n 2011, Environmental Protection Agency compiled and printed Environmental protection manual for business owners to distribute to enterprises. In recent years, the legal documents for environmental protection have been changed and new documents replaced old ones. Therefore, in order to update timely information as well as new rules of the environmental protection law to the owners of industrial production facilities, Environmental Protection Agency has recompiled this document to instruct the latest laws about environmental protection issues that the enterprise need know and has to perform from established preparation to production stably. This guide-material not only is very useful for enterprises to implement measures of environmental protection for their production facilities but also is helpful propaganda material for cadres working in State management about environmental field. PREFACE
- Mineral exploration and production projects: before applying for or before asking approval on the modifications of the Mineral Exploration and Production License. - Projects with construction works: before applying for Construction License and before asking for approval on the modifications of the Construction License. - Other projects: before the investment decision is made. 4. Where to submit the EIA/CEP - EIA: to the DONRE or MONRE as regulated in the Annex III List of projects under the MONREs EIA review and approval issued together with the Decree 29/2011/N-CP. - CEP: to the Districts Peoples Committee where the project takes place.
Remarks: If an enterprise or entity (manufacturing, business, services) has the need to modify, expand, upgrade, increase capacity and the new production capacity (including the existing one plus the expanded one) meets the capacity requirements as listed in the Annex II of Decree 29/2011/NCP), the enterprise would need an EIA, otherwise, only CEP is needed for the expansion project.

1. - Three (03) CEP using the template as regulated in The Annex 5.3, Circular 26/2011/TT-BTNMT. - One (01) Report describes the details of manufacturing, business, and services signed by authorized representative persons and stamped with the enterprises chop. 3. Approval time: 5 working days
Remarks: During the project implementation, if there is any modifications and changes to the contents of the EIA Report and of the CEP Report, and to the approved environmental protection measures, the project owners must notify and get approval of the authorized agencies who have approved the Report before making any changes.

Remarks: When there is no change in terms of designed production capacity, technology and the environmental impacts, the project just needs to submit a document detailing the changes to the approving/registration agencies for modification approval.

I. WHAT SHOULD AN ENTERPRISES OWNER NEED TO DO AFTER THE EIA GETS APPROVED?
1. Adjust the investment project to ensure that it is in line with the requirements specified in the decision for the EIA Approval; 2. Make, get approved and publish the environmental management plan at the Peoples Committee of the commune where the public consultation process has taken place to inform the local people so that they can monitor the implementation. 3. Coordinate the implementation of environmental protection measures during investment preparation phase and during the construction phase in accordance with the requirements specified in the decision for the EIA Approval; The contruction of wastewater treatment systems 4. Design and install environmental facilities including wastewater treatment, hazardous waste and non-hazardous waste management, air and dust emission treatment, etc. as committed in the approved EIA;

5. Conduct the operational trials of the waste treatment facilities; 6. Create a file to ask for inspection and approval of the environmental protection facilities before they are put into official operation. The file must use the template in the Annex 4.2, and 4.3, Circular 26/2011/TT-BTNMT.
Remarks: - For those who do not need environmental protection facilities for the operational period, the projects owners are not required to make a file asking for the inspection and certification of environmental protection facilities for the operational period. - In case the project has different investment phases or independent works the projects owners need to create a file asking for the inspection and certification of environmental protection facilities for each phase of the project or for each independent work.

II. WHAT SHOULD A PROJECT OWNER DO AFTER THE REGISTRATION OF THE CEP?
The projects owner needs to implement all environmental protection measures as committed in the CEP to reduce the negative environmental impacts.

III. HOW TO MAKE A FILE TO ASK FOR THE CERTIFICATION OF ENVIRONMENTAL PROTECTION FACILITIES?
1. The file must include: - One (01) document asking for the inspection and certification of environmental protection facilities to be used for the projects operational period using the template as regulated in the Annex 4.2, Circular 26/2011/ TT-BTNMT; - One (01) copy of the Decision of the EIA Approval and one (01) copy of the approved EIA; - Five (05) Reports on the implementation results of the environmental protection facilities for the operational period using the template in the Annex 4.3, Circular 26/2011/ TT-BTNMT; - Five (05) Annexes with all related supporting documents as regulated in the Item 4, Article 25 of the Decree 29/2011/N-CP. 2. Processing time: 40 working days.
Remarks: If environmental protection facilities and measures have changed compared with what had been approved in the EIA, these changes need to be described in details (plan, scale, technology, etc.) in the Report on the implementation of environmental protection facilities for the operational period for consideration and approval.

