Plaintiff DAVID F. JADWIN, D.O. hereby requests accommodation on behalf of George

Alkhouri, M.D., who has been subpoenaed as a witness in this case.

Dr. Alkhouri is the only full-time OB/GYN specialist serving the Golden Valley area. Dr.
22
Alkhouri works at the Golden Valley Health Clinic, and performs surgeries and/or deliveries on a daily
23
basis. Further, Dr. Alkhouri is on call on an emergency basis twenty-four hours per day, seven days per
24
week. Dr. Alkhouri has been unable to secure coverage in order to take time off to appear at trial in this
25
matter.

Plaintiff requests that, under these circumstances, the Court find that Dr. Alkhouri is
27
"unavailable" to testify at trial, and asks that the Court allow Dr. Alkhouri's testimony to be given by
