Officer J. R. Ricks #3484
Thave reviewed the attached LAD case involving Officer Ricks. [concur with Lieutenant Stone's
assessment of Sustaining Allegations 2, 3 and 4. I do not concur that Allegation #1 is Exonerated, [
recommend this Allegation be Not-Sustained. Even though the charges of assault were dropped, | am not
convinced that Officer Ricks” actions of punching the bus driver were completely justified. I can agree
that Officer Ricks has the right to defend himself but the amount of force used did not match the force
used by the bus driver. Sergeant Smith has recommended a six day suspension and Lieutenant Stone has
recommended an Indefinite Suspension. I recommend that Officer Ricks receive an Indefinite
Suspension.
Taking this as a stand alone incident I can not say that Officer Ricks should be Indefinitely Suspended
from the department, However, this isthe last case in a string of several in Officer Ricks short tenure
with the department and assigned under my command that he has shown a history of poor decisions and
bbad judgment. As a captain of the police department, | have to ask myself, when will this officer mature
to the level that is required of him and can we afford to allow him to keep making bad decisions that can
affect the department and the community. Lieutenant Stone has put forth a valid argument that Officer
Ricks does not show the maturity level that is required of a Fort Worth Police Officer. Whatever the case
may be whether alcohol related or not, Officer Ricks used very poor judgment in his encounter with other
citizens during this incident.
On September 14, 2006 at 1600 hours, I met with Officer Ricks along with Lieutenant Stone in my office
to discuss these Allegations and my recommendation. I advised Officer Ricks of my recommendation
and he had nothing further to add nor did he have any questions
