TENANT POLICY: EL ZAGUN The rental policy for El Zagun reflects the special character of the building, its

architectural and historical significance, and the responsibility of its nonprofit owner, the Historic Santa Fe Foundation (HSFF) to protect and preserve the building for the public benefit HSFF ACCESS TO APARTMENTS! "s stated in apart#ent leases, the Foundation has access to apart#ents for #aintenance purposes and to fulfill its responsibility as the steward of a historic property ACCESS TO THE PUBLIC: "s a nonprofit educational organi$ation, the Foundation has the responsibility of #aintaining and preserving El Zagun for the %public benefit,% i e ! public education and en&oy#ent To this end, the public is allowed li#ited access to the grounds and building, during restricted hours Every effort is #ade to #eet the privacy and security needs of tenants, in spite of re'uire#ents for public access Tenants #ay be re'uested to open their apart#ents for public viewing for a few hours one afternoon a year, during %Historic (reservation )ee*,% when all HSFF properties are open to the public Tenants #ay be e+cused by the HSFF ,oard fro# participating in this annual %open house% because of ill health or other reasons Tenants will be notified in advance of any special functions planned for the pre#ises, such as tours or receptions RENTS: -ent schedules will be reviewed periodically by the HSFF ,oard to enable the ,oard to #aintain a balance between #aintenance costs and rental inco#e -ents in co#parable buildings will also be ta*en into account, although it is the policy of the Foundation to #aintain %below #ar*et% rents at El Zagun to ensure utili$ation of the building for the %public benefit % .ou can e+pect a /0 rent increase annually -ents are due and payable on the first of each #onth 1n e+change for below2#ar*et rents, we as* that each artist donate a piece of their wor* to the Foundation for their private collection These wor*s will be added to the Foundation3s e+isting collection which includes wor*s by 4orothy Stewart, 5live -ush, 6aura 7ilpin, Hel#uth 8au#er, 1rene von Horvath and others

LEASES: "ll apart#ent occupants will be re'uired to agree to the ter#s of a lease and to sign a lease Tenants #ust notify the HSFF at least one #onth in advance before vacating an apart#ent The lease ter# is one year VACANCIES: "ccording to tradition, El Zagun tenants in order of seniority have a right2of2first2refusal for any apart#ent which beco#es vacant 1f no current tenant is interested in the available apart#ent, the vacancy will be filled fro# the list of prospective tenants (reference will be given to applicants who are! prepared to use the apart#ent as their pri#ary residence, on a long2ter# basis9 supportive of the wor* of the Foundation and willing to abide by its property2use guidelines, including the re'uire#ent that apart#ents be #ade available for public viewing during Historic (reservation )ee*9 artists and writers, and those involved in the fields of art and literature, particularly those see*ing %affordable% housing9 and descendants of the original owners of the property, i e ! #e#bers of the ,aca:;ohnson fa#ily9

PETS: The apart#ents will not be rented to applicants with dogs with the e+ception of apart#ent < SUBLEASES: "part#ents #ay not be sublet 7uest privileges e+tend for => days only FURNISHINGS: "n inventory is #aintained by the HSFF of Foundation2owned furniture in apart#ents 8o HSFF2owned furniture #ay be altered or re#oved fro# an apart#ent without the e+press per#ission of the Foundation?s E+ecutive 4irector Should the Foundation decide to sell or otherwise dispose of any furnishings, first choice will be given to Eli$abeth ,erry, grandniece of a past owner of the property

GROUNDS: The garden at El Zagun and the bac* lawn #ay be used by tenants and their guests, but the flowers in these areas are for the en&oy#ent of all and #ay not be pic*ed by tenants or guests MAINTENANCE: Tenants #ust pro#ptly notify the Foundation?s E+ecutive 4irector of #aintenance proble#s in apart#ents and garages to ensure proper #aintenance of the building PARKING: (riority in renting garages will be given to El Zagun tenants9 rent is payable on the first of the #onth Surface par*ing spaces are available, at no charge to tenants, to the north of the building, on the lower level
