CA-070471 et al. ORDER The Charging Partys Motion for Reconsideration of the decision to reject its cross-exceptions is denied. The Board has long held that a request for an extension of time to file an answering brief does not enlarge the time to file crossexceptions. P&M Cedar Products, Inc., 282 NLRB 772 (1987). Here, the Acting General Counsel sought an extension to file an answering brief, and the Board granted an extension solely for that purpose. No extension of time was sought, and none was granted, to file cross-exceptions. Accordingly, under Section 102.46(e) of the Boards Rules and Regulations, cross-exceptions in this case were due on June 21, 2013. The Charging Party filed its cross-exceptions on July 12, 2013. Therefore, the cross-exceptions are untimely and will not be forwarded to the Board for consideration. By direction of the Board: Farah Z. Qureshi Associate Executive Secretary cc: Parties
