DEPARTMENT OF DEFENSE BUL 3 1 2009 TAGON WASHINGTON, DC 20301-1155 Ref: 09-F-1090 Dear Mr. Good: This is in response to your Freedom of Information Act (FOIA) request for information regarding the aerial mission of the VC-25A over New York City on April 27, 2009. This correspondence responds to requests submitted to both the Air Force and the Office of the Secretary of Defense. The enclosed CD-ROM is provided to you in response to your request for the records described above and includes three portable document format (PDF) files of passenger manifest, e-mails regarding flight planning, cost computation, and event reaction, and 146 photos taken during the flight. In consultation with other FOIA Initial Denial Authorities with equities in this information, the Office of the Secretary of Defense (OSD), the Joint Staff (JS), the Office of the Secretary of the Air Force (SAF/XCPP), and the White House Military Office (WHMO), determined that some of the information is properly withheld under FOIA exemptions (b)(2), (b)(5) and (b)(6). Some individual Goverment phone numbers, email addresses and other information have been withheld pursuant to $ U.S.C. § 552(b)(2), High, which pertains to agency internal rules and practices that, if released would risk their circumvention, The names, email addresses, and phone numbers of some Government personnel have also been withheld under 5 U.S.C. § 552(b)(6), which protects information that, if released, would constitute a clearly unwarranted invasion of personal privacy. Individual Government phone numbers and email addresses are used primarily for internal government use and release would have a negative impact on operations and permit a clearly unwarranted invasion of personal privacy. However, individuals who, due to the nature of their work or interact with the public have not had their contact information removed. Some pre-decisional, deliberative documents and e-mails as well as documents and emails protected under the presidential communications privilege, have been withheld under 5 U.S.C. § 552(b)(5). Documents and emails that are not subject to the FOIA under the Presidential Records Act, 44 U.S.C. § 2201 et seq., have also been Withheld. These records remain under the exclusive legal custody and control of the White House. Further, the records are protected by the presidential communications privilege of exemption (b)(5).
