Evidence B 2013: Assignment

In Australia, at common law, expert witnesses enjoy an absolute immunity from any civil action being commenced against them for breach of duty, whether in contract or negligence, in relation to their participation in legal proceedings. However, in the recent case of Jones v Kaney [2011] UKSC 13, the majority of the Supreme Court in UK reversed this line of authority dating back 400 years and decided that expert witness immunity should be abolished. The mere fact that the immunity is long-established is not a sufficient reason for blessing it with eternal life per Lord Dyson. Discuss whether or not expert witness immunity in Australia should continue to be blessed with eternal life. -----------
