REVISED EUROPEAN
SOCIAL CHARTER
OBLIGATIONS OF STATE
AND ROLE OF SOCIAL PARTNERS
Summary
The paper deals with undertakings of Serbia and the role of social partners
in implementation of Revised European Social Charter upon ratification by Serbia in 2009. The ratification instrument has included the vast majority of rights
and principles guaranteed by the Charter, except Article 27 (The right of workers with family responsibilities to equal opportunities and equal treatment)
and Article 31 (The right to housing), and several numbered paragraphs (Art.
2, para. 4, Art. 6, para. 4, Art. 10, para. 5, Art. 17, para. 1a, Art. 19 para. 11 and
12). Serbia is bound by all nine articles of so called hardcore provisions of the
Charter (1, 5, 6, 7, 12, 16, 19 and 20) with exemption of few numbered paragraphs meaning very ambitious undertakings.
Implementing methods shall include not only laws or regulations but collective agreements between representative social partners organisations, as
well as other appropriate means. That is why the author stresses particular importance of social partners in Charter implementation, and provides panorama
of tripartite and multipartite institutions established at republic and local levels
according to the Law on Social and Economic Councils (2004) and Law on
Employment and Unemployment Insurance (2009), etc.
The paper contains legal analysis and comments on compatibility of Serbian labour and social legislation in force with selected numbers of hardcore
provisions and non hardcore provisions of the Charter. The author attributes
particular attention to analyzing some recently passed legislation based on modern legal concepts, and makes the comparison with law and practice of the
Charter. Some ideas for further reform process and harmonization of labour legislation in order to meet the standards of European labour (and social) law are

provided as well. In many regards the positive assessments of legislative and


practical compatibility is given such as the Law on Professional Rehabilitation and Employment of Disabled Persons (2009); Proposal for a Law on Prevention of Harassment (mobbing) at Work (2009); Proposal for a Law on Voluntary Work (2009), etc. However, the author finds that several new laws should be passed: the Law on Work Councils; the Law on Insurance from Professional Risks (work accidents - injury at work and professional illness). Also,
new Law on Strike (and lockout) should be adopted in a more coherent way.
The author also stresses the need for a more active role of social partners
and social NGO-s in implementation of standards set by the Revised European
Social Charter, having in mind that social dialogue and system of collective
agreements is underdeveloped, more particularly at the sector level. The role of
republic and local Social and Economic Councils should be of particular importance in the process of RESC implementation.
Supervisory system for applying Revised European Social Charter is treated in details. The system is based on examination of the national reports that
Serbia bounded by the Charter, submits at regular intervals each year either
on hardcore provisions or on a selection of non hardcore provisions. First national report shall be submitted three years after ratification of the Charter. The
control mechanism functions in the following way: firstly, analysis of national
report is examined before the European Committee for Social Rights (positive or negative conclusions of independent experts); then the Government
Committee, consisted of representatives of the Contract Parties and observers
from the European social partners, prepares the Committee of Ministers decisions. Based on the Governments Committees report, the Committee of Ministers adopts a resolution concerning entire supervision cycle and individual recommendations addressed to the States in question. The author gives particular
attention to the Case Law of European Social Charter.
The Additional Protocol that provides for a system of collective complaints
(1995) enables dealing with collective complaints (submitted by employers and
workers organisations, nongovernmental organisations at national or international level) against alleged violation of the Charter in addition to the procedure
of examination of governmental reports; however Serbia has not ratified this
Protocol.
