That on or about the 29th day of August 2013, in Jackson County, Mississippi, the
defendant,

then the Sheriff of Jackson County, Mississippi, knowingly engaged in misleading conduct

toward Jackson County Sheriff s Deputy Christopher Goff, with the intent to hinder, delay,
and prevent the communication to a federal law enforcement officer of information relating

to the commission or possible commission of a federal offense in Mobile County, within the Southern District of Alabama, to-wit, the June T9,2012 kicking of J.M.S. by BYRD, after J.M.S. had been placed under arrest and handcuffed in Mobile County, and while

BYRD was acting under color of law. Specifically, BYRD falsely stated to Goff,

remember me saying anything to that guy? Kicking or assaulting him, 'cause I don't," when, in truth and in fact, BYRD then well knew that he had kicked the then arrested and handcuffed J.M.S. In violation of Title 18, United States Code, Section 1512(bX3).
