TOWNSHIP OF EWING

PLANNING BOARD AGENDA


The Ewing Township Planning Board will hold its regularly scheduled meeting on Thursday,
September 3, 2009. The board will begin hearing applications at 7:00 p.m. in the Township Council
Room, Municipal Complex, 2 Jake Garzio Drive, Ewing, NJ. Formal action will be taken. The
Agenda for the meeting is as follows:

Held Over Matters:

American Properties at Scotch Road LLC On March 1, 2007, the Applicants received
and Herring Land Group, LLC preliminary and final major subdivision
Sam Weinroth and Scotch Road approval with variances and waivers to divide
Block 371, Lots 3.03, 3.04, and 3.05 (formerly Lot into three lots and preliminary and final site
3.02) plan approval with variances and waivers to
IP-1 Zone construct on newly created Lot 3.03 a 4 story
extended stay hotel. On July 16, 2009 the New
Jersey Superior Court, Appellate Division
rendered a decision in the matter of G.F.
Princeton, LLC v. Ewing Township Planning
Board, Herring Land Group, LLC and
American Properties at Scotch Road, LLC,
Docket No. A-1522-07T3 wherein the Court
remanded the Board’s grant of the approvals
described above for reconsideration by the
Board. The Applicants are seeking
reconsideration without prejudice to their
respective rights to appeal the Appellate
Division’s ruling to the New Jersey Supreme
Court.