During the operation period, the enterprise is required to do the following things: 1. Make a file to register the enterprise as a hazardous waste generator; 2. Declare and pay the environmental protection fee for wastewater; 3. Make periodic environmental monitoring reports; 4. Comply with all environmental protection regulations/standards regarding wastewater and air emission; 5. Comply with all environmental protection regulations/standards for solid waste; 6. Comply with all environmental protection regulations/standards for noise, vibration, light, and radiation. 7. Guide the generation of the EPP and the modifications of EIA and of the CEP.

- Follow the hazardous waste declaration procedure and use the hazardous waste manifest for each hazardous waste transfer as regulated. - Make a Report on hazardous waste management using the template in the Annex 4A, Circular 12/2011/TT-BTNMT every 6 months; - When the operation ends, the enterprise must notify and return the Hazardous Waste Generator Registration Booklet to the EPA.
Remarks: Registration as Hazardous Waste Generator is not applied to the following cases: - The enterprises operational period is less than a year. - Regular generation of no more than 120 kg/year of hazardous wastes containing special hazardous substances exceeding the threadhold as regulated in QCVN 07:2009/BTNMT or no more than 600kg/year for hazardous waste containing other hazardous substances.

IV. HOW TO FULLY COMPLY WITH ALL ENVIRONNETAL PROTECTION REGULATIONS FOR WASTEWATER & AIR EMISSION?
- Collect and treat all wastewater (including process wastewater and domestic wastewater) and air emission generated during operational period to ensure that treated wastewater and air emission meet the discharge standards; - All wastewater and air emission treatment works must be continuously operated.

Remarks: If there is any change in the environmental treatment measures versus the approved treatment ones in the EIA/CEP, the tentative changes must be communicated to the DONRE in writing for considerations and approval before any change can be made.
VI. HOW TO COMPLY WITH ENVIRONMNETAL PROTECTION REGULATIONS FOR NOISE, VIBRATION, LIGHT AND RADIATION?
The enterprise must ensure that noise level, vibration, light and radiation in the workshop(s) meet industrial hygiene standards as regulated in the document associated with Decision 3733/2002/Q-BYT.

VII. HOW TO MAKE THE EPP AND HOW TO ADJUST THE CONTENTS OF THE EIA, AND OF THE CEP?
1. If an enterprise (manufacturing, business, and service) is in operation or has completed the construction, equipment installation and trial operation but has not obtained the EIA Approval Decision, Certification of Environmental Standards Compliance, CEP Approval, the enterprise must make the EPP. Files and Procedure for EPP generation and certification are detailed in the Circular 01/2012/TT-BTNMT.
Remarks: - Make the detailed EPP if the scale and the nature of the enterprise are equivalent with those of the enterprises which require the EIA. -Make the simple EPP if the scale and the nature of the enterprise are equivalent with those of the enterprises which require the CEP.
2. Trong qu trnh hot ng, nu c s SX, KD, DV thc hin vic thay i, iu chnh cc ni dung ca TM hoc CKBVMT nhng khng bo co v cha c s thng nht ca c quan c thm quyn l vi phm cc quy nh ca Lut BVMT. Do , cc c s sn xut, kinh doanh phi ch ng khc phc nh sau: - Nu m rng, nng cp, tng quy m, cng sut di 02 ln hoc c tng lng cht thi tng t hn 02 ln phi c vn bn gii trnh v nhng thay i, iu chnh so vi trc y v gi v S Ti nguyn v Mi trng hoc c quan xc nhn, ng k CKBVMT . - Nu m rng, nng cp, tng quy m, cng sut hoc tng tng lng cht thi t 02 ln tr ln hoc pht sinh cc loi cht thi mi, cht thi c thnh phn gy nhim cao hn so vi trc y phi lp n BVMT .
Lu : Cn c vo quy m, cng sut sn xut (bao gm tng cng sut ca phn hin hu v m rng) v i chiu vi quy nh ti Ph lc II N 29/2011/N-CP xc nh lp TM hay CKBVMT cho d n m rng.
2. During the operational period, if an enterprise (manufacturing, business, service) wants to expand, upgrade, up-scale, increase production capacity or plans to adjust the contents of the EIA, CEP, the enterprise needs to do the following things. - If the project is expanded and upgraded to less than twice the current production capacity and generates less than twice the amount of waste, or if the project has some modifications which do not generate any new waste, the project must notify the DONRE or the agency who has approved the CEP for considerations before any change can be made. - If the project is expanded and upgraded to equal or more than twice the current production capacity and thus generates equal or more than twice the amount of waste, or generates new waste, an EIA or CEP must be made and submitted to the authorized organizations for considerations, approval and registration before the expansion and production scale-up can be implemented. 3. During the operational period, if an enterprise has implemented the changes versus the contents of the EIA or of the CEP without notifying and getting approval from authorized agencies, the enterprise has violated the Vietnam environmental protection law. Therefore, the enterprise must actively make remediation as follows. - If the entity has expanded the production to less than 2 times or the increased waste generation is less than 2 times, a document detailing the changes and modifications compared with the previous setting must be sent to DONRE or to the organization who had approved the CEP. - If the entity has expanded the scale and production capacity more than twice and generated the waste more than twice or generates new waste or waste with higher polluting substances compared with the previous setting, the enterprise must make the EPP.
Remarks: Compare the projects scale and production capacity (including the current production capacity and the expanded one) with those in the Annex II Decree 29/2011/N-CP to decide if an EIA or CEP needs to be produced for the projects expansion.

