The software and accompanying documentation are proprietary products of Mineral Technologies, Inc. and are protected under the copyright la ws of the United States and by international treaties. Ownership of the softwar e and all copies, modifications and merged portions thereof shall at all times r emain with Mineral Technologies, Inc. or its licensors. 1. GRANT OF LICENSE. The software and accompanying documentation are being lic ensed to you, which means you have the right to use the software in accordance w ith the License Agreement. The software is considered in use on a computer when it is loaded into temporary or permanent memory. You may make a single copy of the software solely for backup purposes. Any copy must include the copyright n otices. 2. PERSONAL LICENSE. This license is personal to you. You may not sublicense, lease, sell or otherwise transfer the software or any of the accompanying docum entation to any other person. You may use the software only for evaluation purp oses. 3. NON PERMITTED USES. You may not copy, modify, alter or transfer the softwar e except as permitted in this license agreement. You may not translate, reverse program, disassemble, decompile or otherwise reverse engineer the software. 4. LIMITED WARRANTY. This software is warranted to perform substantially in ac cordance with the accompanying documentation. Mineral Technologies, Inc. entire liability and your exclusive remedy under this Limited Warranty shall be the re pair or replacement of any software that fails to conform to this Limited Warran ty. This software simulation system is not warranted to reflect, predict, descr ibe or model any real or proposed equipment or collection of equipments in any f orm. 5. LIMITED LIABILITY. In no event shall Mineral Technologies, Inc. liability r elated to the software exceed the amount paid by you for the software. Mineral Technologies, Inc. shall not be liable for any damages whatsoever arising out of or related to the use of or inability to use the software, including but not li mited to direct, indirect, incidental or consequential damages. You must accept this agreement before you can use this product. If you do not a ccept the terms of the License Agreement, you should promptly return the product for a refund.
