E RE"ISED PENAL CODE #$ INCREASING T!E PENALTIES OR ESTA A COMMITTED #$ MEANS O #O%NCING C!EC&S WHEREAS, reports received of late indicate an upsurge of estafa (swindling) cases committed by means of bouncing c ec!s" WHEREAS, if not c ec!ed at once, t ese criminal acts would erode t e people#s confidence in t e use of negotiable instruments as a medium of commercial transaction and conse$uently result in t e retardation of trade and commerce and t e undermining of t e ban!ing system of t e country" WHEREAS, it is vitally necessary to arrest and curb t e rise in t is !ind of estafa cases by increasing t e e%isting penalties provided t erefor" &'W, (HERE)'RE, *, )ER+*&A&+ E, MAR-'S, .resident of t e . ilippines, by virtue of t e powers in me vested by t e -onstitution, do ereby decree as part of t e law of t e land t e following amendment to Article /01 of t e Revised .enal -ode2 Sect'o( 1. Any person w o s all defraud anot er by means of false pretenses or fraudulent acts as defined in paragrap 3(d) of Article /01 of t e Revised .enal -ode, as amended by Republic Act &o, 4551, s all be punis ed by2 0st, ( e penalty of reclusion temporal if t e amount of t e fraud is over 03,666 pesos but not e%ceed 33,666 pesos, and if suc amount e%ceeds t e latter sum, t e penalty provided in t is paragrap s all be imposed in its ma%imum period, adding one year for eac additional 06,666 pesos but t e total penalty w ic may be imposed s all in no case e%ceed t irty years, *n suc cases, and in connection wit t e accessory penalties w ic may be imposed under t e Revised .enal -ode, t e penalty s all be termed reclusion perpetua" 3nd, ( e penalty of prision mayor in its ma%imum period, if t e amount of t e fraud is over 7,666 pesos but does not e%ceed 03,666 pesos" /rd, ( e penalty of prision mayor in its medium period, if suc amount is over 366 pesos but does not e%ceed 7,666 pesos" and, 4t , 8y prision mayor in its ma%imum period, if suc amount does not e%ceed 366 pesos, Sect'o( 2.
