We seriously reflected about the problem between Crying Nut and CNBLU , wor!ing hard to loo! at the situation without clouded "udgement or bias. We are carefully writing this post. First, let us ma!e it clear that we ha#e no bad feelings towards CNBLU and we do not want to use them in any way.

$he situation started two years ago in the fall of %&'', where we recei#ed a phone call from a large company. $hey as!ed us if they can use CNBLU (s li#e co#er #ersion of Crying Nut(s )*ffside+ because CNBLU was releasing a ,-, in $aiwan. We were confused by the random .uestion, but we politely refused. We said that the li#e copy was fine, but politely refused the footage use in a ,-,. We thought that was the end of it.

But we later heard that our song was used in a ,-, released in /apan, and we were se#erely offended. 0nd we also saw the #ideo on YouTube by chance, and we heard our instruments and #oice in the li#e #ersion. $hey used our 01 20ll 1ecording or *riginal 1ecording3, we saw the ,-, and our pride was completely hurt, and we loo!ed up if it was *4 to do so under copyright and neighboring copyright laws. 0fter that, we too! legal measures. We learned the problem with the broadcast along with the ,-, production and distribution was with the broadcast station and the large company. While the copyright and the neighboring copyright problems were with CNBLU .

We already too! up the issue with the large company and recei#ed an official apology. 0nd we wanted to also recei#e an apology from CNBLU on the copyright issue.

But we thought that if there was another similar incident to occur in the future and the end result was "ust recei#ing an apology, another such damaging incident could occur. 0nd if there was no legal precedence set, we also thought that powerless indie bands could ha#e e5tremely unfair harm bestowed upon them if something li!e this occurred again in the future. 0lso because CNBLU had a plagiarism issue before with the indie band 6555(, we had to ta!e time to accurately prepare legal measures.

We are clearly stating that our aim is not noise mar!eting through lawsuits with CNBLU , or to stop a popular band(s future because of money.

We thought it was unprofessional and could not understand it when they tried to appeal to our emotions by telling us that they had no other choice because of the broadcast station. We then saw CNBLU (s official apology. We felt a little better and reali<ed CNBLU was also suffering, and we honestly had a lot of mi5ed emotions. But we also felt a bit bitter about the apology. We saw an article saying that they apologi<ed sincerely and that they would try to stop another situation from happening==. But they didn(t say how they were going to ma!e an effort to stop it from happening. $he reason why we too! legal measures is to stop a re:occurrence so no future artist can be harmed. 2Honestly, we wish there would be a good alternati#e.3

We spo!e the truth to a large company and confidently gained our rights. 0nd they ac!nowledged their wrong doing, so we were able to find a middle ground. We are also telling CNBLU the truth and we are loo!ing for our rights. 7t is o!ay if we are told that we ha#e a double standard, or if we(re called narrow:minded sunbaes8 We are "ust telling the truth and we want to find our rights and our honor.

We do not want to hurt anyone and we also don(t want to get hurt, this is the mindset of indie band Crying Nut.

0lso, the legal compensation we would get from CNBLU will be deposited to our legal firm to be donated for the copyrights in order to help grow the indie scene.

We heard that CNBLU were also once an indie band in /apan. What is 6indie(8 >imply, it is 6independence(8 $hey create their own music, produce in their system, and distribute through a pretty independent method. $he most important thing is to ha#e full responsibility o#er their products and actions. 67ndie( is not mar!eting. 7t is a full mindset.