- All wastewater generators with the wastewater discharge flow of more than 1,000m3/24hrs, all industrial parks and industrial clusters need to install the automatic flow meter, hydraulic weir and automatic wastewater quality monitoring equipment. - Wastewater generators of between 200m3 and 1,000m3/24hrs must have both flow measurement meter and hydraulic weir. - Wastewater generators of less than 200m3/24hrs need to install hydraulic weir.

Remarks: The automatic wastewater quality monitoring equipment must be built and installed in accordance with the Technical Guidance on the automatic wastewater quality monitoring equipment issued by the DONRE. The flow monitoring device, and the automatic wastewater sampler and analyzer (or the automatic wastewater quality monitoring equipment) must be connected with the Control Room of the DONREs automatic wastewater monitoring network.

II. HOW TO IDENTIFY SAMPLING LOCATIONS FOR THE SOURCE OF WASTEWATER DISCHARGE?
1. Construction of the wastewater source sampling points - When building the wastewater discharge points into the common wastewater network, the manhole should be positioned at the place convenient for wastewater inspection and supervision. The manhole should be placed next to the entitys fence at the outside to facilitate the supervision of the wastewater discharge by the local authorities and management agencies. - The cover of the manhole should be designed and constructed to facilitate the wastewater monitoring and to be easily opened when needed. To facilitate wastewater monitoring and sampling, the manholes minimum diameter or width should be 0.7m; the wastewater inlet must be placed 0.5m above the bottom of the manhole, and wastewater outlet must be placed 0.3m above the manholes bottom - Strictly ban the construction of the hidden wastewater discharge points. 2. Construction of the air emission monitoring points - The generator of air emission or exhaust air via stacks needs to build the air emission or exhaust air monitoring points on the air emission discharge pipeline or on the stack. - The exhaust air monitoring point must be placed at the height level which is at least 3 times of the stacks diameter. The exhaust air sampling points diameter is 100mm for stacks with diameter of more than 300mm; and is 10mm for stacks with diameter of less than 300mm. Each stack must have 2 exhaust air sampling points on the same cross sectional area and together with the center point of the crosssectional area to make an angle of 900.

1. Pay a fine from VND 2,000,000 to VND 5,000,000 if: - Not published the brief of the EIA at the projects location; - No report or make a false report on the construction plan of the environmental protection facilities; - Not build and not submit the operational trial plan of the environmental treatment facilities; - Not report or make a false report on the modifications of and changes of the contents and the environmental protection measures in the EIA. 2. Pay a fine between VND 40,000,000 to VND 70,000,000 if the entity does not fully comply with all commitments specified in the EIA and in the EIA Approval Decision. 3. Pay a fine from VND70,000,000 to VND 100,000,000 if put the environmental facilities into operation before getting approval from authorized agencies that the environmental facilities are done properly as committed in the EIA; 4. Pay a fine between VND 130,000,000 and VND170,000,000 if environmental facilities are not built or not built properly; not operated, not regularly operated or not operated in accordance with the approved environmental treatment procedure; 5. Pay a fine from VND 200,000,000 to VND 300,000,000 if the EIA or the EPP is not available.
